any_o such_o case_n the_o say_v good_n or_o money_n so_o give_v or_o the_o value_n thereof_o as_o also_o the_o master_n part_n of_o such_o ship_n her_o tackle_n apparel_n and_o furniture_n so_o release_v give_v back_o or_o let_v pass_v out_o of_o which_o the_o say_v good_n be_v take_v shall_v be_v liable_a to_o repair_v the_o person_n who_o good_n be_v so_o deliver_v or_o take_v by_o action_n in_o the_o high_a court_n of_o admiralty_n and_o in_o case_n the_o commander_n or_o master_n part_n of_o the_o ship_n tackle_n apparel_n and_o furniture_n together_o with_o such_o money_n and_o good_n give_v as_o aforesaid_a shall_v not_o be_v sufficient_a to_o repair_v all_o the_o damage_n sustain_v than_o the_o reparation_n to_o be_v recover_v on_o the_o master_n or_o commander_n part_v of_o the_o ship_n to_o be_v divide_v pro_fw-la rata_fw-la among_o the_o person_n prosecute_n and_o prove_v their_o damage_n and_o the_o person_n damage_v to_o have_v their_o action_n against_o the_o master_n for_o the_o remainder_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a ship_n master_n of_o ship_n that_o no_o master_n of_o any_o such_o english_a ship_n as_o aforesaid_a be_v at_o sea_n and_o have_v discover_v any_o ship_n to_o be_v a_o turkish_a ship_n pirate_n or_o sea-rover_n shall_v depart_v out_o of_o his_o ship_n upon_o any_o pretence_n whatsoever_o lest_o by_o his_o detention_n on_o board_n any_o such_o ship_n the_o safety_n of_o his_o own_o ship_n be_v hazard_v and_o be_v it_o further_o enact_v that_o if_o the_o master_n of_o any_o english_a ship_n or_o vessel_n though_o not_o of_o the_o burden_n of_o two_o hundred_o tun_n or_o mount_v with_o sixtéen_a gun_n as_o aforesaid_a shall_v yield_v his_o say_a ship_n unto_o any_o turkish_a ship_n pirate_n or_o sea-rover_n not_o have_v at_o the_o least_o double_a his_o number_n of_o gun_n without_o fight_v every_o such_o master_n shall_v be_v liable_a to_o all_o and_o every_o the_o penalty_n in_o this_o act_n contain_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a admiralty_n process_n out_o of_o the_o court_n of_o admiralty_n that_o upon_o process_n make_v out_o of_o the_o high_a court_n of_o admiralty_n it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o all_o commander_n of_o his_o majesty_n ship_n of_o war_n or_o the_o commander_n of_o any_o other_o english_a ship_n to_o seize_v such_o ship_n or_o master_n so_o offend_v according_a to_o the_o say_a process_n in_o such_o case_n to_o be_v issue_v and_o the_o same_o to_o bring_v or_o send_v in_o custody_n into_o any_o port_n of_o his_o majesty_n dominion_n there_o to_o be_v proceed_v against_o according_a to_o the_o intent_n and_o meaning_n of_o this_o act._n provide_v that_o none_o be_v hereby_o encourage_v to_o violate_v the_o right_n o●_n the_o port_n of_o any_o foreign_a prince_n or_o state_n in_o amity_n with_o the_o king_n majesty_n fight_v mariner_n or_o inferior_a officer_n decline_v to_o fight_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o mariner_n or_o inferior_a officer_n of_o any_o english_a ship_n lade_v with_o good_n and_o merchandize_n as_o aforesaid_a shall_v decline_v or_o refuse_v to_o fight_v and_o defend_v the_o ship_n when_o they_o shall_v be_v thereunto_o command_v by_o the_o master_n or_o commander_n thereof_o or_o shall_v utter_v any_o word_n to_o discourage_v the_o other_o mariner_n from_o defend_v the_o ship_n penalty_n the_o penalty_n that_o every_o mariner_n who_o shall_v be_v find_v guilty_a of_o decline_v or_o refuse_v as_o aforesaid_a shall_v lose_v all_o his_o wage_n due_a to_o he_o together_o with_o such_o good_n as_o he_o have_v in_o the_o ship_n and_o suffer_v imprisonment_n not_o exceed_a the_o space_n of_o six_o month_n and_o shall_v during_o such_o time_n be_v keep_v to_o hard_a labour_n for_o he_o or_o their_o maintenance_n provide_v always_o that_o if_o any_o ship_n shall_v have_v be_v yield_v as_o aforesaid_a contrary_a to_o the_o will_n and_o endeavour_v of_o the_o master_n or_o commander_n by_o the_o disobedience_n of_o his_o mariner_n testify_v by_o their_o have_v lay_v violent_a hand_n on_o he_o that_o in_o such_o case_n the_o master_n or_o commander_n shall_v not_o be_v liable_a to_o the_o sentence_n of_o incapacity_n as_o aforesaid_a nor_o to_o any_o action_n for_o the_o loss_n sustain_v by_o the_o merchant_n unless_o he_o shall_v have_v receive_v back_o from_o the_o taker_n thereof_o his_o ship_n or_o some_o recompense_n gift_n or_o reward_n as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o mariner_n who_o shall_v have_v lay_v violent_a hand_n on_o his_o commander_n whereby_o to_o hinder_v he_o from_o fight_v in_o defence_n of_o his_o ship_n and_o good_n commit_v to_o his_o trust_n shall_v suffer_v death_n as_o a_o felon_n and_o for_o the_o better_a encouragement_n to_o captain_n master_n officer_n and_o sea_n man_n to_o defend_v their_o ship_n ship_n encouragement_n to_o captain_n and_o s●amen_n to_o defend_v their_o ship_n be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o when_o any_o english_a ship_n shall_v have_v be_v defend_v by_o fight_n and_o bring_v to_o her_o design_a port_n in_o which_o fight_n any_o of_o the_o officer_n or_o sea_n man_n shall_v have_v be_v wound_v it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o the_o judge_n of_o his_o majesty_n high_a court_n of_o admiralty_n or_o his_o surrogate_v or_o the_o judge_n of_o the_o vice-admiralty_a within_o which_o the_o ship_n shall_v arrive_v at_o her_o return_n upon_o petition_n of_o the_o master_n or_o seaman_n of_o such_o ship_n so_o defend_v as_o aforesaid_a to_o call_v unto_o he_o such_o and_o so_o many_o as_o he_o shall_v be_v inform_v to_o be_v adventurer_n or_o owner_n of_o the_o ship_n and_o good_n so_o defend_v and_o by_o advice_n with_o they_o to_o raise_v and_o levy_v upon_o the_o respective_a owner_n and_o adventurer_n by_o process_n out_o of_o the_o say_a court_n such_o sum_n or_o sum_n of_o money_n as_o himself_o with_o the_o
major_a part_n of_o the_o adventurer_n or_o owner_n then_o present_a shall_v judge_v reasonable_a not_o exceed_a the_o value_n of_o two_o per_fw-la cent_n of_o the_o ship_n and_o good_n so_o defend_v according_a to_o the_o first_o cost_n of_o the_o good_n to_o be_v make_v appear_v by_o the_o envoyce_n which_o the_o owner_n or_o his_o factor_n or_o correspondent_n be_v hereby_o require_v to_o produce_v or_o by_o the_o oath_n of_o the_o say_a owner_n factor_n or_o correspondent_n if_o thereunto_o require_v which_o money_n so_o raise_v shall_v be_v pay_v unto_o the_o register_n of_o the_o say_a court_n who_o shall_v receive_v for_o the_o same_o three_o penny_n in_o each_o pound_n and_o no_o more_o thence_o to_o be_v distribute_v among_o the_o captain_n master_n officer_n and_o seaman_n of_o the_o say_a ship_n or_o widow_n and_o child_n of_o the_o slay_v according_a to_o the_o direction_n of_o the_o judge_n of_o the_o say_a court_n with_o the_o approbation_n of_o three_o or_o more_o of_o the_o owner_n or_o adventurer_n aforesaid_a who_o shall_v proportion_v the_o same_o according_a to_o their_o best_a judgement_n unto_o the_o ship_n company_n as_o aforesaid_a have_v especial_a regard_n unto_o the_o widow_n and_o child_n of_o such_o as_o shall_v have_v be_v slay_v in_o that_o service_n and_o to_o such_o as_o shall_v have_v be_v wound_v or_o maim_v and_o in_o case_n the_o company_n belong_v to_o any_o english_a merchant-ship_n shall_v happen_v to_o take_v any_o ship_n english_a ship_n which_o 〈◊〉_d o●_n take_v 〈◊〉_d english_a which_o ship_n shall_v first_o have_v assault_v they_o the_o respective_a officer_n and_o mariner_n belong_v to_o the_o same_o shall_v after_o condemnation_n of_o such_o ship_n and_o good_n have_v and_o receive_v to_o their_o own_o proper_a use_n and_o benefit_n such_o part_n and_o share_v thereof_o as_o be_v usual_o practise_v in_o private_a man_n of_o war._n omary_n omary_n and_o whereas_o it_o often_o happen_v that_o master_n and_o mariner_n of_o ship_n have_v insure_v or_o take_v upon_o botomary_a great_a sum_n of_o money_n then_o the_o value_n of_o their_o adventure_n do_v wilful_o cast_v away_o burn_v or_o otherwise_o destroy_v the_o ship_n under_o their_o charge_n to_o merchant_n and_o owner_n great_a loss_n for_o the_o prevention_n thereof_o for_o the_o future_a be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o captain_n master_n mariner_z or_o other_o officer_n belong_v to_o any_o ship_n shall_v wilful_o cast_v away_o burn_v or_o otherwise_o destroy_v the_o ship_n unto_o which_o he_o belong_v or_o procure_v the_o same_o to_o be_v do_v he_o shall_v suffer_v death_n as_o a_o felon_n act._n the_o continuance_n of_o this_o act._n provide_v that_o this_o act_n shall_v continue_v for_o three_o year_n and_o from_o thence_o to_o the_o end_n of_o the_o next_o session_n of_o parliament_n and_o no_o long_o cap._n vii_o deceitful_a disorderly_a and_o excessive_a game_n prevent_v game_n the_o inconvenience_n of_o immoderate_a and_o unlawful_a use_n of_o game_n whereas_o all_o lawful_a game_n and_o exercise_n shall_v not_o be_v otherwise_o use_v then_o as_o innocent_a and_o moderate_a recreation_n and_o not_o as_o constant_a trade_n or_o calling_n to_o gain_v a_o live_n or_o make_v unlawful_a advantage_n thereby_o and_o whereas_o by_o the_o immoderate_a use_n of_o they_o many_o mischief_n and_o inconvenience_n do_v arise_v and_o be_v daily_o find_v to_o the_o maintain_n and_o encourage_v of_o sundry_a idle_a loose_a and_o disorderly_a person_n in_o their_o dishonest_a lewd_a and_o dissolute_a course_n of_o life_n and_o to_o the_o circumvent_a deceive_a cozen_a and_o debauch_v of_o many_o of_o the_o young_a sort_n both_o of_o the_o nobility_n and_o gentry_n and_o other_o to_o the_o loss_n of_o their_o precious_a time_n and_o the_o utter_a ruin_n of_o their_o estate_n and_o fortune_n and_o withdraw_v they_o from_o noble_a and_o laudable_a employment_n and_o exercise_n be_v it_o therefore_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o advice_n and_o consent_n of_o the_o lord_n spiritual_a and_o temporal_a and_o the_o commons_o in_o this_o present_a parliament_n assemble_v and_o by_o the_o authority_n of_o the_o same_o that_o if_o any_o person_n or_o person_n of_o any_o degree_n or_o
