be_v do_v concerning_o other_o grievance_n but_o in_o truth_n it_o be_v well_o know_v that_o about_o that_o time_n upon_o occasion_n of_o our_o war_n there_o be_v divers_a other_o charge_n impose_v by_o our_o lieutenant_n and_o other_o of_o a_o far_o differ_v nature_n most_o of_o which_o be_v by_o direction_n from_o we_o or_o our_o privy_a council_n according_a to_o the_o exigency_n of_o the_o time_n and_o some_o former_a practice_n and_o we_o do_v believe_v that_o there_o be_v at_o that_o time_n neither_o complaint_n or_o occasion_n of_o complaint_n against_o the_o impose_n of_o arm_n for_o home_n defence_n of_o the_o kingdom_n howsoever_o we_o be_v sure_a that_o no_o such_o complaint_n be_v particular_o represent_v unto_o we_o or_o our_o answer_n intend_v thereunto_o and_o now_o to_o clear_v this_o sense_n of_o the_o petition_n 〈◊〉_d of_o the_o judgement_n of_o both_o our_o house_n this_o 〈◊〉_d parliament_n we_o demand_v this_o question_n if_o so_o be_v the_o impose_n arm_n for_o defence_n be_v a_o charge_n upon_o the_o subject_a within_o the_o meaning_n of_o this_o petition_n how_o the_o two_o house_n will_v justify_v their_o ordinance_n which_o we_o be_v sure_a they_o will_v not_o call_v a_o act_n of_o parliament_n for_o without_o a_o act_n of_o parliament_n no_o charge_n thereby_o provide_v against_o can_v be_v impose_v upon_o the_o subject_a the_o word_n be_v plain_a that_o no_o man_n shall_v be_v compel_v to_o make_v or_o yield_v any_o gift_n loan_n benevolence_n tax_n or_o other_o such_o like_a charge_n without_o common_a consent_n by_o act_n of_o parliament_n and_o now_o since_o this_o declaration_n have_v give_v we_o such_o occasion_n to_o examine_v our_o commission_n upon_o the_o petition_n of_o right_n we_o shall_v conclude_v out_o of_o that_o petition_n that_o that_o parliament_n do_v conceive_v the_o power_n of_o this_o commission_n warrantable_a in_o every_o point_n for_o it_o be_v plain_o to_o be_v observe_v that_o the_o commons_o do_v then_o take_v into_o consideration_n the_o general_a grievance_n of_o the_o kingdom_n more_o particular_o concerning_o military_a affair_n and_o therein_o the_o action_n of_o lord_n lieutenant_n and_o deputy-lieutenant_n with_o their_o commission_n and_o power_n and_o their_o exceed_n of_o their_o power_n as_o express_o the_o billet_n of_o soldier_n and_o the_o payment_n of_o billet-money_n muster-master_n fee_n and_o other_o of_o that_o nature_n be_v then_o in_o dispute_n and_o although_o the_o two_o house_n can_v not_o but_o take_v notice_n of_o the_o impose_n of_o arm_n upon_o the_o subject_a by_o our_o commission_n of_o lieutenancy_n and_o their_o power_n to_o levy_v call_v together_o arm_n array_n train_n and_o muster_v our_o subject_n inhabit_v in_o our_o several_a county_n and_o to_o conduct_v and_o lead_v they_o against_o all_o our_o enemy_n and_o all_o rebel_n and_o traitor_n from_o time_n to_o time_n as_o need_n shall_v require_v in_o which_o particular_n they_o contain_v the_o power_n of_o our_o commission_n of_o array_n yet_o the_o complaint_n be_v not_o make_v against_o they_o for_o what_o they_o do_v by_o virtue_n of_o their_o commission_n no_o more_o than_o against_o the_o justice_n of_o peace_n though_o complain_v of_o together_o with_o the_o lieutenant_n but_o for_o matter_n wherein_o they_o do_v exceed_v their_o commission_n upon_o the_o command_n or_o direction_n from_o we_o or_o our_o council_n the_o petition_n throughout_o distinguish_v betwixt_o such_o command_n or_o direction_n and_o our_o commission_n so_o that_o we_o conclude_v here_o be_v not_o only_o a_o admission_n but_o a_o approbation_n of_o those_o power_n by_o that_o parliament_n we_o come_v now_o to_o the_o recital_n in_o the_o preamble_n of_o the_o late_a statute_n make_v this_o parliament_n the_o word_n be_v these_o for_o as_o much_o as_o great_a commotion_n and_o rebellion_n have_v be_v late_o raise_v and_o stir_v up_o in_o his_o majesty_n kingdom_n of_o ireland_n by_o the_o wicked_a plot_n and_o conspiracy_n of_o divers_a of_o his_o majesty_n subject_n there_o be_v traitorous_o affect_v to_o the_o great_a endanger_n not_o only_o of_o the_o say_a kingdom_n but_o also_o of_o this_o kingdom_n of_o england_n unless_o a_o speedy_a course_n be_v take_v for_o the_o provent_v hereof_o and_o for_o the_o raise_n and_o press_v of_o man_n for_o those_o service_n and_o whereas_o by_o the_o law_n of_o this_o realm_n none_o of_o his_o majesty_n subject_n ought_v to_o be_v impress_v or_o compel_v to_o go_v out_o of_o his_o county_n to_o serve_v as_o a_o soldier_n in_o the_o war_n except_o in_o case_n of_o necessity_n of_o the_o sudden_a come_n in_o of_o strange_a enemy_n into_o the_o kingdom_n or_o except_o they_o be_v otherwise_o bind_v by_o the_o tenure_n of_o their_o land_n or_o possession_n etc._n etc._n upon_o which_o preamble_n there_o be_v in_o that_o statute_n some_o provision_n make_v for_o a_o time_n for_o raise_v and_o impress_v man_n for_o those_o service_n and_o upon_o this_o preamble_n the_o conclusion_n be_v make_v in_o these_o word_n that_o this_o commission_n be_v direct_o contrary_a to_o this_o declaration_n be_v so_o evident_a that_o it_o require_v no_o application_n to_o this_o objection_n we_o say_v we_o may_v make_v our_o answer_n as_o short_a as_o the_o inference_n be_v by_o affirm_v that_o it_o be_v evident_a that_o this_o commission_n be_v not_o contrary_a to_o this_o recital_n and_o sure_o we_o think_v that_o what_o we_o have_v already_o open_v be_v apply_v to_o this_o objection_n will_v warrant_v that_o answer_n but_o that_o we_o may_v leave_v nothing_o undo_v that_o may_v tend_v towards_o the_o full_a satisfaction_n of_o our_o good_a people_n we_o shall_v also_o give_v this_o a_o particular_a answer_n first_o we_o say_v that_o if_o this_o recital_n have_v be_v a_o act_n yet_o there_o be_v nothing_o in_o our_o commission_n contrary_a to_o the_o letter_n of_o it_o for_o that_o by_o this_o commission_n no_o man_n be_v compellable_a by_o any_o special_a word_n to_o go_v out_o of_o his_o county_n and_o the_o general_a word_n give_v power_n to_o the_o commissioner_n for_o lead_v they_o to_o the_o sea-coast_n or_o elsewhere_o as_o we_o have_v often_o repeat_v be_v with_o these_o limitation_n they_o be_v to_o lead_v they_o but_o when_o there_o be_v imminent_a danger_n of_o enemy_n for_o defence_n of_o the_o kingdom_n and_o then_o only_o they_o be_v to_o be_v lead_v to_o such_o place_n as_o shall_v be_v necessary_a for_o the_o expulsion_n vanquish_a and_o destruction_n of_o the_o say_a enemy_n and_o this_o be_v a_o case_n of_o necessity_n both_o within_o the_o word_n of_o this_o recital_n and_o according_a to_o the_o sense_n of_o the_o same_o word_n in_o the_o statute_n of_o 1._o e._n 3._o and_o 4._o h._n 4._o therein_o mean_v as_o we_o have_v before_o show_v and_o thus_o we_o may_v leave_v this_o objection_n but_o that_o it_o imply_v a_o matter_n of_o a_o great_a consequence_n then_o plain_o appear_v that_o recital_n of_o the_o law_n in_o preamble_n of_o statute_n be_v bind_v for_o in_o this_o objection_n this_o recital_n be_v call_v a_o declaration_n of_o the_o law_n and_o our_o commission_n sard_n to_o be_v contrary_a to_o that_o statute_n and_o it_o further_o imply_v that_o even_o in_o the_o great_a and_o most_o horrid_a rebellion_n the_o subject_n can_v be_v compel_v out_o of_o the_o county_n for_o the_o suppression_n thereof_o but_o to_o this_o we_o answor_n that_o the_o difference_n be_v apparent_a between_o a_o act_n of_o parliament_n declarative_a and_o a_o recital_n in_o a_o preamble_n for_o such_o a_o act_n in_o any_o matter_n though_o mistake_v be_v assent_v unto_o by_o we_o and_o our_o two_o house_n be_v equal_o bind_v as_o have_v equal_a authority_n with_o a_o act_n introductive_a of_o a_o new_a law_n but_o the_o recital_n in_o a_o preamble_n be_v no_o part_n of_o the_o act_n the_o royal_a assent_n be_v only_o to_o that_o which_o be_v express_o or_o tacit_o pray_v to_o be_v enact_v nor_o can_v it_o any_o way_n so_o much_o as_o imply_v our_o opinion_n for_o otherwise_o king_n must_v be_v enforce_v oftentimes_o to_o deny_v a_o good_a law_n for_o a_o ill_a preamble_n the_o consequence_n whereof_o be_v great_a in_o such_o a_o act_n as_o require_v expedition_n where_o a_o bill_n once_o deny_v be_v not_o regular_o to_o be_v offer_v again_o in_o that_o session_n of_o parliament_n and_o if_o it_o be_v needful_a divers_a mistake_n of_o the_o law_n in_o preamble_n may_v be_v produce_v
by_o which_o we_o will_v be_v loath_a to_o bind_v our_o subject_n nevertheless_o though_o preamble_n be_v not_o in_o themselves_o sufficient_a to_o declare_v law_n yet_o we_o deny_v not_o they_o be_v of_o good_a use_n though_o not_o convince_a argument_n to_o expound_v they_o and_o for_o our_o power_n in_o the_o matter_n of_o rebellion_n beside_o what_o have_v be_v say_v we_o may_v also_o add_v if_o it_o be_v material_a to_o this_o commission_n preamble_n recital_n and_o other_o necessary_a inference_n out_o of_o other_o statute_n make_v since_o those_o intend_a in_o this_o recital_n which_o will_v prove_v that_o in_o case_n of_o rebellion_n all_o our_o subject_n ought_v to_o assist_v we_o and_o to_o attend_v our_o person_n 3._o upon_o our_o command_n for_o the_o defence_n thereof_o whensoever_o we_o shall_v require_v it_o and_o the_o truth_n be_v the_o occasion_n of_o this_o act_n now_o urge_v against_o we_o appear_v to_o be_v for_o the_o service_n of_o ireland_n and_o the_o intention_n of_o it_o for_o so_o much_o as_o be_v the_o enact_a part_n be_v to_o take_v away_o all_o question_n concerning_o the_o press_n of_o the_o subject_n of_o england_n for_o the_o suppression_n of_o the_o rebellion_n in_o ireland_n and_o so_o concern_v foreign_a service_n and_o not_o home_n defence_n either_o against_o invasion_n of_o enemy_n or_o rebel_n and_o thus_o far_o the_o work_n of_o the_o declaration_n have_v be_v to_o overthrow_v our_o commission_n by_o statute_n allege_v to_o be_v direct_o against_o it_o there_o remain_v yet_o some_o other_o objection_n draw_v from_o the_o opinion_n of_o former_a parliament_n and_o the_o practice_n of_o ourselves_o and_o our_o predecessor_n and_o those_o not_o direct_o but_o by_o inference_n but_o these_o as_o we_o shall_v show_v be_v so_o far_o from_o conclude_v against_o our_o commission_n that_o they_o rather_o prove_v the_o contrary_a the_o first_o of_o these_o objection_n be_v upon_o the_o statute_n of_o 1._o jac._n c._n 25._o and_o 21._o iac._n c._n 28._o of_o repeal_v and_o be_v thus_o that_o the_o statute_n of_o 4_o and_o 5._o ph._n and_o m._n cap._n 2._o have_v repeal_v this_o commission_n for_o so_o the_o declaration_n suppose_v they_o have_v show_v little_a care_n of_o their_o own_o and_o the_o subject_n liberty_n in_o the_o parliament_n of_o â—_z iac._n to_o repeal_v that_o statute_n thereby_o to_o revive_v the_o power_n of_o this_o commission_n which_o will_v have_v subject_v the_o people_n to_o far_o great_a bondage_n and_o from_o thence_o infer_v that_o it_o be_v not_o probable_a that_o the_o parliament_n of_o 1._o jac._n will_v have_v repeal_v 4_o and_o 5_o ph._n and_o m._n as_o likâ—wise_o from_o the_o statute_n of_o 21._o iac._n which_o repeal_v the_o statute_n of_o 13._o e._n 1._o and_o 33._o h._n 8._o that_o it_o be_v not_o probable_a that_o the_o parliament_n of_o 21._o jac._n will_v have_v repeal_v those_o statute_n which_o in_o a_o moderate_a manner_n proportion_v the_o arm_n every_o man_n be_v to_o find_v in_o certainty_n and_o suffer_v a_o act_n mean_v this_o of_o 5._o h._n 4._o to_o continue_v which_o establish_v a_o power_n in_o the_o king_n without_o limitation_n not_o only_o to_o impose_v arm_n but_o to_o command_v the_o person_n of_o the_o subject_n at_o pleasure_n to_o this_o we_o say_v that_o both_o the_o ground_n of_o this_o objection_n be_v mistake_v for_o as_o we_o have_v already_o show_v neither_o be_v this_o commission_n repeal_v by_o the_o act_n of_o 4_o and_o 5_o p._n and_o m._n nor_o be_v there_o any_o such_o unlimited_a power_n give_v or_o bondage_n by_o it_o as_o be_v pretend_v and_o therefore_o our_o answer_n be_v that_o it_o be_v no_o wonder_n that_o those_o parliament_n may_v repeal_v 4_o and_o 5_o p._n and_o m._n as_o too_o hard_a and_o 13._o e._n 1._o and_o 33_o h._n 8._o as_o of_o no_o use_n and_o put_v the_o militia_n of_o this_o kingdom_n again_o whole_o under_o the_o power_n of_o this_o commission_n be_v so_o indifferent_a between_o both_o the_o other_o and_o indeed_o the_o militia_n do_v after_o continue_v under_o lieutenant_n who_o have_v in_o effect_n the_o power_n give_v by_o this_o commission_n and_o now_o we_o shall_v return_v this_o objection_n thus_o that_o those_o parliament_n of_o 1._o jac._n and_o 21._o iac._n will_v have_v show_v little_a care_n of_o the_o safety_n and_o defence_n of_o the_o kingdom_n to_o have_v repeal_v those_o statute_n which_o make_v provision_n for_o arm_n if_o they_o have_v think_v there_o be_v no_o law_n or_o power_n leave_v in_o the_o king_n to_o charge_v man_n with_o arm_n for_o defence_n of_o the_o kingdom_n as_o the_o declaration_n affirm_v the_o law_n now_o to_o be_v but_o whosoever_o consider_v that_o at_o that_o time_n and_o long_o before_o the_o power_n of_o impose_v arm_n be_v put_v in_o execution_n by_o lieutenant_n and_o deputy-lieutenant_n by_o authority_n of_o their_o commission_n which_o to_o this_o purpose_n be_v the_o same_o with_o our_o commission_n of_o array_n and_o that_o this_o power_n be_v not_o complain_v of_o in_o those_o parliament_n must_v conclude_v it_o more_o than_o probable_a that_o those_o parliament_n do_v then_o conceive_v there_o be_v a_o sufficient_a power_n remain_v in_o the_o king_n to_o impose_v arm_n the_o next_o objection_n be_v from_o the_o opinion_n of_o the_o parliament_n of_o 4._o and_o 5._o philip_n and_o mary_n c._n 3_o that_o if_o our_o commission_n have_v be_v authorize_v by_o act_n of_o parliament_n that_o statute_n of_o ph._n and_o mar._n have_v be_v to_o little_a purpose_n whereby_o the_o penalty_n of_o imprisonment_n for_o ten_o day_n or_o forty_o shilling_n be_v impose_v upon_o such_o as_o do_v not_o appear_v at_o muster_n be_v summon_v thereunto_o by_o the_o king_n commissioner_n authorize_v for_o that_o purpose_n intimate_v as_o that_o the_o act_n of_o phil_n and_o mar._n will_v never_o have_v be_v make_v if_o they_o have_v then_o conceive_v that_o we_o have_v power_n to_o grant_v such_o commission_n to_o this_o we_o answer_v that_o the_o particular_a arm_n and_o proportion_n of_o arm_n be_v then_o before_o appoint_v by_o the_o statute_n of_o 4._o and_o 5._o ph._n and_o mar._n cap._n 2._o under_o certain_a penalty_n upon_o those_o who_o shall_v be_v defective_a and_o so_o a_o great_a part_n of_o the_o care_n of_o the_o commissioner_n of_o array_n be_v supply_v by_o the_o provision_n of_o that_o statute_n and_o the_o commission_n of_o array_n be_v not_o so_o proper_a but_o in_o time_n of_o danger_n and_o of_o a_o large_a extent_n than_o the_o power_n of_o muster_v a_o commission_n of_o muster_n which_o be_v part_n of_o the_o power_n of_o a_o commission_n of_o array_n will_v then_o serve_v the_o ordinary_a turn_n and_o for_o every_o ordinary_a default_n but_o at_o a_o muster_n in_o a_o time_n of_o no_o danger_n the_o punishment_n by_o 4._o and_o 5._o ph._n and_o mar._n cap._n 3._o be_v great_a enough_o and_o for_o return_v of_o this_o objection_n we_o say_v as_o we_o observe_v before_o that_o this_o statute_n give_v no_o new_a power_n to_o grant_v commission_n for_o muster_n but_o admit_v the_o power_n to_o grant_v such_o commission_n to_o have_v be_v in_o the_o king_n before_o that_o time_n and_o whereas_o the_o statute_n of_o 13._o e._n 1._o appoint_v no_o other_o officer_n but_o the_o constable_n for_o view_n of_o arm_n it_o appear_v by_o these_o statute_n of_o phil._n and_o mar._n that_o the_o king_n may_v appoint_v his_o commissioner_n which_o he_o can_v not_o if_o this_o power_n of_o arm_n have_v be_v whole_o ground_v upon_o that_o statute_n the_o last_o objection_n of_o this_o nature_n be_v ground_v upon_o the_o common_a opinion_n or_o practice_n and_o be_v this_o that_o the_o commission_n of_o lieutenancy_n so_o grievous_a to_o the_o people_n and_o declare_v illegal_a in_o parliament_n have_v not_o be_v so_o often_o issue_v and_o so_o much_o press_v upon_o they_o if_o the_o commission_n of_o array_n not_o much_o differ_v from_o it_o in_o power_n and_o not_o at_o all_o less_o grievous_a to_o the_o subject_a might_n by_o the_o warrant_n and_o authority_n of_o the_o law_n of_o this_o realm_n have_v supply_v their_o room_n to_o this_o our_o answer_n be_v that_o it_o stand_v upon_o two_o ground_n first_o that_o the_o commission_n of_o lieutenancy_n be_v grievous_a second_o that_o they_o be_v illegal_a both_o which_o so_o far_o forth_o at_o least_o as_o to_o the_o power_n wherein_o they_o do_v not_o exceed_v the_o power_n of_o this_o commission_n for_o the_o other_o power_n be_v not_o now_o in_o question_n be_v clear_o mistake_v for_o as_o for_o the_o grievousness_n we_o say_v these_o commission_n be_v such_o as_o have_v be_v long_o use_v in_o the_o happy_a time_n of_o our_o predecessor_n and_o continue_v to_o our_o time_n and_o such_o grievance_n as_o do_v or_o may_v arise_v in_o the_o execution_n

other_o place_n where_o it_o shall_v be_v most_o necessary_a and_o although_o notwithstanding_o all_o these_o limitation_n and_o caution_n it_o be_v true_a that_o in_o this_o charge_n of_o arm_n as_o also_o for_o the_o time_n and_o place_n of_o call_v together_o our_o subject_n and_o of_o conduct_v or_o lead_v they_o and_o the_o danger_n upon_o which_o they_o be_v to_o be_v so_o conduct_v and_o lead_v much_o be_v leave_v to_o the_o discretion_n of_o the_o commissioner_n as_o it_o must_v of_o necessity_n in_o all_o commission_n where_o the_o place_n time_n and_o occasion_n of_o execution_n of_o they_o depend_v upon_o future_a accident_n and_o circumstance_n and_o can_v be_v certain_o know_v or_o describe_v at_o the_o time_n of_o the_o issue_n of_o the_o commission_n yet_o nevertheless_o it_o can_v be_v infer_v thereupon_o that_o therefore_o our_o commissioner_n have_v a_o mere_a absolute_a arbitrary_a liberty_n of_o will_n to_o do_v what_o they_o please_v but_o that_o if_o they_o shall_v wilful_o and_o unjust_o grieve_v any_o of_o our_o good_a subject_n in_o exceed_v or_o not_o observe_v our_o limitation_n or_o direction_n they_o be_v by_o law_n clear_o punishable_a by_o also_o in_o the_o concernment_n of_o their_o posterity_n kindred_n alliance_n friend_n and_o tenant_n and_o the_o good_a affection_n of_o their_o country_n which_o to_o person_n of_o such_o condition_n as_o they_o be_v be_v of_o a_o consideration_n beyond_o their_o fortune_n so_o that_o we_o hope_v their_o forwardness_n in_o undertake_v this_o trouble_n for_o the_o public_a defence_n will_v occasion_v in_o our_o good_a subject_n rather_o a_o willing_a obedience_n unto_o we_o than_o the_o least_o distrust_n or_o jealousy_n of_o any_o of_o they_o have_v thus_o state_v the_o and_o vindication_n of_o our_o own_o honour_n against_o those_o expression_n in_o that_o declaration_n which_o so_o near_o do_v concern_v we_o under_o the_o common_a name_n of_o evil_a councillor_n the_o occasion_n of_o the_o petition_n of_o the_o commons_o in_o that_o parliament_n in_o which_o petition_n they_o intend_v to_o show_v the_o illegality_n of_o those_o commission_n and_o to_o this_o first_o part_n of_o the_o statute_n of_o 1._o e._n 3._o concerning_o the_o arm_v whereas_o it_o be_v to_o be_v presume_v they_o will_v have_v also_o recite_v this_o statute_n of_o 13._o e._n 1._o if_o they_o have_v conceive_v the_o same_o to_o be_v as_o this_o declaration_n set_v it_o forth_o the_o certain_a assize_n for_o arm_n and_o such_o a_o statute_n whereto_o all_o the_o rest_n have_v reference_n or_o any_o way_n material_a against_o part_n of_o these_o commission_n but_o howsoever_o make_v use_n of_o the_o late_a part_n of_o the_o act_n of_o 1._o e._n 3._o against_o carry_v of_o the_o subject_a out_o of_o the_o county_n they_o will_v have_v make_v use_n also_o of_o this_o part_n of_o 1._o e._n 3._o concerning_o the_o arm_n and_o desire_v a_o confirmation_n thereof_o as_o well_o as_o of_o the_o residue_n and_o not_o thus_o purposely_o reject_v it_o if_o so_o be_v they_o have_v not_o upon_o consideration_n first_o resolve_v that_o that_o part_n of_o 1._o e._n 3._o be_v no_o way_n against_o the_o commission_n and_o now_o we_o come_v to_o the_o statute_n of_o 25._o e._n 3._o whereupon_o the_o objection_n stand_v thus_o by_o the_o statute_n of_o 25._o e._n 3._o the_o subject_n be_v not_o to_o be_v constrain_v to_o find_v man_n at_o arm_n etc._n etc._n if_o it_o be_v not_o by_o common_a consent_n and_o grant_v make_v in_o parliament_n but_o by_o this_o commission_n the_o commissioner_n have_v power_n without_o consent_n or_o grant_v in_o parliament_n to_o command_v those_o who_o be_v able_a of_o body_n and_o estate_n to_o arm_v themselves_o and_o those_o who_o be_v impotent_a but_o able_a in_o estate_n to_o find_v arm_n for_o other_o which_o the_o declaration_n in_o some_o place_n
levy_v upon_o the_o people_n by_o lord_n lieutenant_n deputy_n lieutenant_n commissioner_n for_o muster_n justice_n of_o peace_n and_o other_o by_o command_n or_o direction_n from_o we_o or_o our_o privy_a council_n against_o the_o law_n and_o free_a custom_n of_o the_o realm_n which_o the_o declaration_n allege_v to_o be_v the_o breach_n of_o those_o law_n then_o the_o word_n of_o the_o petition_n be_v thus_o apply_v that_o here_o be_v a_o tax_n or_o charge_v impose_v upon_o the_o people_n by_o compel_v they_o to_o find_v arm_n by_o command_n and_o direction_n from_o we_o under_o our_o great_a seal_n without_o consent_n in_o parliament_n and_o the_o meaning_n of_o the_o petition_n be_v thus_o enforce_v that_o it_o be_v very_o well_o know_v and_o do_v sufficient_o appear_v that_o the_o charge_n there_o mention_v to_o be_v lay_v by_o lord_n lieutenant_n and_o deputy_n lieutenant_n be_v the_o charge_n of_o the_o subject_n with_o arm_n against_o law_n by_o colour_n of_o their_o commission_n from_o we_o and_o consequent_o this_o commission_n be_v against_o the_o petition_n of_o right_n for_o our_o clear_a answer_n we_o shall_v set_v down_o the_o sum_n of_o the_o petition_n for_o so_o much_o as_o concern_v the_o unlawful_a charge_n of_o the_o subject_a and_o it_o be_v this_o first_o the_o petition_n recite_v several_a statute_n as_o make_v against_o the_o compel_v the_o subject_a to_o the_o make_n or_o yield_v any_o gift_n loan_n benevolence_n tax_n aid_n or_o such_o like_a charge_n without_o common_a consent_n in_o parliament_n and_o next_o set_v forth_o a_o violation_n of_o those_o statute_n by_o the_o commission_n of_o loan_n and_o execution_n of_o they_o and_o that_o divers_a other_o charge_n have_v be_v lay_v and_o levy_v by_o lord_n lieutenant_n and_o other_o as_o be_v aforesaid_a and_o last_o the_o prayer_n be_v substantive_o of_o itself_o without_o any_o relative_a word_n yet_o extend_v to_o all_o that_o be_v before_o do_v as_o it_o desire_v and_o our_o answer_n to_o the_o objection_n stand_v thus_o first_o that_o whatsoever_o sense_n any_o word_n of_o the_o preamble_n may_v seem_v to_o import_v yet_o without_o question_n there_o be_v no_o more_o in_o this_o preamble_n than_o be_v after_o contain_v in_o the_o prayer_n so_o if_o our_o commission_n be_v not_o against_o the_o prayer_n there_o can_v be_v no_o argument_n against_o it_o draw_v out_o of_o the_o preamble_n or_o if_o in_o truth_n there_o be_v more_o in_o the_o preamble_n then_o in_o the_o prayer_n whereunto_o only_o the_o royal_a assent_n extend_v yet_o nothing_o can_v bind_o be_v conclude_v thereupon_o as_o we_o shall_v further_o show_v upon_o occasion_n this_o then_o only_o rest_v to_o be_v consider_v upon_o this_o objection_n whether_o the_o power_n in_o our_o commission_n to_o compel_v the_o subject_n able_a of_o body_n and_o estate_n to_o arm_n themselves_o and_o in_o case_n of_o impotency_n to_o find_v arm_n for_o other_o for_o the_o necessary_a defence_n of_o the_o kingdom_n can_v be_v say_v to_o be_v a_o compel_n of_o the_o subject_a to_o make_v or_o yield_v any_o gift_n loan_n benevolence_n tax_n or_o other_o like_a charge_n contrary_a to_o the_o prayer_n of_o the_o petition_n upon_o the_o case_n thus_o true_o state_v it_o be_v clear_a that_o here_o be_v no_o yield_a or_o make_v of_o gift_n benevolence_n or_o loan_n and_o as_o for_o make_v or_o yield_v any_o tax_n or_o other_o like_a charge_n though_o it_o be_v true_a that_o this_o arm_v a_o man_n self_n or_o find_v arm_n for_o another_o can_v be_v do_v without_o charge_n yet_o we_o appeal_v to_o every_o man_n understanding_n whether_o our_o subject_n can_v upon_o this_o commission_n be_v say_v to_o make_v or_o yield_v for_o so_o be_v the_o word_n any_o tax_n or_o other_o charge_n against_o the_o petition_n any_o more_o then_o if_o we_o command_v a_o city_n to_o repair_v their_o wall_n or_o a_o level_n put_v the_o case_n before_o their_o advantage_n be_v void_a in_o law_n notwithstanding_o it_o do_v not_o follow_v that_o they_o be_v void_a as_o against_o this_o petition_n for_o the_o petition_n of_o right_n as_o against_o the_o charge_n therein_o mention_v be_v only_o to_o be_v intend_v of_o money_n or_o other_o thing_n valuable_a and_o to_o be_v part_v with_o to_o or_o for_o we_o or_o our_o advantage_n such_o as_o be_v all_o the_o charge_n more_o special_o mention_v in_o the_o preamble_n and_o prayer_n as_o that_o of_o gift_n loan_n and_o benevolence_n and_o such_o as_o be_v those_o charge_n intend_v in_o the_o preamble_n under_o the_o general_a expression_n of_o divers_a other_o charge_n impose_v by_o lord_n lieutenant_n etc._n etc._n which_o we_o think_v be_v very_o well_o know_v to_o most_o county_n to_o have_v be_v mere_a pecuniary_a payment_n and_o which_o we_o ought_v to_o have_v bear_v and_o for_o the_o other_o charge_n that_o be_v of_o tax_n tallage_n aid_n likewise_o mention_v which_o as_o to_o statute_n and_o have_v be_v in_o former_a time_n impose_v upon_o the_o people_n without_o act_n of_o parliament_n and_o according_o all_o of_o they_o be_v so_o to_o be_v expound_v in_o the_o preamble_n and_o the_o prayer_n of_o the_o petition_n say_v nothing_o express_o against_o the_o command_v the_o subject_a to_o do_v a_o thing_n which_o may_v be_v necessary_o of_o expense_n or_o charge_n wherein_o the_o act_n be_v only_o intend_v and_o the_o charge_n but_o a_o necessary_a incident_a but_o the_o prayer_n be_v only_o against_o the_o compel_n of_o the_o subject_a to_o yield_v or_o make_v those_o kind_n of_o charge_n so_o as_o the_o clear_a sense_n of_o the_o petition_n both_o according_a to_o the_o occasion_n of_o complaint_n therein_o mention_v and_o the_o law_n whereupon_o it_o be_v frame_v as_o well_o as_o the_o propriety_n of_o the_o word_n be_v only_o against_o draw_v from_o the_o subject_a either_o money_n or_o money-worth_n by_o any_o of_o those_o particular_a charge_n therein_o mention_v or_o any_o other_o charge_n of_o like_a nature_n under_o what_o specious_a title_n soever_o for_o the_o king_n advantage_n which_o the_o more_o plain_o appear_v for_o that_o the_o charge_n must_v be_v yield_v or_o make_v as_o upon_o gift_n loan_n etc._n etc._n which_o must_v necessary_o be_v intend_v unto_o some_o person_n and_o no_o other_o person_n can_v be_v here_o colourable_o intend_v but_o the_o king_n and_o if_o the_o petition_n by_o any_o construction_n may_v extend_v against_o the_o command_n of_o any_o act_n which_o in_o the_o
