A19394 An apologie for sundrie proceedings by iurisdiction ecclesiasticall, of late times by some chalenged, and also diuersly by them impugned By which apologie (in their seuerall due places) all the reasons and allegations set downe as well in a treatise, as in certaine notes (that goe from hand to hand) both against proceeding ex officio, and against oaths ministred to parties in causes criminall; are also examined and answered: vpon that occasion lately reuiewed, and much enlarged aboue the first priuate proiect, and now published, being diuided into three partes: the first part whereof chieflie sheweth what matters be incident to ecclesiasticall conisance; and so allowed by statutes and common law: the second treateth (for the most part) of the two wayes of proceeding in causes criminal ... the third concerneth oaths in generall ... Whereunto ... I haue presumed to adioine that right excellent and sound determination (concerning oaths) which was made by M. Lancelot Androvves ....; Apologie: of, and for sundrie proceedings by jurisdiction ecclesiasticall Cosin, Richard, 1549?-1597.; Andrewes, Lancelot, 1555-1626. confessis_fw-la if_o then_o that_o law_n do_v so_o deep_o punish_v the_o contemptuous_a in_o that_o behalf_n as_o to_o convict_v they_o therefore_o of_o the_o very_a crime_n impute_v may_v we_o not_o gather_v that_o the_o law_n civil_a and_o canon_n require_v man_n to_o answer_v even_o matter_n criminal_a upon_o their_o oath_n but_o if_o the_o canon_n lawe-shall_a be_v by_o other_o allege_v to_o avouch_v such_o oath_n as_o we_o here_o treat_v of_o to_o this_o allegation_n in_o several_a place_n the_o treatisour_n make_v these_o several_a answer_n follow_v first_o he_o say_v that_o such_o oath_n be_v against_o god_n word_n and_o therefore_o no_o bind_a law_n for_o which_o consequence_n he_o allege_v saint_n german_n in_o his_o book_n of_o doctor_n and_o student_n second_o that_o the_o two_o statute_n of_o submission_n of_o the_o clergy_n make_v in_o king_n henry_n the_o eight_o his_o time_n still_o 8._o still_o 25._o h._n 8._o 27._o h._n 8._o continue_v in_o force_n do_v take_v away_o the_o canon_n law_n three_o that_o this_o kind_n of_o oath_n be_v contrary_a to_o the_o law_n of_o the_o realm_n all_o which_o asseveration_n be_v nothing_o else_o but_o beg_v of_o that_o which_o be_v the_o principal_a controversy_n touch_v the_o first_o of_o these_o it_o come_v in_o the_o next_o chapter_n to_o be_v disouss_v whether_o minister_a of_o such_o oath_n be_v against_o god_n word_n or_o no._n for_o the_o second_o those_o two_o statute_n be_v so_o far_o from_o take_v the_o canon_n law_n away_o that_o both_o of_o they_o do_v in_o truth_n establish_v all_o canon_n be_v of_o that_o quality_n as_o be_v there_o express_v unto_o all_o which_o we_o aver_v this_o oath_n to_o be_v consonant_a the_o clergy_n in_o deed_n do_v there_o promise_v not_o to_o enact_v or_o put_v in_o ure_n any_o new_a canon_n etc._n etc._n without_o the_o king_n express_v assent_v of_o which_o sort_n this_o oath_n be_v none_o for_o it_o have_v be_v prove_v by_o far_o elder_a canon_n than_o that_o time_n concern_v the_o three_o we_o have_v show_v that_o there_o be_v not_o any_o great_a diversity_n betwixt_o those_o two_o law_n in_o this_o point_n &_o therefore_o much_o less_o can_v there_o be_v any_o contrariety_n or_o repugnancy_n last_o hereto_o he_o answer_v that_o if_o any_o man_n shall_v seek_v by_o long_a practice_n and_o continuance_n to_o give_v a_o new_a probate_n unto_o the_o pontifical_a law_n after_o so_o public_a a_o condemnation_n and_o fire_v thereof_o by_o doctor_n luther_n such_o must_v understand_v from_o he_o that_o this_o kingdom_n be_v not_o subject_a to_o any_o part_n of_o canon_n law_n shall_v swerve_v from_o those_o condition_n require_v to_o make_v they_o english_a law_n that_o dispensation_n which_o of_o all_o other_o be_v most_o strict_a and_o never_o afore_o that_o time_n speed_v in_o this_o realm_n shall_v be_v hold_v for_o foreign_a law_n rather_o than_o this_o kind_n of_o oath_n so_o usual_a afore_o and_o since_o in_o most_o court_n yet_o these_o dispensation_n be_v also_o there_o approve_v for_o english_a law_n let_v he_o therefore_o understand_v that_o all_o those_o thing_n there_o require_v viz._n sufferance_n consent_n and_o custom_n to_o make_v the_o canon_n establish_v such_o oath_n to_o be_v account_v the_o custom_a and_o ancient_a law_n of_o this_o realm_n original_o establish_v as_o law_n of_o the_o same_o do_v in_o these_o oath_n so_o apt_o concur_v as_o have_v be_v prove_v that_o none_o of_o his_o confident_a denial_n thereof_o can_v or_o shall_v be_v able_a any_o more_o to_o impeach_v they_o from_o so_o be_v then_o the_o burn_a of_o the_o canon_n law_n at_o wittenberg_n by_o luther_n when_o the_o pope_n have_v burn_v his_o book_n at_o rome_n either_o do_v be_v mean_v or_o yet_o can_v abrogate_v the_o continual_a use_n of_o a_o great_a part_n thereof_o in_o germany_n even_o until_o this_o day_n or_o than_o it_o can_v or_o aught_o to_o have_v any_o force_n to_o disannul_v it_o here_o in_o england_n for_o the_o statute_n establish_v such_o canon_n as_o there_o be_v mention_v be_v make_v in_o the_o self_n same_o parliament_n and_o session_n thereof_o that_o this_o preamble_n be_v before_o the_o statute_n of_o dispensation_n whereby_o he_o will_v now_o overthrow_v the_o canon_n law_n whole_o and_o both_o of_o those_o statute_n at_o the_o begin_n of_o her_o majesty_n reign_n be_v reviue_v again_o in_o one_o act._n how_o can_v there_o then_o be_v any_o such_o contrariety_n or_o abrogation_n general_a of_o the_o canon_n law_n as_o this_o man_n dream_v of_o except_o all_o that_o be_v present_a in_o those_o two_o parliament_n have_v be_v fast_o on_o sleep_n when_o they_o twice_o pass_v they_o both_o together_o for_o statute_n other_o perhaps_o to_o as_o good_a purpose_n will_v of_o torture_n to_o a_o free_a man_n second_o for_o that_o it_o be_v absurd_a in_o small_a cause_n not_o to_o credit_n their_o word_n who_o for_o the_o high_a matter_n touch_v god_n be_v credit_v omination_n towards_o the_o priest_n of_o god_n first_o than_o we_o see_v hereby_o in_o so_o much_o as_o this_o be_v a_o peculiar_a privilege_n grant_v to_o these_o that_o therefore_o all_o other_o might_n by_o magistrate_n be_v put_v to_o their_o oath_n and_o second_o that_o it_o be_v from_o all_o swear_v absolute_o and_o not_o in_o matter_n criminal_a only_o which_o be_v our_o present_a controversy_n for_o so_o livy_n also_o 32._o also_o livius_fw-la lib._n 32._o testify_v hereof_o where_o he_o say_v that_o flamen_n dialis_n amongst_o the_o roman_n may_v in_o no_o case_n at_o all_o make_v out_o of_o those_o two_o law_n chap._n xi_o that_o not_o only_o such_o a_o oath_n may_v be_v take_v but_o also_o be_v by_o magistrate_n due_o command_v ought_v not_o to_o be_v refuse_v be_v approve_v by_o scripture_n by_o practice_n of_o the_o primitive_a church_n and_o of_o late_a time_n together_o with_o a_o reply_n unto_o certain_a answer_n make_v unto_o some_o proof_n here_o use_v the_o innovator_n find_v but_o small_a relief_n in_o the_o law_n be_v right_o understand_v do_v flee_v as_o it_o be_v meet_v unto_o the_o word_n of_o god_n yet_o as_o
