freeman_n of_o the_o realm_n in_o as_o large_a and_o ample_a manner_n as_o any_o layicke_n the_o king_n other_o subject_n be_v it_o seem_v that_o a_o parson_n &_o vicar_n by_o the_o law_n and_o custom_n of_o the_o realm_n be_v a_o freehoulder_n shall_v for_o none_o other_o cause_n loose_v his_o freehould_v then_o for_o the_o which_o like_a cause_n a_o layicke_n may_v loose_v he_o yea_o and_o because_o no_o layicke_n by_o the_o law_n &_o custom_n of_o the_o realm_n may_v be_v put_v from_o his_o freehould_v for_o contempt_n no_o though_o the_o same_o contempt_n be_v commit_v against_o the_o king_n proclamation_n or_o any_o decree_n make_v in_o his_o high_a court_n of_o chancery_n by_o so_o much_o the_o more_o unreasonable_a it_o seem_v to_o be_v that_o a_o parson_n or_o vicar_n for_o contempt_n against_o his_o ordinary_n admonition_n shall_v be_v deprive_v from_o his_o benefice_n by_o how_o much_o a_o contempt_n against_o the_o king_n commandment_n be_v more_o heinous_a than_o be_v a_o contempt_n against_o the_o ordinary_n admonition_n you_o mistake_v the_o case_n answer_n &_o as_o it_o seem_v you_o understand_v not_o the_o law_n the_o freehold_a of_o a_o layick_a and_o the_o freehold_a of_o a_o ecclesiastical_a person_n be_v not_o of_o one_o nature_n the_o former_a belong_v unto_o he_o by_o a_o title_n invest_v in_o his_o person_n but_o the_o latter_a appertain_v unto_o a_o churchman_n in_o the_o right_n of_o his_o church_n if_o then_o the_o churchman_n be_v displace_v from_o his_o church_n it_o follow_v by_o a_o necessary_a consequence_n that_o he_o must_v likewise_o be_v discharge_v from_o his_o freehold_n for_o he_o be_v in_o the_o eye_n of_o the_o law_n dead_a unto_o his_o church_n can_v no_o more_o enjoy_v the_o freehold_n which_o he_o hold_v in_o the_o right_n of_o his_o church_n then_o can_v a_o dead_a layick_a any_o long_o hold_v a_o franktenement_n in_o right_a of_o his_o person_n and_o for_o your_o better_a satisfaction_n herein_o i_o will_v have_v you_o to_o consider_v that_o the_o like_a course_n of_o justice_n be_v keep_v and_o minister_v against_o certain_a officer_n in_o the_o common_a weal_n which_o officer_n so_o soon_o as_o for_o any_o just_a cause_n they_o shall_v be_v put_v from_o their_o office_n do_v withal_o and_o forthwith_o loose_a such_o their_o freeholde_n as_o joint_o with_o their_o office_n and_o in_o regard_n of_o their_o office_n they_o hold_v the_o master_n of_o the_o roll_n and_o warden_n of_o the_o fleet_n have_v their_o office_n grant_v for_o term_n of_o life_n though_o other_o of_o they_o by_o the_o same_o grant_v be_v seize_v of_o a_o freehold_n the_o one_o of_o the_o house_n call_v the_o roll_n the_o other_o of_o the_o house_n call_v the_o fleet_n nevertheless_o if_o the_o first_o be_v put_v from_o his_o mastership_n and_o the_o second_o from_o his_o wardenship_n neither_o can_v the_o one_o nor_o the_o other_o by_o the_o law_n and_o justice_n of_o the_o realm_n retain_v either_o of_o those_o house_n as_o his_o freehold_n for_o as_o the_o house_n be_v joint_o with_o their_o office_n &_o in_o respect_n of_o their_o office_n grant_v so_o their_o office_n be_v once_o take_v from_o they_o they_o must_v withal_o by_o necessary_a consequence_n forgo_v those_o their_o house_n w_z ch_z for_o the_o time_n they_o hold_v as_o their_o freehold_n well_o if_o this_o be_v all_o that_o you_o will_v bear_v we_o in_o hand_n for_o though_o we_o grant_v whatsoever_o you_o have_v except_v to_o be_v true_a yet_o can_v not_o the_o same_o be_v a_o bar_n against_o our_o plead_n reply_n for_o we_o have_v hitherto_o plead_v no_o more_o in_o effect_n but_o thus_o viz._n that_o a_o parson_n or_o vicar_n during_o his_o ministerial_a function_n be_v in_o the_o eye_n of_o the_o law_n no_o dead_a but_o a_o live_a person_n and_o a_o free_a man_n of_o the_o realm_n ought_v no_o more_o for_o a_o contempt_n unto_o his_o ordinary_n admonition_n by_o any_o law_n of_o he_o realm_n be_v dispossess_v from_o the_o freehold_n which_o in_o right_n of_o his_o function_n he_o enjoy_v then_o can_v a_o layicke_n for_o contempt_n unto_o the_o king_n commandment_n be_v disseise_v of_o he_o and_o what_o if_o the_o freeholde_v of_o a_o layick_a &_o of_o a_o ecclesiastical_a person_n be_v as_o you_o say_v they_o be_v diverse_o possess_v the_o one_o by_o right_a of_o church_n the_o other_o by_o right_n of_o person_n what_o do_v this_o i_o say_v impugn_v our_o say_n that_o no_o freeholder_n for_o contempt_n of_o the_o king_n commandment_n may_v be_v punish_v with_o loss_n of_o his_o freehold_n when_o the_o great_a charter_n of_o england_n tell_v we_o that_o a_o freeman_n shall_v not_o be_v amerce_v for_o a_o small_a fault_n but_o after_o the_o quantity_n of_o the_o fault_n and_o for_o a_o great_a fault_n after_o the_o manner_n thereof_o save_v to_o he_o his_o contenement_n or_o freehold_n if_o then_o unto_o every_o freeman_n punishable_a by_o the_o law_n though_o his_o fault_n be_v great_a his_o contenement_n or_o freehold_a aught_o to_o be_v reserve_v it_o seem_v much_o more_o reasonable_a to_o follow_v that_o no_o churchman_n be_v a_o freeman_n of_o the_o realm_n may_v for_o put_v this_o case_n unto_o you_o viz._n that_o a_o churchman_n and_o a_o temporal_a person_n both_o freeman_n of_o the_o realm_n for_o one_o and_o the_o self_n same_o contempt_n against_o the_o king_n be_v punishable_a by_o the_o great_a lord_n in_o the_o star_n chamber_n
