most_o express_o take_v away_o and_o that_o be_v assign_v as_o one_o reason_n and_o occasion_n of_o repeal_n the_o clause_n of_o 1_o eliz._n 1._o which_o establish_v the_o court_n but_o i_o can_v be_v satisfy_v that_o this_o be_v all_o that_o be_v intend_v by_o the_o act_n 17_o car._n 1._o c._n 11._o and_o that_o for_o these_o reason_n 1._o if_o no_o more_o have_v be_v intend_v than_o it_o have_v no_o such_o power_n but_o the_o act_n of_o repeal_n 17_o car._n 1._o c._n 12._o begin_v with_o the_o act_n of_o parliament_n whereas_o in_o the_o parliament_n hold_v in_o the_o first_o year_n of_o queen_n eliz._n there_o be_v a_o act_n make_v and_o establish_v etc._n etc._n in_o which_o act_n among_o other_o thing_n there_o be_v contain_v one_o clause_n branch_n article_n or_o sentence_n whereby_o it_o be_v enact_v to_o this_o effect_n etc._n etc._n then_o follow_v all_o the_o enactin_n clause_n and_o after_o it_o the_o abuse_n of_o the_o power_n by_o the_o letter_n patent_n be_v such_o power_n be_v in_o pursuance_n of_o the_o act._n but_o it_o be_v agree_v say_v he_o that_o before_o this_o act_n no_o man_n can_v be_v punish_v by_o fine_a and_o imprisonment_n by_o any_o to_o the_o tenor_n and_o effect_n of_o the_o letter_n patent_n other_o have_v think_v that_o the_o power_n to_o fine_a and_o imprison_v be_v within_o the_o letter_n patent_n the_o act_n of_o parliament_n do_v bear_v they_o out_o in_o pursue_v what_o be_v in_o the_o tenor_n of_o they_o but_o in_o my_o opinion_n this_o matter_n ought_v to_o be_v a_o little_a further_o clear_v and_o therefore_o we_o must_v distinguish_v between_o the_o original_a commission_n and_o the_o supplemental_a power_n add_v to_o enforce_v it_o the_o original_a commission_n extend_v no_o far_a than_o ecclesiastical_a jurisdiction_n as_o be_v plain_a from_o tho_o read_n of_o the_o statute_n and_o that_o of_o itself_o can_v go_v no_o further_o than_o ecclesiastical_a censure_n but_o because_o of_o the_o circumstance_n of_o that_o time_n when_o as_o the_o lord_n hobart_n in_o a_o m._n s._n discourse_n of_o the_o high_a commission_n observe_v the_o person_n cotton_n most_o concern_v do_v slight_a the_o ecclesiastical_a censure_n therefore_o it_o be_v think_v necessary_a in_o the_o letter_n patent_n to_o grant_v they_o a_o new_a commission_n to_o enforce_v the_o former_a and_o that_o extend_v to_o fine_a and_o imprisonment_n for_o in_o the_o high_a commission_n for_o the_o province_n of_o york_n which_o be_v preserve_v distinct_a power_n be_v grant_v which_o be_v not_o in_o the_o act._n
