be_v not_o the_o king_n law._n for_o take_v one_o example_n for_o many_o every_o leet_n or_o view_n of_o frank_n pledge_v hold_v by_o a_o subject_a be_v keep_v in_o the_o lord_n name_v and_o yet_o it_o be_v the_o king_n court_n and_o all_o the_o proceed_n therein_o be_v direct_v by_o the_o king_n law_n and_o many_o subject_n in_o england_n have_v and_o hold_v court_n of_o record_n and_o other_o court_n and_o all_o their_o proceed_n be_v according_a to_o the_o king_n law_n and_o custom_n of_o the_o realm_n but_o there_o be_v a_o material_a objection_n or_o two_o yet_o to_o be_v answer_v 1._o it_o be_v object_v that_o 2_o jac._n the_o judge_n declare_v in_o the_o star-chamber_n that_o the_o deprivation_n of_o nonconformist_n be_v 100_o lawful_a because_o the_o king_n have_v supreme_a ecclesiastical_a power_n which_o he_o have_v delegated_a to_o the_o commissioner_n whereby_o they_o have_v power_n of_o deprivation_n by_o the_o canon_n law_n of_o this_o realm_n and_o the_o statute_n of_o 1_o eliz._n do_v not_o confer_v any_o new_a power_n but_o explain_v and_o declare_v the_o ancient_a power_n and_o therefore_o they_o hold_v it_o clear_a that_o the_o king_n without_o a_o parliament_n may_v make_v order_n and_o constitution_n for_o the_o government_n of_o the_o clergy_n and_o may_v deprive_v they_o if_o they_o obey_v not_o to_o which_o i_o answer_v 1._o our_o question_n be_v not_o whether_o the_o king_n without_o a_o parliament_n may_v not_o require_v the_o observation_n of_o canon_n pass_v the_o convocation_n so_o as_o to_o deprive_v the_o obstinate_a by_o virtue_n of_o his_o supreme_a power_n in_o ecclesiastical_a matter_n but_o whether_o he_o may_v appoint_v a_o commission_n with_o power_n to_o deprive_v against_o a_o act_n of_o parliament_n which_o have_v take_v away_o the_o legal_a power_n of_o any_o such_o commission_n 2._o in_o matter_n of_o this_o nature_n it_o be_v safe_a trust_v the_o supreme_a judicature_n of_o the_o nation_n in_o parliament_n than_o the_o extrajudicial_a opinion_n of_o the_o judge_n and_o in_o this_o case_n the_o parliament_n have_v declare_v itself_o another_o way_n as_o appear_v by_o the_o canon_n 1640._o which_o be_v not_o only_o condemn_v in_o parliament_n afterward_o which_o then_o may_v be_v impute_v to_o the_o heat_n of_o the_o time_n but_o in_o the_o most_o loyal_a parliament_n after_o the_o king_n return_n particular_a care_n be_v take_v that_o neither_o the_o canon_n of_o 1640._o shall_v be_v confirm_v nor_o any_o other_o ecclesiastical_a law_n or_o canon_n not_o former_o confirm_v allow_v or_o enact_v by_o parliament_n or_o by_o the_o establish_v law_n of_o the_o land_n as_o they_o stand_v in_o the_o year_n of_o the_o lord_n 1639._o which_o imply_v that_o the_o sense_n of_o the_o parliament_n than_o be_v that_o we_o be_v not_o to_o own_o any_o canon_n but_o such_o as_o be_v confirm_v allow_v or_o enact_v by_o parliament_n or_o by_o the_o establish_v law_n of_o the_o land_n before_o 1639._o and_o therefore_o no_o new_a injunction_n without_o a_o parliament_n or_o convocation_n can_v make_v the_o clergy_n liable_a to_o a_o legal_a deprivation_n no_o not_o that_o which_o the_o defender_n be_v so_o please_v with_o the_o thought_n of_o viz._n to_o give_v their_o assent_n and_o consent_v to_o the_o king_n declaration_n on_o pain_n of_o deprivation_n 14._o 3._o the_o temporalty_n of_o the_o clergy_n especial_o the_o bishop_n be_v secure_v by_o several_a act_n of_o parliament_n without_o a_o trial_n at_o law._n which_o because_o i_o see_v none_o of_o our_o his_o freehold_n be_v go_v this_o be_v touch_v clergymen_n freehold_n to_o purpose_n and_o no_o doubt_n out_o of_o pure_a zeal_n to_o the_o church_n of_o england_n but_o see_v the_o equity_n and_o impartiality_n of_o this_o man_n he_o have_v undertake_v before_o to_o give_v public_a assurance_n of_o abby-land_n to_o the_o present_a possessor_n and_o for_o what_o reason_n 184._o because_o the_o pope_n grant_v a_o dispensation_n with_o a_o non_fw-la obstante_fw-la to_o the_o canon_n law_n and_o yet_o in_o this_o book_n he_o prove_v that_o a_o non_fw-la obstante_fw-la be_v no_o way_n bind_v to_o the_o supreme_a power_n so_o that_o no_o man_n can_v more_o effectual_o overthrow_v his_o own_o assurance_n than_o he_o have_v do_v himself_o for_o say_v he_o present_a sovereign_n whether_o king_n or_o pope_n can_v 298._o bind_v their_o successor_n and_o again_o act_n of_o grace_n and_o favour_n be_v alterable_a and_o suspendible_a at_o the_o pleasure_n of_o the_o succeed_v sovereign_n why_o then_o shall_v any_o be_v so_o weak_a as_o to_o think_v the_o plenitude_n of_o the_o pope_n power_n as_o to_o abby-land_n can_v be_v bind_v up_o by_o the_o act_n of_o any_o former_a pope_n i_o confess_v the_o compare_v these_o two_o book_n together_o have_v extreme_o lessen_v his_o assurance_n of_o abbey_n land_n with_o i_o and_o his_o answer_n to_o the_o power_n of_o revocation_n be_v so_o 200._o weak_a that_o they_o come_v at_o last_o to_o no_o more_o than_o this_o it_o be_v a_o thing_n which_o can_v well_o be_v do_v at_o present_a therefore_o there_o be_v no_o fear_n it_o ever_o shall_v be_v do_v here_o be_v some_o security_n at_o least_o till_o it_o can_v be_v do_v but_o as_o to_o the_o possession_n of_o the_o ecclesiastical_a person_n of_o the_o church_n of_o england_n he_o endeavour_v to_o prove_v that_o they_o can_v have_v no_o security_n at_o all_o of_o their_o present_a possession_n notwithstanding_o any_o promise_n or_o a_o legal_a title_n for_o if_o as_o he_o say_v the_o king_n by_o his_o paramount_n jurisdiction_n can_v make_v any_o exception_n null_n and_o 298._o so_o void_a a_o solemn_a oath_n not_o to_o accept_v a_o dispensation_n from_o that_o oath_n why_o shall_v he_o not_o as_o well_o make_v void_a any_o promise_n of_o his_o own_o when_o it_o hinder_v as_o he_o think_v a_o great_a good_a especial_o if_o the_o prerogative_n can_v be_v bind_v but_o then_o as_o to_o a_o legal_a title_n that_o be_v the_o vain_a thing_n imaginable_a as_o to_o such_o conditional_a freehold_n which_o clergyman_n have_v for_o if_o the_o commissioner_n deprive_v they_o by_o their_o power_n ab_fw-la officio_fw-la &_o beneficio_fw-la their_o attendant_a frehold_n say_v he_o be_v go_v without_o any_o course_n of_o law._n and_o the_o defender_n 24_o say_v the_o commissioner_n may_v deprive_v if_o clergyman_n shall_v not_o assent_v and_o consent_n to_o all_o contain_v in_o the_o king_n declaration_n if_o he_o require_v it_o but_o it_o be_v to_o be_v hope_v that_o prince_n will_v not_o take_v the_o measure_n of_o justice_n and_o wisdom_n and_o honour_n from_o such_o man_n we_o will_v therefore_o set_v aside_o the_o omnipotent_a engine_n of_o a_o non_fw-la obstante_fw-la which_o do_v not_o batter_v so_o much_o as_o it_o undermine_v and_o consider_v the_o legal_a security_n of_o these_o conditional_a freehold_n i._o all_o freehold_n be_v in_o some_o sense_n conditional_a or_o else_o they_o can_v never_o be_v forfeit_v which_o show_v that_o there_o be_v none_o absolute_a with_o respect_n to_o the_o law._n and_o as_o to_o their_o original_a especial_o in_o the_o time_n of_o h._n 3._o when_o the_o pope_n usurpation_n here_o be_v at_o so_o great_a a_o height_n that_o the_o king_n upon_o writ_n of_o enquiry_n send_v into_o the_o several_a power_n be_v not_o express_v in_o the_o act_n of_o parliament_n but_o it_o be_v vest_v in_o the_o king_n by_o the_o act_n he_o may_v appoint_v one_o or_o more_o commissioner_n to_o do_v it_o in_o his_o name_n but_o the_o case_n be_v very_o different_a where_o that_o very_a power_n of_o delegation_n be_v take_v away_o by_o act_n of_o parliament_n for_o that_o be_v the_o present_a case_n to_o make_v this_o clear_a we_o must_v consider_v the_o word_n of_o this_o act_n and_o compare_v they_o with_o 1_o eliz._n 1._o the_o 17_o car._n 1._o 12._o and_o the_o present_a commission_n the_o word_n 26_o h._n 8._o 1._o be_v the_o same_o in_o effect_n with_o those_o 1_o eliz._n 1._o but_o with_o this_o observable_a difference_n that_o whereas_o the_o statute_n of_o h._n 8._o give_v the_o king_n his_o heir_n and_o successor_n full_a power_n and_o authority_n from_o time_n to_o time_n to_o visit_v etc._n etc._n that_o of_o 1_o eliz._n 1._o unite_v the_o jurisdiction_n to_o the_o imperial_a crown_n of_o this_o realm_n but_o than_o it_o do_v not_o proceed_v as_o the_o other_o do_v to_o give_v full_a power_n and_o authority_n to_o she_o her_o heir_n and_o successor_n to_o visit_v etc._n etc._n but_o the_o word_n be_v and_o that_o your_o highness_n your_o heir_n and_o successor_n king_n or_o queen_n of_o this_o realm_n shall_v have_v full_a power_n and_o authority_n by_o this_o act_n by_o letter_n patent_n under_o the_o great_a seal_n of_o england_n to_o assign_v name_n and_o authorize_v when_o and_o as_o often_o as_o your_o highness_n your_o heir_n and_o successor_n shall_v think_v meet_a to_o exercise_n use_v occupy_n and_o execute_v under_o your_o highness_n your_o heir_n and_o successor_n all_o manner_n of_o jurisdiction_n privilege_n and_o preeminence_n in_o any_o wise_a touch_v or_o concern_v any_o spiritual_a or_o ecclesiastical_a jurisdiction_n etc._n etc._n so_o that_o the_o administration_n of_o this_o extraordinary_a jurisdiction_n be_v by_o this_o act_n limit_v to_o such_o who_o be_v nominate_v and_o appoint_v by_o the_o letter_n patent_n the_o fountain_n of_o all_o jurisdiction_n be_v acknowledge_v to_o be_v in_o the_o imperial_a crown_n of_o this_o realm_n but_o the_o administration_n be_v twofold_a ordinary_a in_o the_o archbishop_n bishop_n and_o ecclesiastical_a court_n and_o to_o secure_v their_o dependence_n on_o the_o crown_n the_o oath_n of_o supremacy_n be_v require_v by_o this_o act_n to_o be_v take_v by_o every_o archbishop_n bishop_n and_o all_o ecclesiastical_a person_n and_o officer_n but_o beside_o this_o it_o be_v then_o think_v fit_a that_o there_o shall_v be_v a_o extraordinary_a administration_n of_o it_o which_o be_v limit_v by_o this_o act_n to_o such_o as_o shall_v be_v nominate_v and_o appoint_v in_o letter_n patent_n etc._n etc._n and_o no_o other_o reason_n can_v be_v give_v of_o the_o change_n from_o what_o it_o be_v in_o the_o time_n of_o henry_n the_o eight_o for_o it_o be_v not_o now_o place_v absolute_o as_o then_o in_o the_o queen_n her_o heir_n and_o successor_n but_o the_o jurisdiction_n be_v annex_v to_o the_o crown_n and_o the_o extraordinary_a administration_n to_o be_v by_o commission_n under_o the_o broad_a seal_n now_o since_o this_o power_n of_o nominate_a commissioner_n for_o extraordinary_a jurisdiction_n be_v take_v away_o by_o act_n of_o parliament_n the_o only_a question_n be_v whether_o notwithstanding_o the_o right_n of_o jurisdiction_n be_v still_o in_o the_o crown_n a_o new_a commission_n may_v not_o be_v grant_v for_o extraordinary_a jurisdiction_n there_o have_v be_v no_o question_n in_o this_o case_n if_o the_o administration_n of_o extraordinary_a jurisdiction_n have_v not_o be_v settle_v 1_o eliz._n 1._o to_o be_v by_o commission_n and_o that_o very_a power_n of_o grant_v such_o a_o commission_n have_v not_o be_v take_v away_o by_o act_n of_o parliament_n but_o as_o the_o matter_n now_o stand_v the_o only_a pretence_n leave_v for_o it_o be_v that_o the_o same_o act_n which_o confirm_v the_o repeal_n have_v a_o salvo_n for_o the_o king_n supremay_n in_o these_o word_n provide_v always_o that_o this_o act_n shall_v not_o extend_v or_o be_v construe_v to_o extend_v to_o abridge_v or_o diminish_v the_o king_n supremacy_n in_o ecclesiastical_a matter_n or_o affair_n if_o these_o word_n be_v take_v strict_o with_o respect_n to_o the_o same_o matter_n they_o make_v the_o act_n inconsistent_a with_o itself_o for_o then_o the_o meaning_n will_v be_v the_o king_n supremacy_n shall_v not_o extend_v to_o the_o set_n up_o such_o a_o court_n always_o provide_v that_o his_o supremacy_n notwithstanding_o this_o act_n may_v extend_v to_o the_o set_n up_o such_o another_o court._n be_v it_o consistent_a with_o the_o wisdom_n of_o a_o parliament_n to_o make_v such_o delusory_a act_n therefore_o we_o must_v understand_v the_o king_n supremacy_n in_o other_o matter_n and_o there_o be_v this_o reason_n for_o it_o all_z the_o act_n of_o parliament_n touch_v the_o supremacy_n in_o henry_n the_o eighth_n time_n be_v repeal_v by_o queen_n mary_n and_o the_o restore_a the_o supremacy_n to_o the_o crown_n be_v by_o the_o same_o act_n which_o set_v up_o the_o high_a commission_n and_o therefore_o when_o part_n of_o that_o act_n be_v repeal_v and_o that_o repeal_v confirm_v it_o be_v fit_v to_o add_v a_o clause_n that_o there_o be_v no_o intention_n to_o abridge_v or_o diminish_v the_o supremacy_n settle_v by_o law_n especial_o since_o by_o that_o act_n the_o ordinary_a jurisdiction_n of_o the_o bishop_n in_o their_o court_n be_v revive_v and_o it_o be_v very_o well_o know_v what_o clamour_n have_v be_v make_v as_o though_o the_o bishop_n court_n be_v hold_v in_o their_o own_o name_n be_v inconsistent_a with_o the_o king_n supremacy_n and_o although_o the_o judge_n have_v declare_v july_n the_o first_o 1637._o that_o there_o be_v no_o necessity_n that_o process_n ecclesiastical_a shall_v be_v in_o the_o king_n name_n and_o the_o king_n august_n the_o eighteen_o in_o 13_o car._n 1._o publish_v a_o proclamation_n to_o that_o purpose_n yet_o all_o this_o do_v not_o satisfy_v some_o but_o the_o bishop_n be_v still_o think_v by_o they_o in_o their_o ordinary_a jurisdiction_n to_o usurp_v upon_o the_o king_n supremacy_n and_o to_o abridge_v and_o diminish_v it_o therefore_o when_o this_o act_n pass_v to_o revive_v their_o jurisdiction_n it_o be_v no_o more_o than_o reasonable_a to_o add_v such_o a_o clause_n to_o prevent_v misconstruction_n viz._n that_o this_o act_n nor_o any_o thing_n in_o it_o be_v construe_v to_o extend_v to_o abridge_v or_o diminish_v the_o king_n supremacy_n in_o ecclesiastical_a matter_n as_o the_o ordinary_a jurisdiction_n of_o the_o bishop_n have_v be_v think_v to_o do_v and_o the_o vindicator_n of_o the_o ecclesiastical_a commission_n can_v 19_o not_o forbear_v a_o marginal_a note_n to_o that_o purpose_n the_o court_n hold_v by_o his_o majesty_n ecclesiastical_a commissioner_n be_v more_o legal_a than_o the_o bishop_n court_n this_o be_v in_o the_o king_n name_n they_o in_o their_o own_o name_n only_o as_o though_o the_o new_a set_v up_o a_o court_n forbid_v by_o law_n do_v not_o make_v it_o illegal_a in_o who_o name_n soever_o it_o be_v and_o as_o though_o court_v express_o own_v and_o allow_v by_o law_n be_v illegal_a mere_o because_o the_o form_n of_o their_o proceed_n do_v not_o run_v in_o the_o king_n name_n but_o i_o desire_v he_o to_o take_v a_o answer_n from_o his_o own_o oracle_n the_o l._n ch._n j._n coke_n 39_o now_o albeit_o the_o proceed_n and_o process_n in_o the_o ecclesiastical_a court_n be_v in_o the_o name_n of_o the_o bishop_n etc._n etc._n it_o follow_v not_o therefore_o that_o either_o the_o court_n be_v not_o the_o king_n or_o the_o law_n whereby_o they_o proceed_v
