attorney_n make_v a_o difference_n between_o the_o case_n of_o a_o indictment_n and_o this_o charge_n i_o conceive_v that_o in_o this_o case_n there_o be_v no_o difference_n the_o matter_n be_v the_o same_o the_o one_o concern_v the_o life_n of_o a_o person_n and_o so_o do_v the_o other_o the_o offence_n be_v the_o same_o the_o one_o be_v a_o charge_n of_o high_a treason_n and_o so_o be_v the_o other_o it_o be_v true_a those_o formality_n that_o concern_v the_o manner_n of_o the_o trial_n those_o it_o be_v true_a be_v lay_v by_o because_o here_o be_v no_o jury_n to_o come_v before_o your_o lordship_n but_o your_o lordship_n try_v upon_o the_o hear_n of_o the_o testimony_n and_o according_a to_o thing_n allege_v and_o prove_v but_o for_o other_o matter_n that_o especial_o be_v substantial_o require_v by_o the_o act_n of_o parliament_n we_o conceive_v that_o those_o shall_v be_v supply_v no_o more_o by_o a_o intendment_n in_o case_n of_o a_o charge_n before_o your_o treason_n for_o adhere_v to_o the_o enemy_n and_o another_o treason_n for_o counterfeit_v of_o the_o coin_n or_o those_o kind_n of_o thing_n these_o be_v several_a treason_n though_o they_o be_v all_o put_v into_o one_o information_n and_o haply_o may_v be_v put_v in_o case_n of_o necessity_n into_o one_o indictment_n as_o here_o be_v several_a act_n put_v into_o one_o charge_n but_o now_o a_o proof_n of_o treason_n within_o one_o of_o the_o act_n by_o one_o witness_n and_o a_o proof_n of_o a_o treason_n within_o another_o of_o the_o act_n by_o another_o witness_n will_v not_o be_v esteem_v and_o account_v a_o proof_n by_o two_o witness_n for_o it_o must_v be_v a_o proof_n not_o that_o he_o be_v within_o the_o charge_n but_o within_o that_o part_n of_o the_o charge_n upon_o which_o he_o be_v to_o be_v arraign_v and_o here_o be_v not_o a_o prove_v each_o distinct_a part_n of_o the_o charge_n by_o two_o witness_n as_o the_o statute_n require_v and_o then_o to_o come_v near_o suppose_v course_n i_o know_v what_o it_o be_v that_o in_o case_n there_o be_v one_o general_a charge_n and_o then_o it_o do_v descend_v to_o several_a particular_n one_o witness_n will_v serve_v for_o one_o and_o another_o to_o another_o and_o a_o three_o to_o a_o three_o and_o these_o shall_v make_v up_o two_o witness_n to_o convict_v the_o party_n but_o we_o be_v not_o now_o in_o a_o proceed_n of_o star-chamber_n that_o be_v lay_v by_o it_o be_v not_o altogether_o so_o regular_a in_o all_o thing_n and_o then_o we_o be_v not_o in_o a_o thing_n bare_o criminal_a but_o in_o a_o case_n of_o life_n and_o not_o in_o the_o case_n of_o life_n ordinary_o but_o in_o a_o case_n wherein_o a_o party_n be_v accuse_v of_o treason_n wherein_o the_o statute_n do_v provide_v that_o there_o shall_v be_v two_o witness_n as_o i_o conceive_v to_o swear_v to_o the_o same_o thing_n by_o which_o you_o will_v bring_v he_o within_o it_o otherwise_o they_o stand_v as_o single_a witness_n every_o one_o apart_o i_o act_n two_o three_o four_o witness_n i_o think_v they_o be_v number_n enough_o to_o accuse_v and_o detect_v a_o person_n of_o as_o high_a quality_n and_o for_o the_o last_o for_o misprision_n of_o treason_n m._n love_n have_v say_v that_o which_o never_o come_v into_o my_o thought_n that_o such_o act_n do_v by_o m._n love_n can_v be_v judge_v misprision_n he_o that_o act_v with_o they_o five_o treason_n and_o one_o act_n may_v be_v a_o offence_n against_o four_o or_o five_o act_n of_o parliament_n and_o this_o be_v the_o truth_n for_o where_o the_o several_a act_n be_v repeat_v that_o my_o lord_n be_v those_o law_n against_o which_o this_o treason_n and_o this_o treasonable_a practice_n and_o design_n be_v lay_v to_o be_v then_o follow_v the_o several_a enumeration_n of_o
