it_o shall_v neither_o be_v interfere_v with_o in_o the_o least_o nor_o the_o jurisdiction_n of_o the_o lord_n nor_o their_o proceed_n meddle_v with_o in_o any_o kind_n by_o his_o be_v bail_v but_o parliament_n now_o upon_o this_o order_n he_o observe_v that_o it_o relate_v as_o well_o to_o appeal_n and_o writ_n of_o error_n as_o to_o impeachment_n and_o seem_v to_o be_v more_o full_o word_v to_o they_o than_o to_o impeachment_n the_o word_n statu_fw-la quo_fw-la and_o without_o beginning_n de_fw-fr novo_fw-la being_n annex_v in_o the_o order_n more_o particular_o to_o the_o appeal_v and_o writ_n of_o error_n whereas_o all_o that_o be_v say_v as_o to_o the_o impeachment_n he_o observe_v to_o be_v that_o the_o dissolution_n of_o that_o last_o parliament_n do_v not_o alter_v the_o state_n of_o impeachment_n bring_v up_o by_o the_o commons_o in_o that_o parliament_n and_o be_v not_o word_n which_o strict_o take_v can_v bind_v after_o the_o dissolution_n of_o any_o other_o than_o in_o one_o session_n and_o have_v take_v out_o a_o pardon_n during_o the_o prorogation_n be_v never_o more_o call_v upon_o nor_o never_o question_v upon_o the_o former_a impeachment_n although_o the_o parliament_n shall_v meet_v again_o which_o will_v consist_v of_o new_a men._n he_o say_v it_o be_v likewise_o to_o be_v observe_v that_o although_o the_o transcript_n of_o the_o record_n in_o a_o writ_n of_o error_n may_v have_v day_n of_o continuance_n yet_o no_o supersedeas_fw-la be_v grantable_a and_o he_o say_v that_o if_o the_o lord_n order_v be_v no_o ground_n for_o a_o supersedeas_fw-la observe_v that_o if_o the_o order_n shall_v be_v continue_v literal_o to_o mean_v that_o the_o impeachment_n as_o well_o as_o the_o appeal_v and_o writ_n of_o error_n and_o the_o incident_n relate_v to_o all_o of_o they_o shall_v remain_v in_o the_o same_o state_n they_o be_v at_o the_o dissolution_n of_o that_o parliament_n mention_v in_o the_o say_a order_n his_o case_n thereupon_o he_o say_v will_v be_v quite_o different_a from_o any_o other_o for_o that_o he_o be_v not_o under_o any_o commitment_n at_o the_o dissolution_n of_o that_o parliament_n nor_o at_o the_o time_n when_o that_o that_o on_o the_o contrary_a the_o reason_n be_v much_o strong_a for_o the_o do_v of_o that_o as_o it_o relate_v not_o only_o to_o he_o but_o to_o the_o liberty_n of_o the_o subject_a in_o general_n then_o for_o the_o proceed_n which_o the_o inferior_a court_n do_v daily_a practice_n upon_o appeal_n and_o writ_n of_o error_n which_o be_v but_o for_o property_n and_o be_v comprise_v in_o the_o same_o order_n and_o therefore_o he_o say_v that_o he_o hope_v he_o shall_v at_o least_o find_v the_o same_o favour_n in_o a_o case_n of_o liberty_n which_o be_v allow_v every_o day_n in_o case_n of_o lesser_a moment_n he_o then_o say_v that_o although_o it_o do_v not_o concern_v his_o particular_a case_n yet_o for_o the_o sake_n of_o english_a liberty_n itself_o he_o can_v not_o but_o say_v something_o further_o upon_o this_o point_n for_o he_o can_v not_o but_o be_v of_o opinion_n that_o if_o the_o order_n have_v direct_o forbid_v bail_n which_o it_o be_v far_o from_o do_v and_o beside_o the_o lord_n own_o practice_n have_v show_v their_o meaning_n to_o the_o contrary_a by_o the_o bail_n of_o a_o commonnor_n who_o crime_n be_v declare_v to_o be_v great_a than_o he_o and_o in_o which_o case_n they_o make_v not_o non_fw-la obstante_fw-la to_o their_o order_n but_o take_v that_o to_o be_v still_o in_o the_o same_o force_n towards_o he_o as_o towards_o any_o other_o who_o be_v in_o custody_n yet_o he_o say_v in_o that_o case_n if_o such_o a_o order_n shall_v be_v find_v to_o be_v against_o magna_fw-la charta_fw-la and_o the_o fundamental_a right_n of_o the_o liberty_n of_o the_o subject_a as_o any_o thing_n must_v be_v which_o do_v subject_a any_o man_n to_o a_o indefinite_a imprisonment_n he_o conceive_v that_o of_o right_o that_o court_n ought_v to_o free_v any_o man_n from_o such_o a_o slavery_n for_o he_o say_v he_o can_v give_v it_o no_o better_o a_o name_n and_o he_o then_o cite_v a_o argument_n of_o the_o earl_n of_o shaftsburye_n upon_o that_o point_n which_o that_o lord_n argue_v in_o that_o court_n upon_o a_o habeas_fw-la corpus_fw-la when_o the_o court_n agree_v they_o will_v have_v bail_v he_o have_v it_o not_o be_v in_o a_o time_n of_o a_o will_v make_v their_o liberty_n to_o be_v very_o precarious_a he_o proceed_v to_o say_v that_o the_o earl_n of_o shaftsbury_n be_v allow_v to_o be_v a_o know_a man_n both_o in_o the_o law_n order_n and_o constitution_n of_o parliament_n he_o will_v beg_v leave_n to_o quote_v another_o part_n of_o the_o same_o speech_n viz._n that_o mr._n attorney_n which_o be_v then_o sir_n william_n jones_n take_v these_o man_n who_o he_o have_v name_v for_o no_o small_a authority_n in_o this_o age_n and_o the_o earl_n of_o shaftsbury_n he_o say_v be_v a_o man_n still_o as_o much_o for_o the_o maintain_n of_o this_o order_n as_o ever_o but_o that_o his_o lordship_n do_v show_v himself_o at_o the_o same_o time_n to_o be_v for_o english_a liberty_n and_o he_o plain_o show_v his_o own_o sense_n both_o of_o this_o and_o of_o all_o order_n whatever_o which_o concern_v the_o liberty_n of_o the_o subject_a and_o declare_v that_o he_o take_v that_o court_n to_o be_v the_o proper_a judge_n of_o all_o such_o order_n he_o say_v it_o thereby_o appear_v how_o sensible_a that_o lord_n be_v that_o such_o case_n may_v concern_v forty_o as_o well_o as_o one_o and_o member_n of_o either_o house_n as_o well_o as_o other_o man_n and_o without_o relief_n if_o it_o shall_v be_v admit_v that_o ordinart_n court_n can_v not_o relieve_v and_o the_o earl_n of_o danby_n say_v that_o there_o be_v no_o answer_v of_o these_o argument_n of_o the_o earl_n of_o shaftsbury_n unless_o it_o can_v be_v deny_v that_o the_o king_n can_v impeach_v as_o well_o as_o the_o commons_o or_o that_o the_o king_n can_v call_v and_o dissolve_v parliament_n at_o his_o own_o will_n and_o pleasure_n for_o if_o he_o may_v as_o be_v not_o to_o be_v doubt_v he_o say_v he_o be_v sure_o every_o man_n in_o england_n be_v in_o the_o same_o danger_n when_o the_o king_n please_v and_o then_o he_o see_v nothing_o whereby_o we_o have_v any_o security_n but_o that_o we_o live_v under_o a_o king_n who_o will_v not_o exercise_v construe_v to_o extend_v to_o indefinite_a imprisonment_n he_o then_o repeat_v sir_n william_n jones_n his_o declaration_n in_o that_o court_n that_o either_o a_o pardon_n a_o prorogation_n or_o a_o dissolution_n be_v a_o cure_n against_o such_o imprisonment_n and_o he_o observe_v thereupon_o that_o if_o that_o doctrine_n be_v true_a that_o any_o one_o of_o those_o be_v a_o cure_n against_o such_o imprisonment_n and_o he_o can_v not_o doubt_v of_o its_o be_v good_a law_n then_o certain_o he_o ought_v to_o find_v relief_n from_o his_o imprisonment_n who_o have_v every_o one_o of_o those_o cure_n on_o his_o side_n he_o then_o desire_v to_o put_v the_o court_n in_o mind_n how_o in_o the_o worst_a of_o time_n justice_n have_v take_v place_n so_o far_o as_o to_o lay_v aside_o the_o force_n of_o order_n make_v in_o parliament_n after_o the_o dissolution_n of_o those_o parliament_n which_o make_v they_o although_o it_o be_v to_o the_o prejudice_n of_o the_o interest_n of_o those_o usurper_n themselves_o he_o cite_v a_o instance_n of_o one_o sir_n john_n stowel_n who_o by_o the_o article_n of_o exciter_n be_v to_o have_v be_v admit_v to_o composition_n for_o his_o estate_n but_o yet_o contrary_a to_o those_o article_n the_o parliament_n do_v afterward_o order_v his_o estate_n to_o be_v sell_v after_o the_o dissolution_n of_o which_o parliament_n sir_n john_n stowel_n plead_v
