assize_n concerning_o arm_n whereunto_o they_o can_v refer_v as_o constant_o use_v for_o the_o time_n past_a or_o that_o may_v constant_o endure_v for_o time_n to_o come_v neither_o ever_o be_v or_o this_o time_n in_o 1._o e._n 3._o and_o will_v so_o continue_v afterwards_o and_o now_o that_o we_o have_v clear_v this_o first_o part_n of_o the_o statute_n of_o 1._o e._n 3._o as_o concerning_o the_o arm_v a_o man_n self_n that_o it_o be_v not_o thereby_o intend_v that_o the_o subject_n shall_v not_o be_v charge_v with_o arm_n otherwise_o then_o according_a to_o the_o statute_n of_o 13._o appear_v for_o the_o want_n of_o the_o roll_n of_o that_o parliament_n yet_o we_o may_v well_o judge_v thereof_o upon_o this_o occasion_n happen_v within_o the_o compass_n of_o about_o one_o year_n the_o time_n of_o former_a king_n and_o according_a to_o our_o commission_n moderate_o and_o so_o as_o they_o may_v live_v still_o according_a to_o their_o former_a condition_n as_o in_o like_o case_n of_o other_o statute_n against_o outrageous_a distress_n and_o amerciament_n and_o although_o we_o take_v this_o to_o be_v the_o sense_n of_o that_o statute_n yet_o if_o any_o man_n shall_v think_v this_o part_n of_o the_o statute_n of_o 1._o e._n 3._o concerning_o arm_v a_o man_n self_n to_o be_v the_o same_o with_o the_o word_n of_o the_o statute_n of_o 25._o e._n 3._o against_o constrain_v any_o man_n to_o find_v man_n of_o arm_n etc._n etc._n which_o be_v the_o sense_n of_o this_o declaration_n which_o make_v both_o statute_n to_o be_v to_o the_o same_o effect_n and_o make_v the_o authority_n be_v chief_o insist_v upon_o in_o this_o declaration_n our_o commission_n be_v no_o way_n oppose_v by_o either_o of_o those_o statute_n and_o it_o be_v this_o it_o appear_v that_o the_o late_a issue_n of_o the_o commissioner_n complain_v of_o in_o 4._o h._n 4._o which_o the_o declaration_n suppose_v be_v of_o the_o same_o nature_n with_o our_o commission_n but_o we_o deny_v it_o be_v the_o occasion_n of_o the_o petition_n of_o the_o commons_o in_o that_o parliament_n in_o which_o petition_n they_o intend_v to_o show_v the_o illegality_n of_o those_o commission_n and_o to_o obtain_v as_o they_o thereupon_o do_v a_o confirmation_n of_o former_a act_n to_o the_o contrary_a do_v recite_v the_o statute_n of_o 25._o e._n 3._o 18._o e._n 3_o c._n 8._o and_o that_o part_n of_o the_o statute_n of_o 1._o e._n 3._o which_o be_v against_o carry_v of_o man_n out_o of_o their_o county_n and_o yet_o nevertheless_o they_o whole_o omit_v this_o statute_n of_o 13._o e._n 1._o and_o this_o first_o part_n of_o the_o statute_n of_o 1._o e._n 3._o concerning_o the_o arm_v whereas_o it_o be_v to_o be_v presume_v they_o will_v have_v also_o recite_v this_o statute_n of_o 13._o e._n 1._o if_o they_o have_v conceive_v the_o same_o to_o be_v as_o this_o declaration_n set_v it_o forth_o the_o certain_a assize_n for_o arm_n and_o such_o a_o statute_n whereto_o all_o the_o rest_n hereupon_o the_o objection_n be_v this_o that_o by_o the_o statute_n of_o 1._o e._n 3_o and_o 4._o h._n 4._o the_o subject_n be_v not_o compellable_a to_o go_v out_o of_o his_o county_n but_o in_o case_n of_o the_o sudden_a come_n of_o a_o enemy_n which_o the_o declaration_n interpret_v of_o a_o actual_a invasion_n but_o this_o commission_n give_v power_n not_o only_o to_o compel_v the_o second_o as_o to_o the_o sense_n of_o the_o statute_n we_o do_v deny_v that_o the_o subject_n be_v not_o compellable_a to_o go_v out_o of_o his_o county_n unless_o in_o case_n of_o a_o actual_a invasion_n by_o a_o foreign_a enemy_n and_o herein_o though_o we_o have_v not_o upon_o this_o commission_n necessary_a occasion_n to_o dispute_v it_o yet_o we_o can_v but_o observe_v that_o the_o declaration_n allow_v of_o no_o necessity_n of_o compel_v the_o subject_a out_o of_o the_o proper_a county_n in_o case_n of_o actual_a rebellion_n and_o only_o against_o a_o foreign_a enemy_n the_o ground_n whereof_o be_v a_o mistake_n in_o recital_n of_o the_o statute_n of_o 1._o e._n 3._o by_o the_o act_n of_o confirmation_n of_o 4._o h._n 4._o of_o the_o word_n and_o between_o the_o two_o word_n necessity_n and_o sudden_a come_n the_o act_n of_o 1._o e._n 3._o go_v thus_o that_o no_o man_n be_v distrain_v to_o go_v out_o of_o his_o county_n but_o where_o necessity_n require_v and_o sudden_a come_n of_o strange_a enemy_n into_o the_o realm_n and_o the_o act_n of_o 4._o h._n 4._o which_o as_o we_o have_v before_o observe_v recite_v not_o the_o whole_a statute_n of_o 1._o e._n 3._o spare_v he_o in_o this_o special_a and_o particular_a case_n of_o impotency_n from_o contribute_v to_o the_o defence_n of_o the_o kingdom_n doom_n by_o find_v another_o as_o in_o his_o place_n while_o he_o be_v as_o much_o or_o more_o concern_v than_o other_o who_o must_v undergo_v as_o much_o charge_n and_o must_v also_o adventure_v their_o own_o person_n and_o by_o the_o common_a law_n whereof_o to_o the_o same_o effect_n that_o then_o our_o answer_n to_o any_o of_o these_o three_o be_v a_o answer_n to_o the_o rest_n we_o be_v now_o come_v to_o 4._o h._n 4._o be_v the_o last_o of_o these_o statute_n which_o in_o the_o matter_n of_o arm_v be_v object_v against_o our_o commission_n as_o it_o stand_v at_o common_a law_n before_o 5._o h._n 4._o and_o herein_o we_o agree_v that_o the_o parliament_n roll_n whereupon_o the_o statute_n be_v frame_v be_v true_o set_v forth_o in_o the_o declaration_n yet_o we_o conceive_v that_o in_o substance_n there_o be_v no_o more_o upon_o the_o roll_n then_o in_o the_o print_n though_o some_o passage_n may_v give_v some_o light_n for_o the_o exposition_n of_o these_o other_o statute_n of_o 1._o e._n 3._o and_o 25._o e._n 3._o therein_o can_v be_v do_v without_o charge_n yet_o we_o appeal_v to_o every_o man_n understanding_n whether_o our_o subject_n can_v upon_o this_o commission_n be_v say_v to_o make_v or_o yield_v for_o so_o be_v have_v be_v mere_a pecuniary_a payment_n and_o which_o we_o ought_v to_o have_v bear_v and_o for_o the_o other_o charge_n that_o be_v of_o tax_n tallage_n aid_n likewise_o mention_v which_o as_o to_o this_o purpose_n be_v but_o synonoma_n and_o of_o one_o signification_n they_o be_v mean_v of_o money_n or_o other_o thing_n valuable_a and_o for_o the_o king_n and_o so_o use_v in_o the_o old_a statute_n and_o have_v be_v in_o former_a time_n impose_v upon_o the_o people_n without_o act_n of_o parliament_n and_o according_o all_o of_o they_o be_v so_o to_o be_v expound_v in_o the_o preamble_n and_o the_o prayer_n of_o the_o petition_n say_v nothing_o express_o against_o the_o command_v the_o subject_a to_o do_v a_o thing_n which_o may_v be_v necessary_o of_o expense_n or_o charge_n wherein_o the_o act_n be_v only_o intend_v and_o the_o charge_n but_o a_o necessary_a incident_a but_o the_o prayer_n be_v only_o against_o the_o compel_n of_o the_o subject_a to_o yield_v or_o make_v those_o kind_n of_o charge_n so_o as_o the_o clear_a sense_n of_o the_o petition_n both_o according_a to_o the_o occasion_n of_o complaint_n therein_o mention_v and_o the_o law_n whereupon_o it_o be_v frame_v as_o well_o as_o the_o propriety_n of_o the_o word_n be_v only_o against_o draw_v from_o the_o subject_a either_o money_n or_o money-worth_n by_o any_o of_o those_o particular_a charge_n therein_o mention_v or_o any_o other_o charge_n of_o like_a nature_n under_o what_o specious_a title_n soever_o for_o the_o king_n advantage_n which_o the_o more_o plain_o appear_v for_o that_o the_o charge_n must_v be_v yield_v or_o make_v as_o upon_o gift_n loan_n etc._n etc._n which_o must_v necessary_o be_v intend_v unto_o some_o person_n and_o no_o other_o person_n can_v be_v here_o colourable_o intend_v but_o the_o king_n and_o if_o the_o petition_n by_o any_o construction_n may_v extend_v against_o the_o command_n of_o any_o act_n which_o in_o the_o execution_n may_v induce_v charge_n yet_o such_o charge_n must_v according_a to_o the_o very_a word_n of_o the_o petition_n be_v such_o like_a charge_n that_o be_v for_o we_o or_o our_o advantage_n contain_v in_o the_o general_a word_n of_o the_o prayer_n to_o which_o we_o have_v answer_v before_o and_o though_o it_o be_v to_o this_o purpose_n say_v in_o the_o declaration_n that_o those_o charge_n by_o lord_n lieutenant_n and_o other_o be_v mean_v of_o charge_v of_o the_o subject_a with_o arm_n certain_o no_o such_o thing_n can_v appear_v in_o the_o petition_n which_o speak_v but_o only_o of_o divers_a charge_n but_o name_v none_o in_o particular_a nor_o can_v there_o be_v any_o other_o assurance_n that_o the_o house_n do_v intend_v any_o such_o thing_n but_o by_o vote_n wherein_o they_o only_o speak_v
of_o these_o commission_n not_o warrant_v by_o they_o be_v no_o cause_n to_o quarrel_v at_o the_o commission_n themselves_o more_o than_o at_o the_o commission_n of_o peace_n because_o some_o new_a commission_n omit_v such_o clause_n but_o if_o we_o shall_v for_o this_o time_n admit_v the_o ground_n of_o this_o objection_n that_o our_o commission_n of_o lieutenancy_n have_v be_v such_o as_o this_o declaration_n will_v have_v they_o yet_o it_o be_v but_o a_o very_a inconsequent_a argument_n that_o those_o commission_n will_v not_o have_v issue_v so_o often_o and_o be_v so_o much_o press_v if_o the_o commission_n of_o array_n have_v be_v legal_a for_o the_o commission_n of_o lieutenancy_n contain_v not_o only_o most_o of_o the_o power_n of_o the_o commission_n of_o array_n but_o issue_v in_o the_o reign_v of_o several_a of_o our_o predecessor_n and_o be_v allow_v by_o the_o judge_n of_o those_o time_n obey_v without_o dispute_n and_o not_o question_v in_o the_o parliament_n of_o 1._o iac._n or_o 21._o iac._n nor_o be_v these_o power_n wherein_o they_o agree_v with_o the_o commission_n of_o array_n complain_v of_o by_o the_o petition_n of_o right_n but_o rather_o admit_v make_v against_o our_o commission_n of_o array_n upon_o all_o which_o objection_n we_o shall_v further_o observe_v that_o although_o the_o declaration_n deny_v our_o power_n at_o this_o day_n of_o command_v to_o train_n or_o exercise_n yet_o none_o of_o those_o objection_n touch_v any_o thing_n upon_o those_o power_n so_o that_o if_o all_o be_v true_a which_o be_v object_v yet_o we_o shall_v still_o have_v power_n at_o least_o by_o a_o distinct_a commission_n to_o command_v our_o subject_n to_o be_v discipline_v muster_v train_v and_o exercise_v with_o such_o arm_n as_o they_o have_v in_o a_o readiness_n for_o that_o as_o we_o have_v show_v before_o these_o be_v distinct_a from_o the_o power_n of_o impose_v of_o arm_n and_o may_v be_v several_o grant_v or_o execute_v and_o now_o upon_o
