same_o be_v special_o mention_v therein_o as_o may_v appear_v by_o diverse_a principle_n and_o rule_n of_o the_o law_n which_o be_v as_o general_a as_o be_v your_o say_v suppose_a maxim_n and_o yet_o neither_o the_o king_n nor_o the_o crown_n be_v by_o any_o of_o they_o bind_v as_o for_o example_n it_o be_v very_o plain_a that_o the_o rule_n of_o the_o tenant_n by_o the_o courtesy_n be_v general_a without_o any_o exception_n at_o al._n courtesy_n and_o yet_o the_o same_o bind_v not_o the_o crown_n neither_o do_v extend_v to_o geve_v any_o benefit_n to_o he_o that_o shall_v marry_v the_o queen_n of_o england_n as_o it_o be_v plain_o agree_v by_o all_o the_o lawyer_n of_o this_o realm_n when_o king_n philippe_n be_v marry_v unto_o queen_n marie_n although_o for_o the_o more_o surety_n and_o plain_a declaration_n of_o the_o intentes_fw-la of_o king_n philippe_n and_o queen_n marie_n and_o of_o all_o the_o state_n of_o this_o realm_n it_o be_v enact_v that_o king_n philip_n shall_v not_o a_o difference_n in_o your_o case_n between_o the_o king_n majesty_n and_o i.s._n a_o subject_n and_o also_o between_o land_n hold_v of_o a_o lord_n above_o and_o the_o crown_n hold_v of_o no_o earthly_a lord_n but_o
one_o rule_n as_o a_o general_a maxim_n be_v object_v against_o she_o and_o yet_o the_o same_o rule_n be_v so_o untrue_o set_v forth_o that_o i_o can_v not_o well_o agree_v that_o it_o be_v any_o rule_n or_o maxim_n of_o the_o common_a law_n of_o this_o realm_n of_o england_n your_o pretence_a maxim_n be_v whosoever_o be_v bear_v out_o of_o the_o realm_n of_o england_n and_o of_o father_n and_o mother_n not_o be_v under_o the_o obedience_n of_o the_o king_n of_o england_n can_v be_v capable_a to_o inherit_v any_o thing_n in_o england_n adversary_n which_o rule_n be_v nothing_o true_a but_o altogether_o false_a for_o every_o stranger_n and_o alien_n be_v able_a to_o purchase_v the_o inheritance_n of_o land_n within_o this_o realm_n as_o it_o may_v appear_v in_o 7._o &_o 9_o of_o king_n edward_n the_o four_o 10._o and_o also_o in_o 11._o &_o 14._o of_o king_n henry_n the_o four_o and_o although_o the_o same_o purchase_n be_v of_o some_o man_n account_v to_o be_v to_o the_o use_n of_o the_o king_n yet_o until_o such_o time_n as_o the_o king_n be_v entitle_v thereunto_o by_o matter_n of_o record_n the_o inheritance_n remain_v in_o the_o alien_n by_o the_o opinion_n of_o all_o man_n and_o so_o be_v a_o very_a alien_n capable_a of_o inheritance_n within_o this_o realm_n and_o then_o it_o must_v needs_o fall_v out_o very_o plain_o that_o your_o general_a maxim_n where_o upon_o you_o have_v talk_v and_o brag_v so_o much_o be_v now_o become_v no_o rule_n of_o the_o common_a law_n of_o this_o realm_n and_o if_o it_o be_v so_o then_o have_v you_o utter_v very_o many_o word_n to_o small_a purpose_n but_o yet_o let_v we_o see_v fartther_o whether_o there_o be_v any_o rule_n or_o maxim_n in_o the_o common_a law_n that_o may_v seem_v any_o thing_n like_o to_o that_o say_a queen_n and_o all_o her_o subject_n of_o scotland_n will_v stour_o affirm_v the_o same_o yet_o there_o be_v a_o great_a number_n of_o man_n in_o eng_n and_o both_o learned_a and_o other_o that_o be_v not_o of_o that_o opinion_n be_v lead_n and_o persuade_v thereto_o by_o diverse_a history_n register_n record_n and_o instrument_n of_o homage_n remain_v in_o the_o treasury_n of_o this_o realm_n wherein_o be_v metion_v that_o the_o king_n of_o scotland_n have_v acknowledge_v the_o king_n of_o england_n to_o be_v the_o superior_a lord_n over_o the_o realm_n of_o scotland_n and_o have_v do_v homage_n and_o fealty_n for_o the_o same_o which_o thing_n be_v true_a notwithstanding_o it_o be_v common_o deny_v by_o all_o scotsmen_n then_o by_o the_o law_n of_o this_o realm_n scotland_n must_v needs_o be_v account_v to_o be_v within_o the_o allegiance_n of_o england_n and_o although_o sin_v the_o time_n of_o king_n henry_n the_o six_o none_o of_o the_o king_n of_o scotlan_n have_v do_v the_o say_a service_n unto_o the_o king_n of_o england_n yet_o that_o be_v no_o reason_n in_o our_o law_n to_o say_v that_o therefore_o the_o realm_n of_o scotland_n at_o the_o time_n of_o the_o birth_n of_o the_o say_a lady_n marie_n queen_n of_o scotlan_n be_v in_o the_o thirty_o and_o four_o year_n of_o the_o reign_n of_o our_o late_a sovereign_n lord_n king_n henry_n the_o eight_o be_v out_o of_o the_o allegiance_n of_o the_o king_n of_o england_n service_n for_o the_o law_n of_o this_o realm_n be_v very_o plain_a that_o though_o the_o tenant_n do_v not_o his_o service_n unto_o the_o lord_n yet_o have_v not_o the_o lord_n thereby_o lose_v his_o seignory_n for_o the_o land_n still_o remain_v within_o his_o fee_n and_o seignory_n that_o notwithstanding_o but_o peradventure_o some_o will_n object_n and_o say_v that_o by_o that_o reason_n france_n shall_v likewise_o be_v say_v to_o be_v within_o the_o allegiance_n of_o england_n forasmuch_o as_o the_o possession_n of_o same_o realm_n by_o no_o mean_n can_v be_v say_v to_o be_v within_o their_o allegiance_n especial_o consider_v how_o that_o sin_n the_o time_n of_o usurpation_n the_o people_n of_o france_n have_v whole_o forsake_v their_o allegiance_n and_o subjection_n which_o they_o do_v owe_v unto_o the_o king_n of_o england_n and_o have_v give_v and_o submit_v themselves_o under_o the_o obedience_n and_o allegiance_n of_o the_o usurper_n but_o as_o for_o the_o realm_n of_o scotlan_n it_o be_v otherwise_o for_o
and_o intent_n of_o the_o say_a law_n now_o in_o case_n these_o two_o cause_n and_o consideration_n will_v not_o satisfy_v the_o adversary_n we_o will_v adjoin_v thereunto_o a_o three_o which_o he_o shall_v never_o by_o any_o good_a and_o honest_a shift_n avoid_v and_o that_o be_v the_o use_n and_o practice_v of_o the_o realm_n as_o well_o in_o the_o time_n forego_v the_o say_a statute_n as_o afterward_o we_o stand_v upon_o the_o interpretation_n of_o the_o common_a law_n recite_v and_o declare_v by_o the_o say_a statute_n and_o how_o shall_v we_o better_o understand_v legious_a what_o the_o law_n be_v therein_o then_o by_o the_o use_n and_o practice_v of_o the_o say_a law_n 1057._o for_o the_o best_a interpretation_n of_o the_o law_n be_v custom_n but_o the_o realm_n before_o the_o
