A45124 The authority of magistrate about religion discussed in a rebuke to the preacher of a late book of Bishop Bramhalls, being a confutation of that mishapen tenent, of the magistrates authority over the conscience in the matters of religion, and better asserting of his authority ecclesiastical, by dividing aright between the use of his sword about religious affairs, and tenderness towards mens consciences : and also for vindication of the grateful receivers of His Majesties late gracious declaration, against his and others aspersions / by J.H. Humfrey, John, 1621-1719. 1672 (1672) Wing H3669; ESTC R20217 60,044 138

such_o where_o the_o superior_a command_n what_o he_o ought_v i_o will_v express_v it_o if_o you_o will_v in_o other_o word_n when_o the_o superior_a command_v any_o thing_n which_o he_o ought_v we_o be_v oblige_v for_o conscience_n sake_n and_o the_o five_o commandment_n require_v we_o to_o do_v the_o thing_n or_o else_o we_o break_v that_o command_n because_o this_o thing_n bear_v in_o it_o the_o authority_n of_o both_o commander_n when_o he_o command_v any_o thing_n which_o he_o ought_v not_o we_o be_v oblige_v for_o wrath_n sake_n and_o the_o five_o commandment_n require_v only_o that_o we_o do_v not_o resist_v so_o that_o if_o we_o resist_v not_o we_o give_v that_o honour_n and_o pay_v that_o duty_n to_o the_o magistrate_n which_o we_o owe_v in_o this_o case_n if_o we_o suffer_v with_o submission_n or_o obey_v rather_o than_o suffer_v or_o avoid_v both_o the_o grievance_n and_o suffering_n with_o prudence_n neither_o bring_v contempt_n on_o his_o authority_n or_o induce_v our_o brethren_n to_o sin_n we_o be_v to_o account_v that_o we_o answer_v the_o intent_n of_o this_o commandment_n i_o must_v add_v still_o that_o this_o be_v as_o much_o too_o as_o the_o magistrate_n himself_o need_v desire_n in_o the_o earth_n see_v if_o he_o be_v strict_a upon_o it_o and_o the_o thing_n be_v not_o sinful_a he_o may_v take_v any_o body_n do_v what_o he_o please_v upon_o this_o account_n as_o for_o our_o prefacer_n it_o must_v be_v yet_o a_o great_a reproof_n to_o his_o undertake_n that_o in_o this_o endeavour_n of_o he_o to_o set_v up_o a_o authority_n in_o the_o magistrate_n over_o the_o conscience_n in_o all_o matter_n external_n he_o be_v certain_o fall_v in_o with_o mr_n hobbs_n who_o yet_o to_o avoid_v the_o odium_fw-la he_o be_v fain_o himself_o to_o confute_v for_o when_o that_o more_o considerable_a person_n according_a to_o his_o principle_n of_o government_n make_v all_o man_n by_o nature_n before_o they_o come_v into_o society_n to_o be_v in_o a_o state_n of_o war_n that_o give_v every_o man_n right_o to_o every_o thing_n which_o right_a upon_o their_o agreement_n into_o a_o commonwealth_n be_v give_v up_o he_o count_v into_o the_o hand_n of_o the_o sovereign_a to_o determine_v propriety_n so_o that_o his_o will_n thenceforth_o become_v the_o measure_n of_o right_n and_o wrong_n to_o the_o community_n he_o proceed_v so_o far_o upon_o the_o conceit_n as_o to_o condemn_v these_o two_o position_n that_o every_o man_n be_v judge_v of_o good_a and_o evil_a doctrine_n that_o whatsoever_o a_o man_n do_v against_o his_o conscience_n be_v sin_n see_v his_o leviathan_n c._n 29._o now_o let_v we_o compare_v this_o ingenuous_o as_o we_o ought_v see_v else_o it_o be_v so_o bad_a with_o other_o place_n in_o his_o book_n that_o subject_n owe_v to_o sovereign_n simple_a obedience_n in_o all_o thing_n wherein_o their_o obedience_n be_v not_o repugnant_a to_o the_o law_n of_o god_n i_o have_v prove_v c._n 31._o again_o it_o be_v manifest_a enough_o that_o when_o a_o man_n receive_v two_o contrary_a command_n and_o know_v that_o one_o of_o they_o be_v god_n he_o ought_v to_o obey_v that_o and_o not_o the_o other_o though_o it_o be_v the_o command_n of_o his_o lawful_a sovereign_n or_o his_o father_n c._n 43._o it_o do_v appear_v then_o when_o the_o ecclesiastical_a politician_n do_v confine_v the_o authority_n he_o give_v the_o magistrate_n over_o the_o conscience_n to_o external_a and_o indifferent_a thing_n allow_v the_o authority_n of_o the_o conscience_n over_o the_o magistrate_n in_o thing_n intrinsical_o sinful_a and_o express_o forbid_v by_o god_n he_o do_v but_o the_o same_o which_o mr._n hobbs_n do_v also_o if_o you_o compare_v they_o equal_o take_v one_o place_n with_o another_o but_o herein_o be_v they_o wicked_a companion_n both_o that_o they_o shall_v once_o offer_v to_o take_v away_o from_o reasonable_a agent_n a_o judgement_n of_o private_a discretion_n in_o any_o concernment_n of_o conscience_n whatsoever_o one_o may_v easy_o indeed_o perceive_v what_o the_o content_n of_o this_o young_a man_n paper_n do_v amount_v unto_o he_o dare_v not_o take_v off_o all_o obligation_n of_o good_a and_o evil_n from_o man_n conscience_n antecedent_n to_o humane_a law_n as_o hobbs_n in_o that_o one_o place_n though_o otherwhere_o as_o it_o seem_v he_o intend_v not_o so_o far_o have_v do_v because_o this_o be_v not_o only_o the_o way_n to_o ruin_v religion_n but_o his_o name_n and_o to_o bring_v all_o government_n also_o to_o ruin_n which_o he_o engage_v to_o assert_v but_o he_o will_v take_v off_o all_o obligation_n from_o man_n conscience_n in_o the_o whole_a business_n of_o conformity_n antecedent_n to_o the_o will_n of_o the_o parliament_n and_o bishop_n so_o as_o their_o act_n must_v be_v the_o rule_n of_o good_a and_o evil_n to_o we_o as_o to_o these_o matter_n he_o do_v tell_v we_o indeed_o of_o a_o liberty_n to_o our_o judgement_n and_o to_o our_o faith_n but_o when_o he_o will_v allow_v we_o to_o judge_v and_o believe_v of_o these_o thing_n as_o we_o do_v and_o will_v yet_o have_v we_o account_v that_o the_o public_a conscience_n the_o law_n and_o not_o the_o private_a dictate_v of_o our_o own_o must_v govern_v our_o outward_a action_n it_o do_v bring_v to_o my_o mind_n one_o passage_n more_o in_o his_o friend_n what_o if_o a_o sovereign_n forbid_v his_o subject_n to_o believe_v in_o christ_n i_o answer_v say_v mr._n hobbs_n it_o be_v no_o effect_n because_o belief_n or_o unbelief_n never_o follow_v man_n command_n but_o what_o if_o we_o be_v command_v to_o confess_v with_o our_o tongue_n it_o be_v a_o external_a thing_n and_o no_o more_o than_o any_o other_o gesture_n whereby_o we_o signify_v our_o obedience_n and_o a_o christian_a hold_v firm_o in_o his_o heart_n the_o faith_n of_o christ_n have_v the_o same_o liberty_n herein_o with_o naaman_n leviathan_n c._n 42._o there_o be_v no_o passage_n but_o this_o and_o that_o one_o before_o cite_v that_o in_o my_o read_n over_o that_o book_n i_o observe_v to_o be_v so_o extreme_a bad_a as_o folk_n ordinary_o talk_v but_o this_o i_o note_v for_o a_o devilish_a doctrine_n see_v it_o be_v offer_v thus_o indefinite_o for_o it_o be_v direct_o contrary_a to_o all_o the_o holy_a martyr_n belief_n and_o practice_n and_o the_o express_a institution_n of_o our_o lord_n that_o he_o that_o confess_v he_o before_o man_n he_o will_v acknowledge_v and_o he_o that_o deni_v he_o he_o will_v deny_v before_o his_o heavenly_a father_n yet_o if_o any_o will_v be_v so_o kind_a to_o the_o old_a gentleman_n as_o i_o have_v be_v before_o to_o produce_v some_o passage_n otherwhere_o that_o may_v confine_v h●s_a meaning_n here_o to_o such_o compliance_n of_o the_o tongue_n and_o knee_n only_o as_o be_v require_v in_o the_o imposition_n of_o uniformity_n and_o no_o other_o but_o such_o then_o shall_v the_o old_a leviathan_n and_o the_o young_a leviathan_n agree_v very_o thorough_o in_o their_o opinion_n and_o why_o the_o young_a one_o shall_v fall_v upon_o his_o sire_n so_o foul_o as_o he_o have_v do_v who_o above_o all_o man_n be_v alone_o of_o his_o side_n he_o shall_v have_v rather_o endeavour_v to_o excuse_v unless_o out_o of_o show_v only_o and_o for_o a_o colour_n or_o out_o of_o invenility_n and_o vanity_n he_o shall_v for_o i_o have_v the_o tripos_n or_o be_v the_o eight_o man_n who_o can_v give_v i_o a_o good_a reason_n i_o perceive_v indeed_o that_o two_o point_n and_o both_o of_o which_o i_o have_v have_v long_o in_o my_o thought_n be_v harl_v together_o through_o the_o skein_n of_o this_o prefacers_n discourse_n that_o be_v the_o magistrate_n authority_n in_o religion_n and_o the_o obligation_n of_o human_a law_n it_o will_v be_v expedient_a for_o i_o to_o dispatch_v the_o one_o quite_o out_o of_o my_o hand_n be_v already_o do_v in_o another_o book_n to_o be_v at_o liberty_n to_o attend_v the_o other_o present_o altogether_o by_o what_o have_v be_v then_o lay_v down_o it_o may_v appear_v that_o the_o right_a and_o relation_n of_o a_o subject_a to_o his_o sovereign_n may_v be_v hold_v good_a when_o yet_o there_o be_v it_o may_v be_v some_o of_o his_o law_n not_o obey_v some_o law_n there_o be_v which_o a_o man_n must_v rather_o suffer_v or_o die_v then_o obey_v as_o the_o roman_a emperor_n command_v sacrifice_n to_o their_o god_n some_o we_o be_v to_o obey_v out_o of_o conscience_n such_o be_v all_o the_o wholesome_a law_n of_o a_o man_n country_n some_o there_o be_v that_o we_o obey_v out_o of_o what_o be_v that_o rule_n according_a to_o which_o the_o law_n of_o man_n be_v to_o be_v measure_v that_o we_o may_v
sedition_n in_o the_o late_a war_n and_o aught_o to_o be_v destroy_v the_o contest_v now_o say_v the_o prefacer_n as_o it_o relate_v to_o the_o real_a concernment_n of_o the_o nation_n be_v which_o at_o the_o same_o time_n alienate_v from_o the_o government_n and_o list_v into_o a_o combination_n against_o it_o how_o miserable_o this_o tart_a gentleman_n be_v out_o he_o will_v see_v himself_o in_o good_a time_n for_o we_o do_v all_o own_o loyalty_n when_o we_o do_v not_o yet_o obey_v their_o imposition_n but_o who_o have_v give_v licence_n to_o the_o man_n if_o himself_o be_v not_o the_o licenser_n to_o make_v any_o such_o saucy_a reflection_n in_o print_n as_o this_o upon_o that_o which_o his_o majesty_n with_o great_a wisdom_n have_v think_v fit_a to_o be_v do_v let_v he_o produce_v any_o of_o those_o who_o come_v in_o and_o accept_v the_o king_n grace_n that_o can_v be_v accuse_v of_o the_o least_o disaffection_n to_o and_o much_o less_o of_o combination_n against_o his_o government_n if_o he_o mean_v the_o episcopal_a church_n why_o be_v not_o these_o man_n as_o sagacious_a to_o combine_v we_o with_o they_o will_v he_o have_v the_o king_n no_o wise_a for_o his_o own_o on_o it_o hitherto_o for_o it_o be_v true_a there_o be_v something_o moreover_o that_o some_o of_o we_o will_v have_v but_o not_o of_o the_o king_n to_o let_v in_o any_o into_o the_o public_a his_o conscience_n then_o can_v he_o command_v he_o to_o sin_n then_o can_v he_o command_v what_o god_n have_v forbid_v then_o must_v man_n be_v above_o god_n the_o earth_n itself_o methinks_v can_v as_o soon_o be_v move_v as_o this_o foundation_n sect_n 12._o what_o shall_v we_o say_v then_o to_o these_o thing_n shall_v we_o complain_v that_o god_n almighty_n have_v put_v in_o man_n such_o a_o sturdy_a thing_n as_o conscience_n be_v which_o make_v he_o so_o often_o to_o become_v refractory_a to_o the_o commandment_n of_o his_o superior_n whensoever_o they_o do_v but_o require_v any_o thing_n against_o it_o no_o there_o be_v good_a reason_n god_n shall_v maintain_v to_o himself_o a_o authority_n above_o any_o mortal_a in_o the_o earth_n and_o that_o his_o name_n shall_v be_v glorify_v by_o his_o servant_n in_o the_o confession_n of_o it_o to_o be_v world_n or_o shall_v we_o complain_v of_o government_n desire_v to_o be_v rid_v of_o it_o as_o that_o which_o be_v so_o uneasy_a to_o our_o conscience_n that_o we_o can_v hardly_o serve_v god_n but_o we_o must_v disobey_v man_n and_o incur_v danger_n about_o it_o shall_v we_o rise_v up_o therefore_o in_o rebellion_n and_o acquit_v ourselves_o god_n forbid_v it_o be_v the_o will_n of_o heaven_n who_o have_v put_v into_o the_o heart_n of_o man_n a_o awe_n to_o his_o invisible_a be_v as_o our_o supreme_a lord_n to_o constitute_v the_o magistrate_n to_o bear_v his_o image_n and_o representation_n in_o the_o earth_n that_o in_o his_o person_n himself_o may_v be_v honour_v so_o long_o as_o we_o obey_v only_o with_o subordination_n to_o his_o will_n and_o the_o common_a good_a which_o be_v the_o end_n of_o his_o appointment_n if_o neither_o of_o these_o what_o then_o shall_v we_o be_v even_o content_a in_o this_o state_n of_o corruption_n and_o imperfection_n when_o the_o fall_n have_v bring_v so_o much_o difficulty_n upon_o all_o thing_n else_o as_o well_o as_o government_n to_o offer_v the_o best_a composition_n we_o can_v between_o the_o duty_n the_o magistrate_n owe_v to_o god_n and_o his_o people_n and_o the_o obedience_n the_o people_n owe_v to_o he_o and_o their_o conscience_n so_o that_o we_o may_v not_o put_v off_o any_o truth_n which_o stand_v irrefragable_a by_o the_o plead_a inconvenience_n when_o these_o inconvenience_n be_v by_o prudence_n to_o be_v prevent_v and_o if_o we_o do_v it_o but_o as_o well_o as_o we_o can_v that_o be_v as_o the_o state_n of_o man_n corruption_n or_o human_a frailty_n and_o infirmity_n will_v allow_v it_o suffice_v and_o the_o rest_n must_v be_v bear_v shall_v we_o agree_v upon_o this_o if_o we_o shall_v i_o have_v but_o a_o little_a more_o to_o say_v hereunto_o and_o i_o have_v do_v the_o office_n of_o the_o magistrate_n be_v to_o make_v the_o law_n and_o to_o see_v to_o the_o execution_n in_o all_o thing_n as_o well_o religious_a i_o have_v say_v as_o civil_a which_o be_v for_o the_o people_n good_a he_o may_v pass_v and_o execute_v any_o law_n so_o long_o as_o they_o be_v agreeable_a to_o the_o word_n of_o god_n and_o man_n conscience_n but_o he_o can_v command_v or_o enforce_v nothing_o which_o be_v against_o man_n conscience_n this_o be_v deliver_v already_o those_o thing_n now_o which_o be_v against_o man_n conscience_n let_v we_o consider_v in_o the_o last_o place_n which_o have_v be_v intimate_v also_o from_o one_o or_o two_o occasion_n before_o be_v either_o such_o as_o be_v against_o the_o universality_n or_o against_o so_o many_o of_o their_o conscience_n as_o the_o magistrate_n be_v to_o take_v cognizance_n of_o they_o or_o against_o the_o conscience_n only_o of_o so_o few_o as_o be_v not_o meet_v for_o he_o to_o take_v cognizance_n of_o they_o in_o the_o first_o case_n he_o be_v not_o to_o pass_v such_o a_o law_n i_o count_v upon_o any_o term_n if_o he_o do_v he_o sin_n against_o his_o charge_n and_o he_o have_v no_o authority_n to_o sin_n himself_o or_o cause_v any_o to_o sin_n in_o the_o second_o we_o may_v suppose_v that_o the_o conscience_n of_o a_o few_o particular_a person_n only_o be_v not_o sufficient_a to_o put_v a_o obstruction_n to_o any_o law_n real_o good_a for_o the_o community_n but_o it_o be_v to_o be_v account_v for_o the_o universality_n sake_n to_o be_v according_a to_o the_o subject_n conscience_n and_o not_o against_o they_o but_o when_o i_o have_v say_v thus_o as_o to_o the_o pass_v of_o the_o law_n i_o must_v say_v also_o that_o in_o the_o execution_n of_o such_o law_n i_o hold_v that_o even_o those_o particular_a person_n ought_v to_o be_v regard_v in_o order_n hereunto_o there_o be_v some_o that_o pretend_v conscience_n of_o a_o thing_n when_o indeed_o they_o make_v none_o of_o it_o understand_v not_o this_o so_o as_o if_o all_o that_o can_v not_o give_v a_o reason_n sufficient_a for_o what_o they_o hold_v do_v not_o make_v a_o conscience_n of_o it_o which_o have_v cause_n a_o great_a prejudice_n and_o false_a reckon_n of_o this_o business_n but_o when_o they_o believe_v not_o the_o thing_n real_o in_o their_o heart_n to_o be_v so_o as_o they_o pretend_v when_o man_n pretend_v they_o make_v a_o conscience_n of_o a_o thing_n and_o indeed_o do_v not_o i_o will_v have_v the_o magistrate_n above_o all_o man_n to_o execute_v the_o law_n upon_o such_o suppose_v they_o judge_v that_o law_n righteous_a and_o make_v they_o a_o example_n if_o you_o will_v say_v but_o how_o shall_v a_o magistrate_n know_v this_o see_v no_o man_n can_v judge_n of_o another_o heart_n i_o acknowledge_v ready_o this_o be_v a_o difficulty_n and_o the_o chief_a thing_n which_o require_v the_o magistrate_n prudence_n and_o faithfulness_n yet_o this_o i_o say_v that_o every_o man_n for_o all_o that_o be_v judge_n of_o his_o own_o act_n and_o the_o punish_n of_o forbear_v a_o person_n be_v what_o the_o magistrate_n do_v he_o must_v go_v and_o can_v but_o go_v according_a to_o his_o judgement_n he_o use_v the_o medium_n as_o a_o wise_a man_n do_v and_o lawful_o may_v take_v his_o conjecture_n the_o tree_n be_v know_v by_o his_o fruit_n and_o it_o be_v not_o necessary_a it_o shall_v be_v certain_a but_o only_o that_o it_o be_v certain_a he_o so_o judge_n and_o if_o he_o be_v convince_v in_o his_o soul_n and_o indeed_o judge_v the_o man_n profession_n only_o to_o be_v pretence_n it_o be_v his_o own_o judgement_n and_o nothing_o else_o can_v determine_v he_o although_o where_o the_o person_n be_v serious_a in_o what_o he_o declare_v and_o not_o under_o any_o public_a note_n of_o perfidiousness_n the_o rule_n of_o charity_n which_o hope_v all_o thing_n and_o believe_v all_o thing_n and_o think_v no_o evil_a must_v incline_v he_o to_o the_o best_a construction_n when_o man_n do_v true_o make_v the_o conscience_n they_o pretend_v let_v the_o justice_n take_v heed_n and_o see_v that_o he_o likewise_o reverence_v conscience_n no_o less_o than_o they_o do_v if_o the_o penalty_n be_v such_o only_a as_o the_o man_n be_v like_a to_o endure_v it_o without_o scruple_n rather_o than_o do_v that_o which_o be_v against_o his_o conscience_n the_o magistrate_n may_v be_v the_o bold_a in_o execute_v that_o law_n upon_o he_o but_o if_o it_o be_v such_o as_o he_o be_v like_a rather_o to_o do_v the_o thing_n against_o his_o conscience_n than_o suffer_v it_o i_o will_v not_o be_v that_o magistrate_n who_o shall_v put_v such_o a_o law_n in_o execution_n upon_o any_o in_o the_o mean_a time_n every_o particular_a man_n for_o himself_o be_v to_o look_v to_o his_o conscience_n as_o his_o judge_n in_o the_o business_n of_o his_o soul_n and_o account_v that_o authority_n void_a to_o he_o whatsoever_o it_o be_v that_o command_v any_o thing_n contrary_a to_o what_o that_o dictate_v and_o the_o supreme_a authority_n be_v to_o conceive_v that_o those_o that_o act_n under_o it_o will_v use_v prudence_n upon_o that_o account_n which_o prudence_n i_o fear_v i_o real_o in_o this_o case_n can_v hardly_o be_v christian_a but_o it_o must_v come_v to_o this_o that_o either_o they_o must_v total_o forbear_v and_o not_o so_o much_o as_o threaten_v prosecution_n of_o the_o law_n upon_o such_o a_o person_n or_o else_o persuade_v he_o first_o to_o resolution_n to_o bear_v the_o penalty_n and_o not_o do_v the_o thing_n against_o his_o conscience_n they_o must_v in_o effect_n say_v thus_o to_o the_o man_n if_o this_o thing_n be_v against_o your_o conscience_n we_o advise_v you_o not_o
