their_o executor_n administrator_n or_o assign_v successive_o without_o preference_n of_o one_o before_o the_o other_o and_o not_o otherwise_o and_o if_o any_o undue_a preference_n be_v make_v in_o enter_v of_o any_o gold_n or_o silver_n or_o deliver_v out_o of_o any_o money_n coin_v contrary_a to_o the_o true_a intent_n and_o meaning_n of_o this_o act_n by_o any_o officer_n or_o officer_n of_o the_o mint_n or_o mint_n penalty_n penalty_n then_o the_o party_n or_o party_n offend_v shall_v be_v liable_a by_o action_n of_o debt_n or_o in_o the_o case_n to_o pay_v the_o value_n of_o the_o gold_n or_o silver_n bring_v in_o and_o not_o enter_v and_o deliver_v according_a to_o the_o true_a intent_n and_o meaning_n and_o direction_n of_o this_o act_n as_o aforesaid_a with_o damage_n and_o cost_v to_o the_o party_n or_o party_n grieve_v and_o shall_v be_v forejudged_n from_o he_o or_o their_o place_n or_o office_n and_o if_o such_o preference_n be_v undue_o make_v by_o any_o of_o he_o or_o their_o deputy_n or_o deputy_n clerk_n or_o clerk_n without_o direction_n or_o privity_n of_o he_o or_o their_o master_n or_o master_n than_o such_o deputy_n or_o deputy_n clerk_n or_o clerk_n only_o shall_v be_v liable_a to_o such_o action_n damage_n and_o cost_v as_o aforesaid_a and_o be_v for_o ever_o after_o uncapable_a of_o serve_v or_o bear_v office_n in_o any_o mint_n in_o the_o bringer_n in_o thereof_o to_o be_v coin_v a_o bill_n under_o his_o hand_n denote_v the_o weight_n fineness_n and_o value_v thereof_o together_o with_o the_o day_n and_o order_n of_o its_o delivery_n into_o the_o say_a mint_n or_o mint_n and_o for_o the_o further_a encouragement_n and_o assurance_n of_o such_o as_o shall_v bring_v any_o gold_n or_o silver_n into_o his_o majesty_n say_a mint_n or_o mint_n to_o be_v coin_v be_v it_o enact_v coin_a there_o shall_v be_v no_o seizure_n or_o forfeiture_n etc._n etc._n of_o any_o gold_n or_o silver_n bring_v in_o to_o be_v coin_a and_o it_o be_v hereby_o enact_v by_o the_o authority_n aforesaid_a that_o no_o confiscation_n forfeiture_n seizure_n attachment_n stop_v or_o restraint_n whatsoever_o shall_v be_v make_v in_o the_o say_a mint_n or_o mint_n of_o any_o gold_n or_o silver_n bring_v in_o to_o be_v coin_v for_o or_o by_o reason_n of_o any_o embargo_n breach_n of_o the_o peace_n letter_n of_o mart_n or_o reprisal_n or_o war_n with_o any_o foreign_a nation_n or_o upon_o any_o other_o account_n or_o pretence_n whatsoever_o but_o that_o all_o gold_n and_o silver_n bring_v into_o any_o of_o his_o majesty_n mint_n or_o mint_n within_o the_o kingdom_n of_o england_n to_o be_v coin_v shall_v true_o and_o with_o all_o convenient_a speed_n be_v coin_v and_o deliver_v out_o to_o the_o respective_a bringer_n or_o bringer_n in_o thereof_o their_o executor_n administrator_n or_o assign_v according_a to_o the_o rule_n and_o direction_n of_o this_o act._n and_o whereas_o it_o can_v be_v reasonable_o expect_v that_o the_o expense_n waste_v from_o all_o other_o money_n by_o they_o collect_v and_o levy_v upon_o the_o same_o commodity_n or_o upon_o any_o other_o commodity_n or_o merchandize_n whatsoever_o and_o to_o be_v by_o the_o say_a collector_n or_o collector_n respective_o so_o answer_v and_o pay_v quarterly_o into_o the_o receipt_n of_o the_o exchequer_n of_o your_o majesty_n your_o heir_n and_o successor_n there_o also_o to_o be_v keep_v distinct_a and_o apart_o from_o all_o other_o money_n arise_v by_o the_o custom_n or_o by_o any_o other_o way_n or_o revenue_n whatsoever_o which_o say_v duty_n they_o be_v hereby_o enjoin_v to_o receive_v and_o pay_v according_a to_o the_o several_a direction_n of_o this_o act_n without_o any_o salary_n or_o fee_n and_o be_v it_o further_o enact_v and_o declare_v by_o the_o shall_v be_v apply_v or_o convert_v to_o any_o use_n or_o use_n whatsoever_o mint_n money_n leviable_a upon_o this_o act_n shall_v be_v employ_v only_o to_o the_o use_n of_o the_o mint_n other_o then_o to_o the_o defray_v the_o charge_n or_o expense_n of_o the_o mint_n or_o mint_n and_o of_o the_o assay_v melt_v down_o waste_v and_o coinage_n of_o gold_n and_o silver_n and_o the_o encouragement_n of_o the_o bring_n in_o of_o gold_n and_o silver_n into_o the_o say_a mint_n or_o mint_n there_o to_o be_v coin_v into_o the_o current_a coin_n of_o this_o kingdom_n nor_o shall_v any_o of_o the_o say_a money_n be_v issue_v out_o of_o the_o exchequer_n but_o by_o order_n or_o warrant_n of_o the_o lord_n treasurer_n and_o vnder-treasurer_n or_o commissioner_n of_o the_o entry_n make_v before_o land_v common_a brewer_n to_o account_v weekly_o and_o other_o retailer_n of_o beer_n ale_n etc._n etc._n monthly_a and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o several_a rate_n duty_n and_o charge_n of_o excise_n or_o new_a impost_n above_o mention_v hereby_o set_v or_o impose_v upon_o all_o and_o every_o the_o say_v foreign_a liquor_n which_o shall_v be_v import_v or_o bring_v into_o all_o or_o any_o the_o port_n of_o this_o kingdom_n and_o dominion_n thereof_o aforesaid_a from_o and_o after_o the_o five_o and_o twenty_o day_n of_o december_n next_o shall_v be_v from_o time_n to_o time_n satisfy_v and_o pay_v by_o the_o merchant_n or_o merchant_n importer_n or_o importer_n of_o the_o same_o in_o ready_a money_n upon_o his_o or_o their_o entry_n or_o entry_n make_v and_o before_o the_o land_n thereof_o aforesaid_a the_o penalty_n for_o not_o account_v as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o common_a brewer_n of_o béer_n and_o ale_n shall_v once_o in_o every_o wéek_v and_o all_o inn-kéepers_a victualler_n and_o other_o retayler_n of_o béer_n ale_n cider_n perry_n metheglin_n or_o strong-water_n brew_v make_v or_o retail_v the_o same_o shall_v once_o in_o every_o month_n make_v true_a and_o particular_a entry_n at_o the_o office_n of_o excise_n within_o the_o limit_n of_o which_o the_o say_a commodity_n and_o manufacture_n be_v make_v of_o all_o béer_n ale_n perry_n cider_n metheglin_n strong-water_n or_o other_o the_o liquor_n aforesaid_a which_o they_o or_o any_o of_o they_o shall_v brew_n make_v or_o retail_n in_o that_o wéek_v and_o month_n respective_o as_o aforesaid_a aforesaid_a the_o penalty_n for_o not_o account_v as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o such_o common_a brewer_n who_o do_v not_o once_o a_o wéek_v make_v due_a and_o particular_a entry_n shall_v forfeit_v five_o pound_n and_o that_o every_o such_o inn-kéepe_a who_o do_v not_o make_v true_a and_o particular_a entry_n once_o a_o month_n shall_v forfeit_v five_o pound_n and_o that_o every_o alehouse-kéepe_a victualler_n or_o other_o retailer_n who_o do_v not_o once_o a_o month_n make_v due_a and_o particular_a entry_n shall_v forfeit_v twenty_o shilling_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o common_a brewer_n who_o shall_v not_o pay_v and_o clear_v off_o within_o a_o wéek_v after_o he_o make_v his_o entry_n or_o aught_o to_o have_v make_v his_o entry_n as_o aforesaid_a shall_v pay_v double_a the_o value_n of_o the_o duty_n and_o that_o every_o inn-kéepe_a alehouse-kéepe_a victualler_n or_o other_o retailer_n who_o shall_v not_o pay_v and_o clear_v off_o within_o a_o month_n after_o he_o make_v his_o entry_n or_o aught_o to_o have_v make_v his_o entry_n as_o aforesaid_a shall_v pay_v double_a the_o value_n of_o gager_n the_o power_n of_o the_o gager_n to_o travel_v for_o the_o make_n of_o the_o say_a entry_n or_o payment_n of_o the_o say_a duty_n or_o other_o cause_n whatsoever_o touch_v or_o concern_v the_o same_o if_o he_o live_v in_o a_o market-town_n out_o of_o the_o say_a town_n if_o he_o live_v out_o of_o a_o market-town_n then_o to_o no_o other_o place_n then_o to_o the_o next_o market-town_n to_o his_o habitation_n in_o the_o same_o county_n on_o the_o market-day_n and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o commissioner_n who_o shall_v be_v appoint_v by_o his_o majesty_n for_o put_v this_o act_n in_o execution_n and_o their_o sub-commissioner_n in_o their_o respective_a circuit_n and_o division_n shall_v hereby_o have_v power_n to_o constitute_v under_o their_o hand_n and_o seal_n such_o and_o so_o many_o gager_n as_o they_o shall_v find_v needful_a which_o gager_n and_o every_o of_o they_o shall_v at_o all_o time_n as_o well_o brewhouse_n distilling-house_n and_o all_o other_o house_n and_o place_n whatsoever_o belong_v to_o or_o use_v by_o any_o brewer_n inn-kéepe_a victualler_n or_o other_o retailer_n of_o béer_n brew_v or_o make_v the_o same_o as_o aforesaid_a or_o by_o any_o distiller_n of_o strong-water_n or_o retailer_n of_o other_o the_o liquor_n aforesaid_a and_o to_o gage_n all_o copper_n fat_n be_v and_o vessel_n in_o the_o same_o and_o to_o take_v a_o account_n of_o béer_o ale_n word_n perry_n cider_n strong-water_n aquavite_n metheglin_n or_o other_o the_o liquor_n aforesaid_a in_o the_o say_a offend_v to_o gaol_n till_o the_o next_o session_n there_o to_o be_v indict_v and_o proceed_v against_o for_o the_o same_o and_o that_o the_o officer_n and_o inhabitant_n of_o the_o village_n or_o parish_n where_o such_o offence_n shall_v happen_v shall_v be_v assistant_n therein_o and_o moreover_o the_o party_n grieve_v shall_v have_v his_o action_n or_o action_n against_o such_o offender_n or_o offender_n and_o therein_o recover_v his_o treble_a damage_n and_o treble_a cost_n in_o which_o action_n no_o essoin_fw-fr wager_n of_o law_n aid-prayer_n privilege_n protection_n imparlance_n injunction_n or_o order_n of_o restraint_n depend_v no_o action_n upon_o this_o statute_n to_o be_v stay_v but_o by_o order_n of_o the_o court_n where_o such_o action_n depend_v shall_v be_v grant_v or_o allow_v and_o if_o any_o person_n or_o person_n shall_v after_o notice_n give_v that_o the_o action_n depend_v be_v ground_v upon_o this_o statute_n cause_n or_o procure_v any_o action_n at_o the_o common_a law_n ground_v on_o this_o statute_n to_o be_v delay_v or_o stay_v before_o judgement_n by_o colour_n or_o mean_n of_o any_o order_n power_n warrant_v or_o authority_n save_v only_o particular_a entry_n once_o a_o month_n shall_v forfeit_v five_o pound_n and_o that_o every_o alehouse-kéepe_a victualler_n or_o other_o retailer_n who_o do_v not_o once_o a_o month_n make_v due_a call_v or_o know_v by_o the_o name_n of_o the_o sessions-house_n or_o common_a hall_n in_o leeds_n aforesaid_a and_o also_o at_o such_o other_o time_n and_o place_n of_o the_o say_v west-riding_a as_o shall_v from_o time_n to_o time_n be_v appoint_v by_o the_o say_a justice_n master_n warden_n and_o assistant_n or_o any_o thirtéen_n of_o they_o upon_o eight_o day_n notice_n or_o warning_n to_o be_v give_v of_o such_o meeting_n and_o court_n to_o be_v hold_v and_o in_o case_n that_o the_o master_n warden_n and_o assistant_n or_o the_o major_a part_n of_o they_o shall_v refuse_v or_o neglect_v to_o appear_v so_o as_o a_o court_n can_v be_v hold_v according_o as_o be_v before_o direct_v that_o then_o such_o master_n warden_n or_o assistant_n so_o refuse_v or_o neglect_v shall_v forfeit_v the_o sum_n of_o twenty_o shilling_n the_o one_o moiety_n to_o the_o use_n of_o the_o poor_a of_o such_o respective_a town_n where_o the_o person_n so_o refuse_v or_o neglect_v shall_v live_v the_o other_o moiety_n to_o the_o use_n of_o the_o corporation_n and_o the_o say_a justice_n master_n warden_n and_o assistant_n or_o any_o thirtéen_n of_o they_o be_v hereby_o impower_v to_o summon_v to_o go_v to_o the_o use_n of_o the_o say_a corporation_n and_o the_o other_o half_a or_o moiety_n to_o the_o use_n of_o the_o poor_a of_o the_o parish_n where_o such_o person_n so_o offend_v may_v be_v dwell_v and_o inhabit_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a justice_n master_n cloth_n power_n to_o appoint_v searcher_n of_o cloth_n warden_n and_o assistant_n or_o any_o thirtéen_n of_o they_o shall_v have_v power_n to_o nominate_v and_o choose_v searcher_n of_o cloth_n in_o the_o several_a place_n of_o the_o say_v west-riding_a who_o shall_v be_v swear_v before_o they_o or_o any_o thirtéen_n of_o they_o in_o manner_n aforesaid_a for_o the_o true_a search_n of_o cloth_n that_o it_o be_v of_o a_o due_a weight_n length_n and_o breadth_n
