we_o shall_v out_o of_o the_o pen_n and_o otherwise_o upon_o sure_a ground_n conclude_v the_o contrary_a for_o first_o in_o this_o case_n regular_o if_o not_o necessary_o where_o a_o late_a statute_n in_o the_o substance_n and_o meaning_n thereof_o whole_o depend_v upon_o a_o former_a and_o must_v have_v reference_n thereunto_o the_o parliament_n of_o 1._o e._n 3._o will_v have_v make_v mention_n of_o this_o statute_n of_o 13._o e._n 1._o as_o they_o do_v thereof_o the_o next_o year_n follow_v when_o it_o be_v renew_a but_o for_o keep_v of_o the_o peace_n next_o in_o wisdom_n it_o be_v fit_v if_o so_o be_v that_o they_o have_v intend_v a_o further_a re-establishment_n of_o the_o particularity_n of_o the_o kind_n and_o proportion_n of_o arm_n mention_v in_o 13._o e._n 1._o that_o when_o they_o have_v a_o former_a statute_n so_o punctual_a therein_o they_o shall_v not_o have_v thus_o leave_v we_o for_o a_o true_a understanding_n of_o their_o meaning_n to_o a_o general_a inquiry_n of_o the_o particular_a assize_n use_v for_o arm_n in_o former_a time_n but_o on_o the_o contrary_a the_o statute_n refer_v to_o the_o former_a usage_n in_o the_o time_n of_o the_o king_n progenitor_n the_o statute_n of_o 25._o e._n 3._o there_o be_v not_o only_o to_o be_v a_o consent_n but_o also_o a_o grant_n in_o parliament_n for_o so_o the_o word_n be_v if_o it_o be_v not_o by_o common_a consent_n and_o grant_v in_o parliament_n but_o in_o those_o act_n of_o 13._o e._n 1._o and_o 1._o e._n 3._o there_o be_v no_o colour_n of_o a_o grant_v make_v at_o all_o and_o this_o statute_n be_v declaratory_a of_o the_o common_a law_n as_o appear_v by_o the_o reason_n of_o the_o act_n deliver_v in_o the_o petition_n of_o the_o commons_o in_o these_o word_n car_fw-fr cet_fw-fr est_fw-fr spare_v he_o in_o this_o special_a and_o particular_a case_n of_o impotency_n from_o contribute_v to_o the_o defence_n of_o the_o kingdom_n doom_n by_o find_v another_o as_o in_o his_o place_n while_o he_o be_v as_o much_o or_o more_o concern_v than_o other_o who_o must_v undergo_v as_o much_o charge_n and_o must_v also_o adventure_v their_o own_o person_n and_o by_o the_o common_a law_n whereof_o to_o the_o same_o effect_n that_o then_o our_o answer_n to_o any_o of_o these_o three_o be_v a_o answer_n to_o the_o rest_n we_o be_v now_o come_v to_o 4._o h._n 4._o be_v the_o last_o of_o these_o statute_n which_o in_o the_o matter_n of_o arm_v be_v object_v against_o our_o commission_n as_o it_o stand_v at_o common_a law_n before_o 5._o h._n 4._o and_o herein_o we_o agree_v that_o the_o parliament_n roll_n whereupon_o the_o statute_n be_v frame_v be_v true_o set_v forth_o in_o the_o declaration_n yet_o we_o conceive_v that_o in_o substance_n there_o be_v no_o more_o upon_o the_o new_a commission_n omit_v such_o clause_n but_o if_o we_o shall_v for_o this_o time_n admit_v the_o ground_n of_o this_o objection_n that_o our_o commission_n of_o lieutenancy_n have_v be_v such_o as_o this_o declaration_n will_v have_v they_o yet_o it_o be_v but_o a_o very_a inconsequent_a argument_n that_o those_o commission_n will_v not_o have_v issue_v so_o often_o and_o be_v so_o much_o press_v if_o the_o commission_n of_o array_n have_v be_v legal_a for_o the_o commission_n of_o lieutenancy_n contain_v not_o only_o most_o of_o the_o power_n of_o the_o commission_n of_o array_n but_o
