that_o shall_v and_o will_v upon_o that_o security_n advance_v any_o present_a sum_n or_o sum_n of_o money_n towards_o the_o present_a â—â—paration_n of_o the_o say_a highway_n for_o the_o repay_v the_o same_o with_o interest_n ibid._n when_o and_o how_o the_o justice_n may_v make_v a_o rate_n keb._n ibid._n and_o in_o case_n money_n can_v be_v borrow_v on_o that_o security_n than_o the_o justice_n at_o their_o quarter-session_n when_o they_o see_v cause_n may_v make_v a_o rate_n for_o the_o repair_n of_o the_o say_a highway_n of_o such_o sum_n or_o sum_n of_o money_n as_o they_o think_v fit_a for_o the_o speedy_a effect_v the_o repair_v thereof_o to_o be_v raise_v upon_o the_o parish_n that_o lie_v in_o or_o near_o the_o say_a road_n and_o to_o be_v pay_v to_o the_o surveyor_n or_o to_o their_o receiver_n or_o collector_n and_o in_o â—ase_n of_o refusal_n by_o any_o person_n to_o pay_v than_o the_o say_a surveyor_n or_o their_o receiver_n or_o collector_n may_v distrain_v for_o such_o sum_n or_o sum_n of_o money_n and_o sell_v the_o distress_n render_v the_o overplus_n to_o the_o owner_n and_o the_o money_n so_o advance_v 11._o repayment_n out_o of_o the_o toll_n to_o the_o town_n charge_v with_o a_o rate_n keb._n st._n f._n 1258._o sect_n 7._o such_o as_o be_v former_o chargeable_a towards_o repair_v to_o be_v so_o still_o keb._n ibid._n f._n 1259._o sect_n 11._o by_o the_o say_a town_n be_v to_o be_v repay_v by_o the_o surveyor_n as_o it_o do_v arise_v out_o of_o the_o toll_n and_o such_o person_n who_o by_o â—aw_v be_v chargeable_a towards_o the_o repair_n of_o the_o say_a highway_n and_o place_n shall_v still_o remain_v so_o chargeable_a notwithstanding_o this_o act_n of_o parliament_n all_o fine_n and_o forfeiture_n incur_v 9_o fine_n and_o forfeiture_n to_o be_v levy_v by_o the_o surveyor_n keb._n stat._n 1258._o sect_n 9_o by_o this_o act_n shall_v be_v pay_v to_o the_o surveyor_n or_o any_o three_o of_o they_o or_o their_o treasurer_n towards_o the_o repair_n the_o say_a highway_n and_o place_n and_o in_o ibid._n in_o case_n of_o refusal_n or_o death_n new_a surveyor_n to_o be_v choose_v keb._n ibid._n case_n of_o refusal_n or_o of_o person_n accept_v and_o die_v in_o the_o office_n or_o discharge_v for_o any_o lawful_a impediment_n than_o two_o or_o more_o justice_n in_o the_o county_n live_v in_o or_o near_o the_o say_a highway_n and_o place_n aforesaid_a be_v to_o appoint_v some_o other_o fit_a person_n or_o person_n within_o the_o county_n in_o the_o place_n of_o he_o or_o they_o so_o refuse_v die_a or_o discharge_v and_o such_o person_n as_o be_v so_o choose_v have_v notice_n thereof_o give_v under_o the_o hand_n and_o seal_n of_o such_o justice_n so_o choose_v they_o be_v to_o take_v upon_o they_o the_o office_n and_o execute_v the_o same_o in_o such_o manner_n and_o under_o such_o penalty_n as_o if_o he_o or_o they_o have_v be_v choose_v by_o the_o justice_n at_o their_o session_n of_o the_o peace_n in_o manner_n aforesaid_a and_o all_o suit_n upon_o 10._o action_n upon_o this_o statute_n to_o be_v lay_v in_o the_o same_o county_n general_a issue_n plead_v and_o give_v special_a matter_n in_o evidence_n keb._n ib._n sect_n 10._o this_o act_n to_o be_v lay_v in_o the_o same_o county_n and_o the_o desendant_n may_v plead_v the_o general_n issue_n and_o give_v the_o special_a matter_n in_o evidence_n and_o if_o at_o the_o trial_n it_o appear_v the_o matter_n be_v do_v in_o pursuance_n and_o by_o authority_n of_o this_o act_n and_o that_o such_o action_n shall_v be_v bring_v in_o any_o other_o county_n than_o the_o jury_n to_o find_v for_o the_o defendant_n and_o upon_o such_o verdict_n or_o that_o the_o plaintiff_n shall_v be_v nonsuit_v or_o discontinue_v this_o action_n after_o the_o defendant_n appearance_n or_o if_o upon_o demurrer_n judgement_n shall_v be_v give_v against_o the_o plaintiff_n the_o defendant_n shall_v have_v double_a cost_v and_o have_v like_o remedy_n for_o the_o same_o as_o any_o defendant_n have_v in_o other_o case_n by_o law_n and_o this_o act_n be_v to_o continue_v for_o eleven_o year_n which_o end_v anno_fw-la dom._n 1674._o then_o by_o the_o statute_n of_o the_o 16_o and_o 3._o 16_o &_o 17_o car._n 2._o ch_n 10._o toll_n at_o wade_v mill_n continue_v for_o
