although_o in_o inferior_a county_n court_v where_o many_o time_n be_v ignorant_a judge_n and_o mean_a clerk_n and_o in_o ordinary_a offence_n this_o maxim_n may_v hold_v good_a that_o communis_fw-la error_n facit_fw-la jus_fw-la that_o the_o common_a practice_n of_o a_o error_n make_v it_o the_o law_n of_o the_o court_n and_o not_o convenient_a to_o be_v alter_v yet_o i_o have_v never_o observe_v that_o maxim_n to_o take_v place_n in_o the_o high_a court_n of_o justice_n in_o this_o kingdom_n before_o the_o judge_n of_o the_o court_n at_o westminster_n justice_n of_o oyer_n and_o terminer_n justice_n of_o goal-delivery_n and_o justice_n of_o assize_n who_o sit_v not_o to_o practise_v but_o to_o correct_v and_o destroy_v error_n of_o all_o kind_n especial_o in_o trial_n of_o man_n life_n in_o case_n of_o blood_n and_o whoever_o shall_v urge_v that_o maxim_n against_o what_o i_o have_v here_o say_v do_v by_o that_o sufficient_o grant_v what_o i_o have_v here_o endeavour_v to_o prove_v viz._n the_o error_n and_o inconvenience_n of_o such_o practice_n which_o ought_v no_o more_o to_o be_v continue_v than_o a_o long_a custom_n when_o it_o be_v find_v to_o be_v unreasonable_a but_o i_o shall_v never_o allow_v neither_o can_v it_o be_v prove_v that_o there_o have_v be_v in_o this_o kingdom_n such_o liberty_n and_o practice_n allow_v and_o indulge_v by_o the_o reverend_n and_o learned_a judge_n to_o grand_a juror_n to_o find_v and_o alter_v indictment_n bring_v unto_o they_o in_o case_n of_o blood_n as_o they_o themselves_o please_v and_o judge_v convenient_a they_o be_v as_o have_v be_v say_v before_o not_o the_o judge_n nor_o the_o trier_n but_o presenter_n of_o a_o fact_n of_o blood_n fit_a for_o the_o judgement_n of_o the_o jury_n of_o life_n and_o death_n who_o
