depredation_n or_o in_o the_o pursuit_n of_o denounce_v or_o declare_v rebel_n for_o capital_a crime_n or_o of_o such_o who_o assist_v and_o defend_v the_o rebel_n and_o masterfull_a depredator_n by_o arm_n and_o by_o force_n oppose_v the_o pursuit_n and_o apprehend_v of_o they_o which_o shall_v happen_v to_o fall_v out_o in_o time_n come_v nor_o any_o of_o they_o shall_v not_o be_v punish_v by_o every_o ordinary_a quarter_n session_n or_o otherways_o when_o he_o be_v require_v lawful_o by_o the_o custos_fw-la rotulorum_fw-la to_o any_o particular_a meeting_n shall_v incur_v the_o penalty_n of_o forty_o pound_n scot_n money_n not_o be_v lawful_o excuse_v and_o the_o excuse_v allow_v by_o the_o rest_n of_o the_o justice_n there_o assemble_v the_o lord_n of_o session_n shall_v direct_v baron_n two_o hundred_o pound_n each_o other_o gentleman_n and_o burgess_n one_o hundred_o pound_n every_o other_o person_n of_o inferior_a quality_n ten_o pound_n scot_n money_n and_o that_o these_o penalty_n shall_v be_v double_v toties_fw-la quoties_fw-la according_a to_o the_o relapse_n and_o degree_n of_o the_o offence_n and_o quality_n of_o the_o offender_n and_o that_o the_o say_v penalty_n shall_v be_v levy_v not_o only_o of_o the_o man_n but_o also_o of_o the_o woman_n according_a to_o her_o quality_n and_o the_o degree_n of_o her_o offence_n the_o one_o without_o prejudice_n of_o the_o other_o all_o and_o sundry_a which_o penalty_n so_o to_o be_v levy_v be_v to_o be_v dispose_v of_o as_o follow_v to_o wit_n one_o half_a to_o pious_a use_n in_o the_o same_o paroch_n where_o the_o offender_n live_v or_o the_o offence_n have_v be_v commit_v and_o the_o other_o half_a to_o be_v divide_v in_o two_o equal_a part_n one_o part_n whereof_o to_o be_v give_v to_o the_o informer_n they_o which_o penalty_n in_o the_o say_n several_a act_n contain_v the_o say_n justice_n be_v to_o levy_v or_o cause_n to_o be_v levy_v upon_o the_o said_n delinquent_n and_o the_o say_n penalty_n be_v to_o be_v dispose_v of_o by_o the_o said_n justice_n in_o likemanner_n as_o aforesaid_a the_o say_n justice_n shall_v put_v in_o execution_n all_o act_n of_o parliament_n make_v against_o such_o person_n as_o shall_v profane_a the_o lordsday_n and_o require_v or_o levy_v the_o penalty_n therein_o contain_v which_o penalty_n foresay_a the_o say_n justice_n be_v to_o dispose_v of_o in_o likemanner_n as_o aforesaid_a and_o at_o what_o time_n and_o whensoever_o one_o shall_v accuse_v another_o person_n or_o person_n to_o be_v guilty_a of_o treason_n murder_n or_o other_o felony_n blasphemy_n incest_n or_o any_o other_o heinous_a crime_n in_o such_o case_n the_o say_a justice_n or_o justice_n shall_v forthwith_o cause_v such_o person_n or_o person_n to_o be_v apprehend_v and_o after_o inquiry_n make_v in_o the_o cause_n the_o say_a justice_n or_o justice_n if_o they_o find_v cause_n shall_v commit_v the_o offender_n to_o prison_n or_o take_v sufficient_a bail_n if_o the_o respective_o to_o the_o end_n the_o justice_n may_v proceed_v against_o they_o according_a to_o the_o law_n and_o if_o any_o nobleman_n baron_n or_o baily_n or_o any_o in_o their_o name_n have_v power_n shall_v acclaim_v the_o right_n of_o jurisdiction_n to_o proceed_v against_o any_o delinquent_n apprehend_v by_o a_o constable_n for_o any_o capital_a crime_n then_o and_o in_o that_o case_n any_o of_o the_o justice_n shall_v receive_v security_n of_o the_o say_a party_n who_o require_v the_o defender_n to_o be_v deliver_v to_o he_o that_o justice_n shall_v be_v due_o minister_v and_o the_o poor_a in_o every_o paroch_n within_o burgh_n or_o land_n into_o which_o number_n there_o shall_v no_o person_n be_v receive_v who_o be_v any_o way_n able_a to_o gain_v their_o own_o live_n and_o to_o the_o effect_n these_o poor_a may_v no_o long_o be_v necessitate_v to_o seek_v their_o live_n with_o such_o hardship_n and_o difficulty_n by_o scandalous_a vage_v as_o hitherto_o they_o have_v be_v in_o use_n of_o the_o justice_n shall_v appoint_v two_o or_o more_o person_n of_o good_a same_o and_o quality_n in_o every_o paroch_n to_o be_v overseer_n for_o the_o poor_a in_o each_o paroch_n aforesaid_a and_o to_o authorise_v the_o say_v overseer_n to_o make_v due_a trial_n and_o examination_n of_o the_o condition_n and_o number_n of_o such_o poor_a aged_n sick_a lame_a and_o impotent_a inhabitant_n of_o the_o say_a paroch_n who_o of_o themselves_o have_v not_o to_o maintain_v they_o nor_o be_v able_a to_o work_v for_o their_o live_n as_o also_o of_o all_o orphan_n and_o other_o poor_a child_n within_o the_o say_a paroch_n who_o be_v
leave_v destitute_a of_o all_o help_n and_o the_o say_n overseer_n be_v to_o list_n and_o enrol_v all_o such_o person_n and_o to_o provide_v they_o such_o a_o convenient_a house_n for_o their_o dwell_n either_o a_o part_n or_o together_o as_o they_o shall_v judge_v requisite_a and_o upon_o consideration_n have_v what_o the_o necessary_a maintenance_n will_v extend_v to_o weekly_o the_o say_n overseer_n be_v to_o call_v for_o the_o collection_n of_o the_o say_a paroch_n or_o other_o sum_v appoint_v for_o the_o maintenance_n of_o the_o poor_a thereof_o and_o the_o person_n who_o have_v parliament_n ratify_v and_o approve_v and_o for_o his_o highness_n and_o his_o successor_n perpetual_o confirm_v the_o ten_o act_n of_o the_o first_o parliament_n of_o his_o majesty_n royal_a father_n of_o bless_a memory_n king_n charles_n the_o first_o hold_v at_o edinburgh_n in_o anno_fw-la one_o thousand_o six_o hundred_o and_o thirty_o three_o entitle_v a_o act_n anent_o the_o annexation_n of_o his_o majesty_n property_n in_o the_o whole_a head_n and_o clause_n thereof_o especial_o that_o clause_n of_o the_o same_o whereby_o his_o majesty_n and_o the_o estate_n of_o parliament_n then_o convene_v do_v declare_v the_o right_n and_o title_n of_o superiority_n of_o all_o and_o sundry_a land_n barony_n milnes_n wood_n fishing_n tower_n fortalices_n mannor-place_n and_o pertinent_o thereof_o pertain_v to_o whatsoever_o abbacy_n priory_n prioress_n preceptory_n and_o whatsoever_o other_o benefice_n of_o whatsoever_o estate_n degree_n title_n name_n or_o designation_n the_o same_o be_v of_o erect_v in_o temporal_a lordship_n barony_n or_o live_n before_o or_o after_o the_o general_a act_n of_o annexation_n of_o kirk-land_n make_v in_o the_o month_n of_o july_n one_o thousand_o five_o hundred_o eighty_o and_o seven_o together_o with_o the_o whole_a few-mails_a few-fermes_a and_o other_o rent_n and_o duty_n of_o the_o say_n superiority_n to_o be_v annex_v and_o to_o remain_v with_o the_o crown_n for_o ever_o upon_o the_o reservation_n of_o the_o lord_n and_o titular_o of_o erection_n therein_o specify_v likeas_n thereby_o his_o majesty_n and_o estate_n aforesaid_a find_a and_o declare_v that_o all_o titular_o of_o erection_n without_o exception_n shall_v hold_v their_o property_n and_o proper_a land_n of_o the_o king_n majesty_n and_o his_o successor_n in_o few-ferm_a deed_n make_v and_o grant_v to_o whatsoever_o person_n or_o person_n precede_v the_o date_n of_o the_o foresay_a act_n which_o may_v prejudge_v his_o majesty_n and_o his_o successor_n in_o the_o peaceable_a enjoy_v of_o the_o say_a superiority_n and_o few-ferm-duty_n shall_v be_v null_a and_o of_o no_o avail_n by_o way_n of_o action_n exception_n or_o reply_n and_o further_o his_o majesty_n with_o advice_n and_o consent_n foresaid_n of_o new_a declare_v the_o foresay_a superiority_n of_o all_o and_o whatsoever_o kirk-land_n milnes_n wood_n fishing_n and_o whole_a pertinent_o of_o the_o same_o pertain_v of_o before_o to_o whatsoever_o chapter_n prior_n prioress_n preceptor_n and_o whatsoever_o other_o benefice_n of_o whatsoever_o other_o estate_n degree_n title_n or_o designation_n they_o be_v of_o whereof_o the_o presentation_n belong_v to_o his_o majesty_n and_o his_o highness_n predecessor_n erect_v in_o temporal_a lordship_n barony_n and_o live_n to_o pertain_v to_o his_o
