aforesaid_a oath_n stat._n sect._n 4._o they_o which_o be_v in_o seminary_n shall_v after_o proclamation_n return_v and_o take_v the_o oath_n if_o any_o of_o her_o majesty_n subject_n not_o be_v a_o jesuit_n seminary_n priest_n or_o other_o such_o priest_n deacon_n or_o religious_a or_o ecclesiastical_a person_n as_o be_v before_o mention_v now_o be_v or_o which_o hereafter_o shall_v be_v of_o or_o bring_v up_o in_o any_o college_n of_o jesuit_n or_o seminary_n already_o erect_v or_o ordain_v or_o hereafter_o to_o be_v erect_v or_o ordain_v in_o the_o part_n beyond_o the_o sea_n or_o out_o here_o limit_v first_o go_v into_o ireland_n and_o then_o come_v into_o england_n and_o within_o two_o day_n submit_v himself_o and_o take_v the_o oath_n of_o supremacy_n in_o this_o case_n recusant_n the_o want_n of_o due_a consideration_n of_o this_o statute_n in_o each_o of_o these_o part_n of_o it_o have_v occasion_v some_o mistake_n in_o those_o who_o have_v handle_v it_o and_o wingate_n tit_n crown_n numb_a 78._o restrain_v both_o part_n of_o it_o as_o well_o relate_v to_o those_o that_o have_v no_o certain_a place_n of_o abode_n as_o those_o who_o place_n of_o abode_n be_v certain_a to_o recusant_n convict_v and_o make_v no_o mention_n that_o this_o late_a sort_n must_v be_v in_o england_n at_o the_o time_n of_o their_o conviction_n and_o in_o the_o late_a addition_n to_o dalton_n cap._n 81._o tit_n recusant_n sect._n 14._o it_o be_v not_o only_o say_v that_o both_o sort_n must_v be_v convict_v but_o that_o they_o must_v be_v in_o england_n at_o the_o time_n of_o their_o conviction_n which_o two_o thing_n be_v only_o requisite_a in_o such_o who_o have_v a_o certain_a place_n of_o abode_n and_o not_o in_o the_o other_o sort_n who_o be_v within_o the_o meaning_n and_o danger_n of_o this_o law_n without_o any_o precedent_a conviction_n for_o recusancy_n see_v more_o of_o this_o matter_n 5._o licence_n to_o travel_v stat._n 3_o jac._n 5._o and_o how_o a_o popish_a recusant_n shall_v be_v license_v to_o travel_v out_o of_o his_o compass_n of_o five_o mile_n stat._n 3_o jac._n cap._n 5._o sect._n 8._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a copyholder_n stat._n sect._n 4._o a_o popish_a recusant_n copyholder_n that_o every_o such_o offender_n as_o be_v before_o mention_v which_o have_v or_o shall_v have_v any_o land_n tenement_n or_o hereditament_n by_o copy_n of_o court_n roll_n or_o by_o any_o other_o customary_a tenure_n at_o the_o will_n of_o the_o lord_n according_a to_o the_o custom_n of_o any_o disobedience_n of_o the_o say_a law_n and_o statute_n and_o be_v commit_v to_o prison_n for_o the_o same_o do_v live_v for_o the_o most_o part_n in_o better_a case_n there_o than_o they_o can_v if_o they_o be_v abroad_o at_o their_o own_o liberty_n the_o lord_n spiritual_a and_o temporal_a and_o the_o commons_o in_o this_o present_a parliament_n assemble_v do_v most_o humble_o and_o instant_o beseech_v the_o queen_n majesty_n that_o it_o may_v be_v further_o enact_v that_o if_o any_o such_o person_n or_o person_n be_v a_o popish_a recusant_n not_o be_v a_o feme_fw-fr covert_n and_o not_o have_v land_n tenement_n rent_n or_o annuity_n of_o a_o absolute_a estate_n of_o inheritance_n or_o freehold_n of_o the_o clear_a yearly_a value_n of_o twenty_o mark_n above_o all_o charge_n to_o their_o own_o use_n and_o behoof_n and_o not_o upon_o any_o secret_a trust_n or_o confidence_n for_o any_o other_o or_o good_n and_o chattel_n in_o their_o own_o right_n and_o to_o their_o own_o proper_a use_n and_o behoof_n and_o not_o upon_o any_o such_o secret_a trust_n and_o confidence_n for_o any_o other_o above_o the_o value_n of_o forty_o pound_n shall_v not_o within_o the_o time_n before_o in_o this_o act_n in_o that_o behalf_n limit_v and_o appoint_v repair_v to_o their_o place_n of_o usual_a dwell_n and_o abode_n if_o they_o have_v any_o or_o else_o to_o the_o place_n where_o they_o be_v bear_v or_o where_o their_o father_n or_o mother_n shall_v be_v dwell_v according_a to_o the_o tenor_n and_o intent_n of_o this_o present_a act_n and_o thereupon_o notify_v their_o come_n and_o present_v themselves_o and_o deliver_v their_o true_a name_n in_o write_v to_o the_o minister_n or_o curate_n of_o the_o parish_n and_o to_o the_o constable_n headborough_z or_o tithingman_n of_o the_o town_n within_o such_o time_n and_o in_o such_o manner_n and_o form_n as_o be_v aforesaid_a or_o at_o any_o time_n after_o such_o their_o repair_n to_o any_o such_o place_n as_o be_v before_o appoint_v shall_v pass_v or_o remove_v above_o five_o mile_n from_o the_o same_o and_o shall_v not_o within_o three_o month_n next_o after_o such_o person_n shall_v be_v apprehend_v or_o take_v for_o offend_v as_o be_v aforesaid_a conform_v themselves_o to_o the_o obedience_n of_o the_o law_n and_o statute_n of_o this_o realm_n in_o come_v usual_o to_o the_o church_n to_o hear_v curate_n of_o the_o parish_n that_o in_o every_o such_o case_n every_o such_o offender_n be_v thereunto_o warn_v or_o require_v by_o any_o two_o justice_n of_o the_o peace_n or_o coroner_n of_o the_o same_o county_n where_o such_o offender_n shall_v then_o be_v shall_v upon_o his_o or_o their_o corporal_a oath_n abjuration_n abjuration_n before_o any_o two_o justice_n of_o the_o peace_n or_o coroner_n of_o the_o same_o county_n abjure_v this_o realm_n of_o england_n and_o all_o other_o the_o queén_v majesty_n dominion_n forever_o and_o thereupon_o shall_v depart_v out_o of_o this_o realm_n at_o such_o haven_n and_o port_n and_o within_o such_o time_n as_o shall_v in_o that_o behalf_n be_v assign_v and_o appoint_v by_o the_o say_a justice_n of_o peace_n or_o coroner_n before_o who_o such_o abjuration_n shall_v be_v make_v unless_o the_o same_o offender_n be_v let_v or_o stay_v by_o such_o lawful_a and_o reasonable_a mean_n or_o cause_n as_o by_o the_o common_a law_n of_o statute_n and_o none_o but_o such_o not_o what_o popish_a recusant_n be_v within_o this_o branch_n and_o which_o not_o dalton_n v._o cap._n 45._o tit_n recusant_n apply_v this_o clause_n to_o popish_a recusant_n convict_v as_o if_o it_o concern_v they_o and_o they_o only_o and_o so_o both_o at_o once_o extend_v and_o restrain_v the_o statute_n contrary_a to_o its_o true_a meaning_n for_o these_o word_n any_o such_o person_n or_o person_n neither_o extend_v to_o all_o that_o be_v convict_v nor_o be_v restrain_v to_o such_o only_a as_o be_v convict_v for_o the_o popish_a recusant_n who_o have_v a_o certain_a place_n of_o abode_n within_o this_o realm_n although_o he_o be_v convict_v be_v not_o within_o this_o statute_n unless_o he_o be_v a_o popish_a recusant_n and_o in_o england_n at_o the_o time_n of_o his_o conviction_n and_o the_o popish_a recusant_n who_o have_v no_o certain_a place_n of_o abode_n within_o this_o realm_n be_v within_o this_o statute_n although_o he_o be_v never_o convict_v so_o that_o either_o of_o these_o sort_n of_o popish_a recusant_n who_o have_v a_o estate_n under_o value_n viz._n he_o who_o have_v no_o certain_a place_n of_o abode_n and_o he_o who_o have_v a_o certain_a place_n of_o abode_n be_v convict_v when_o a_o popish_a recusant_n and_o in_o england_n and_o no_o other_o be_v liable_a by_o this_o act_n to_o abjuration_n of_o the_o clear_a yearly_a value_n value_n clear_a yearly_a value_n of_o twenty_o mark_n above_o all_o charge_n a_o rent-charge_n of_o 40_o l._n per_fw-la annum_fw-la be_v issue_v out_o of_o land_n worth_a 100_o l._n per_fw-la annum_fw-la a_o popish_a recusant_n liable_a to_o be_v confine_v by_o this_o statute_n purchase_v for_o his_o life_n or_o in_o fee_n parcel_n of_o the_o land_n of_o the_o clear_a yearly_a value_n of_o twenty_o mark_n over_z and_o above_o what_o his_o proportion_n of_o the_o say_a rent-charge_n come_v to_o this_o be_v a_o estate_n of_o the_o clear_a yearly_a value_n of_o twenty_o mark_n within_o the_o meaning_n of_o this_o act_n and_o shall_v free_v he_o from_o abjuration_n for_o although_o in_o strictness_n of_o law_n his_o estate_n be_v not_o clear_o so_o much_o above_o all_o charge_n for_o that_o it_o be_v chargeable_a with_o a_o yearly_a rent_n of_o forty_o pound_n yet_o in_o equity_n he_o shall_v pay_v no_o more_o than_o his_o proportion_n of_o it_o which_o the_o land_n he_o purchase_v will_v discharge_v and_o yet_o yield_v twenty_o mark_n per_fw-la annum_fw-la clear_o beside_o or_o good_n and_o chattel_n this_o statute_n be_v in_o the_o disjunctive_a land_n or_o good_n a_o estate_n partly_o of_o land_n together_o good_n and_o land_n not_o to_o be_v value_v together_o and_o partly_o of_o good_n will_v not_o satisfy_v the_o intent_n thereof_o and_o therefore_o if_o a_o popish_a recusant_n who_o offend_v against_o this_o act_n have_v fifteen_o mark_n per_fw-la annum_fw-la clear_o in_o land_n and_o be_v worth_a thirty_o pound_n in_o good_n although_o this_o take_v together_o be_v in_o truth_n a_o estate_n of_o more_o value_n than_o be_v here_o require_v yet_o it_o shall_v not_o free_v he_o from_o abjuration_n for_o the_o statute_n do_v not_o warrant_v any_o valuation_n of_o the_o land_n and_o good_n together_o so_o as_o to_o supply_v the_o defect_n of_o the_o yearly_a value_n of_o the_o land_n by_o the_o good_n or_o the_o defect_n of_o the_o value_n of_o the_o good_n by_o the_o land_n and_o therefore_o the_o recusant_n must_v have_v such_o a_o estate_n in_o the_o one_o or_o the_o other_o as_o will_v answer_v the_o statute_n and_o this_o be_v not_o like_o the_o case_n of_o juror_n upon_o the_o statute_n of_o 2_o h._n 5._o 3._o stat._n 2_o h._n 5._o 3._o cap._n 3._o where_o it_o be_v say_v that_o the_o juror_n shall_v have_v land_n of_o the_o clear_a yearly_a value_n of_o forty_o shilling_n if_o the_o debt_n or_o damage_n declare_v amount_v to_o forty_o mark_n in_o which_o case_n although_o it_o be_v in_o the_o disjunctive_a debt_n or_o damage_n yet_o it_o have_v be_v adjudge_v that_o where_o the_o debt_n and_o damage_n both_o amount_v to_o forty_o mark_n it_o be_v sufficient_a and_o the_o juror_n must_v have_v forty_o shilling_n per_fw-la annum_fw-la co._n 1._o inst_z 272._o for_o in_o that_o case_n the_o word_n or_o be_v cumulative_a and_o debt_n or_o damage_n both_v amount_v to_o no_o more_o than_o one_o entire_a thing_n viz._n the_o value_n of_o the_o cause_n or_o action_n depend_v and_o it_o appear_v plain_o to_o be_v the_o intent_n of_o the_o maker_n of_o the_o law_n that_o no_o cause_n declare_v to_o be_v of_o the_o value_n of_o forty_o mark_n shall_v be_v try_v by_o juror_n of_o a_o less_o estate_n but_o in_o our_o case_n the_o land_n and_o good_n be_v thing_n of_o different_a nature_n one_o real_a the_o other_o personal_a and_o can_v be_v regular_o reduce_v under_o one_o and_o the_o same_o head_n and_o therefore_o shall_v not_o be_v value_v together_o unless_o the_o act_n have_v express_o appoint_v such_o a_o valuation_n but_o yet_o if_o a_o popish_a recusant_n have_v a_o lease_n for_o year_n may_v but_o lease_n for_o year_n and_o personal_a good_n may_v and_o personal_a good_n and_o both_o do_v amount_v in_o value_n to_o above_o forty_o pound_n he_o shall_v be_v out_o of_o the_o danger_n of_o abjuration_n for_o although_o the_o lease_n be_v in_o the_o realty_n and_o the_o good_n be_v personal_a yet_o they_o shall_v in_o this_o case_n be_v value_v together_o for_o that_o by_o this_o copulative_a and_o the_o statute_n express_o so_o appoint_v without_o distinguish_v between_o the_o value_v of_o either_o but_o make_v it_o sufficient_a if_o both_o of_o they_o be_v of_o that_o value_n money_o secure_v upon_o a_o mortgage_n mortgage_n mortgage_n of_o land_n be_v within_o the_o meaning_n of_o these_o word_n good_n and_o chattel_n and_o if_o the_o popish_a recusant_n have_v above_o forty_o pound_n owe_v to_o he_o upon_o such_o mortgage_n he_o can_v be_v require_v to_o abjure_v within_o three_o month_n next_o after_o such_o person_n shall_v be_v apprehend_v or_o take_v wingate_n in_o abridge_n this_o clause_n tit_n crown_n numb_a 80._o clear_o mistake_v the_o meaning_n of_o it_o for_o he_o say_v that_o a_o popish_a recusant_n who_o estate_n be_v under_o value_n must_v make_v the_o submission_n prescribe_v by_o this_o act_n within_o three_o month_n next_o after_o his_o arrival_n at_o his_o place_n of_o abode_n which_o be_v a_o complicate_v error_n for_o he_o quite_o leave_v out_o he_o who_o be_v to_o repair_v to_o the_o place_n where_o he_o be_v bear_v or_o his_o father_n or_o mother_n dwell_v he_o make_v the_o party_n liable_a to_o such_o submission_n before_o he_o become_v a_o offender_n by_o not_o repair_v or_o not_o present_v himself_o and_o give_v in_o his_o true_a name_n or_o travel_v above_o five_o mile_n he_o speak_v nothing_o of_o his_o be_v
presentment_n as_o a_o profit_n of_o the_o advowson_n which_o be_v parcel_n of_o the_o manor_n moor_n ibid._n matter_n the_o recusant_n may_v plead_v collateral_a matter_n or_o other_o defect_n whatsoever_o this_o be_v mean_v of_o defect_n within_o the_o indictment_n or_o other_o proceed_n and_o not_o of_o any_o collateral_a matter_n which_o the_o recusant_n have_v to_o discharge_v himself_o as_o a_o pardon_n auterfoit_n convict_v etc._n etc._n for_o the_o recusant_n be_v not_o hereby_o disable_v to_o plead_v such_o collateral_a matter_n but_o may_v take_v advantage_n thereof_o co._n
