charity_n be_v within_o the_o statute_n for_o that_o by_o the_o will_n and_o act_n of_o parliament_n the_o executor_n of_o the_o founder_n and_o such_o trustee_n as_o they_o shall_v appoint_v after_o they_o be_v only_a trustee_n and_o not_o special_a visiter_n within_o the_o proviso_n of_o the_o statute_n and_o by_o reason_n of_o the_o great_a abuse_n commit_v by_o the_o appellant_n the_o commissioner_n be_v oblige_v to_o make_v such_o decree_n for_o the_o well_o government_n thereof_o that_o the_o will_n and_o intent_n of_o the_o donor_n be_v the_o widow_n shall_v be_v pay_v to_o set_v up_o in_o the_o chapel_n of_o the_o say_a college_n by_o the_o appellant_n for_o the_o quarterly_o payment_n and_o from_o time_n to_o time_n pay_v according_o and_o without_o such_o quarterly_o payment_n the_o widow_n must_v live_v miserable_o upon_o trust_n that_o it_o be_v the_o practice_n of_o commission_n of_o this_o nature_n when_o they_o change_v the_o trust_n to_o decree_v the_o payment_n to_o the_o new_a trustee_n for_o the_o poor_a and_o their_o acquittance_n be_v a_o good_a discharge_n that_o the_o appellant_n do_v turn_v out_o the_o say_a widow_n featley_n in_o a_o violent_a manner_n six_o month_n after_o dr._n pierce_n his_o death_n and_o the_o appellant_n do_v place_v another_o widow_n in_o her_o stead_n but_o do_v not_o pay_v she_o as_o pretend_v that_o the_o rent_n for_o the_o two_o acre_n be_v receive_v by_o the_o chaplain_n but_o dispose_v of_o by_o the_o appellant_n order_n which_o belong_v to_o the_o widow_n that_o the_o appellant_n be_v never_o due_o constitute_v a_o trustee_n therefore_o and_o for_o several_a grand_a miscarriage_n commit_v by_o he_o in_o the_o trust_n and_o that_o the_o charity_n be_v like_a to_o be_v destroy_v if_o he_o be_v continue_v the_o commissioner_n lay_v he_o aside_o and_o place_v other_o therein_o that_o deposition_n be_v take_v on_o both_o side_n and_o all_o the_o say_a matter_n prove_v on_o behalf_n of_o the_o charity_n this_o cause_n then_o come_v to_o be_v hear_v before_o the_o right_n honourable_a the_o lord_n keeper_n of_o the_o great_a seal_n of_o england_n 1693._o 24_o nou._n 1693._o upon_o a_o full_a hear_v of_o council_n and_o read_v the_o proof_n on_o both_o side_n his_o lordship_n confirm_v the_o say_v commissioner_n decree_n which_o decree_n of_o the_o say_a lord_n keeper_n be_v sign_v and_o enrol_v according_o the_o appellant_n appeal_v against_o the_o say_a decree_n to_o this_o honourable_a house_n the_o last_o session_n of_o parliament_n and_o the_o respondent_fw-la north_n put_v in_o his_o answer_n thereto_o but_o pend_v that_o appeal_v the_o appellant_n do_v prevail_v with_o some_o few_o of_o the_o trustee_n to_o have_v another_o meeting_n and_o in_o order_n thereunto_o the_o appellant_n illegal_o procure_v another_o commission_n to_o issue_n and_o thereupon_o the_o appellant_n by_o his_o subtle_a insinuation_n persuade_v some_o few_o of_o the_o commissioner_n to_o comply_v with_o he_o to_o sign_n a_o new_a decree_n differ_v from_o the_o former_a in_o many_o particular_n whereby_o the_o former_a decree_n make_v by_o all_o the_o commissioner_n and_o upon_o a_o full_a hear_v and_o due_a proof_n confirm_v by_o the_o lord_n keeper_n and_o sign_v and_o enrol_v be_v make_v null_a and_o void_a and_o then_o the_o appellant_n withdraw_v that_o appeal_n to_o which_o second_o decree_v the_o widow_n do_v never_o consent_n but_o so_o soon_o as_o they_o understand_v the_o matter_n they_o prefer_v their_o petition_n to_o the_o lord_n keeper_n against_o the_o say_v second_o decree_n and_o soon_o after_o put_v in_o exception_n thereto_o and_o among_o other_o matter_n insist_v as_o now_o they_o do_v that_o the_o say_v second_o decree_n of_o the_o commissioner_n be_v illegal_a and_o unwarrantable_a to_o which_o exception_n the_o appellant_n put_v in_o his_o answer_n and_o the_o say_a cause_n come_v on_o again_o to_o be_v hear_v 1695._o a_o second_o hear_v the_o 28_o oct._n 1695._o upon_o the_o exception_n to_o the_o say_v second_o decree_n of_o the_o commissioner_n and_o upon_o full_a hear_v of_o council_n on_o both_o side_n the_o lord_n keeper_n allow_v the_o exception_n and_o reverse_v the_o say_v second_o decree_n of_o the_o commissioner_n as_o illegal_a and_o unwarrantable_a therefore_o the_o say_a mr._n warner_n have_v bring_v this_o appeal_n but_o the_o poor_a widow_n hope_v your_o lordship_n will_v see_v no_o cause_n to_o reverse_v change_n or_o alter_v the_o say_v first_o decree_v make_v by_o the_o commissioner_n or_o the_o order_n make_v by_o the_o lord_n keeper_n on_o the_o argue_n of_o the_o exception_n thereto_o and_o humble_o pray_v your_o lordship_n will_v not_o suffer_v they_o to_o be_v surprise_v by_o the_o say_v second_o decree_n of_o the_o commissioner_n but_o will_v quiet_v they_o at_o last_o after_o so_o long_a a_o travel_n and_o great_a expense_n and_o utter_a ruin_n if_o your_o lordship_n shall_v not_o let_v the_o first_o decree_n of_o the_o commissioner_n stand_v and_o by_o your_o lordship_n be_v ratify_v and_o confirm_v and_o be_v observe_v and_o perform_v and_o the_o respondent_o dismiss_v with_o cost_v for_o this_o unjust_a and_o unreasonable_a trouble_n and_o vexation_n give_v they_o by_o the_o appellant_n
