time_n whether_o they_o shall_v have_v be_v discharge_v after_o his_o death_n without_o payment_n of_o such_o arrear_n and_o the_o opinion_n of_o those_o who_o hold_v that_o the_o seizure_n shall_v neither_o ensue_v nor_o continue_v after_o his_o death_n but_o that_o the_o arrear_n be_v discharge_v be_v principal_o ground_v upon_o the_o aforesaid_a construction_n of_o this_o statute_n viz._n that_o due_a and_o payable_a extend_v only_o to_o arrearage_n due_a and_o payable_a upon_o a_o judgement_n and_o convert_v into_o a_o debt_n but_o when_o the_o recusant_n be_v convict_v by_o proclamation_n the_o penalty_n be_v never_o convert_v into_o a_o debt_n and_o therefore_o when_o he_o die_v there_o be_v no_o arrearage_n due_a in_o the_o sense_n of_o this_o statute_n for_o the_o heir_n to_o pay_v and_o yet_o that_o by_o such_o offender_n here_o be_v general_o intend_v all_o recusant_n convict_v as_o well_o by_o proclamation_n upon_o default_n as_o upon_o judgement_n and_o the_o heir_n of_o either_o shall_v have_v have_v the_o benefit_n of_o this_o proviso_n viz._n that_o upon_o the_o death_n of_o the_o ancestor_n no_o seizure_n shall_v ensue_v or_o be_v continue_v only_o in_o the_o case_n of_o a_o judgement_n the_o arrear_n be_v to_o have_v be_v pay_v but_o there_o seem_v now_o to_o be_v no_o further_o need_v of_o this_o question_n for_o the_o statute_n of_o 1_o jac._n cap._n 4._o 4._o stat._n 1_o jac._n 4._o meet_v with_o both_o these_o case_n for_o if_o there_o be_v no_o seizure_n of_o the_o recusants_n land_n in_o his_o life_n time_n the_o discharge_n of_o the_o heir_n will_v depend_v upon_o his_o conformity_n and_o if_o there_o be_v a_o seizure_n the_o two_o part_n shall_v continue_v in_o his_o majesty_n possession_n till_o the_o arrear_n be_v pay_v and_o satisfy_v not_o entail_v land_n when_o discharge_v and_o when_o not_o but_o this_o be_v not_o intend_v of_o entail_v land_n for_o without_o any_o aid_n of_o this_o proviso_n if_o a_o recusant_n tenant_n in_o tail_n be_v convict_v by_o proclamation_n upon_o default_n and_o die_v neither_o any_o seizure_n for_o the_o arrear_n of_o the_o 20_o l._n per_fw-la month_n shall_v ensue_v after_o his_o death_n nor_o if_o they_o be_v seize_v in_o his_o life_n time_n shall_v the_o seizure_n be_v continue_v after_o his_o death_n nor_o be_v the_o heir_n in_o tail_n bind_v to_o pay_v any_o such_o arrear_n but_o if_o a_o judgement_n be_v have_v against_o the_o recusant_n tenant_n in_o tail_n in_o his_o life_n time_n the_o heir_n be_v bind_v in_o that_o case_n of_o which_o see_v far_a in_o stat._n 1_o jac._n cap._n 4._o sect._n 4._o if_o a_o judgement_n be_v have_v against_o the_o recusant_n before_o the_o say_a statute_n of_o 1_o jac._n and_o he_o have_v die_v before_o seizure_n of_o the_o two_o part_n of_o his_o land_n the_o question_n be_v whether_o after_o his_o death_n they_o may_v have_v be_v seize_v by_o force_n of_o this_o statute_n of_o 29._o for_o the_o arrear_n of_o the_o penalty_n incur_v in_o his_o life_n time_n for_o that_o the_o seizure_n here_o give_v be_v mere_o in_o nature_n of_o a_o nomine_fw-la poenae_fw-la or_o penalty_n inflict_v for_o his_o contempt_n in_o not_o pay_v the_o 20_o l_o per_fw-la month_n and_o shall_v not_o have_v go_v in_o satisfaction_n of_o the_o debt_n but_o the_o queen_n shall_v have_v hold_v the_o land_n till_o the_o 20_o l._n per_fw-la month_n be_v otherwise_o pay_v and_o satisfy_v and_o when_o this_o penalty_n of_o seizure_n be_v not_o execute_v in_o the_o recusants_n life_n time_n by_o his_o death_n the_o contempt_n be_v go_v and_o consequent_o the_o penalty_n inflict_v for_o that_o contempt_n can_v not_o then_o be_v put_v in_o execution_n vide_fw-la lane_n 92_o 93._o becket_n case_n ibid._n 107._o halsey_n case_n 4._o stat._n 1_o jac._n 4._o but_o now_o by_o the_o statute_n of_o 1_o jac._n 4._o the_o seizure_n be_v not_o as_o a_o mere_a penalty_n for_o the_o contempt_n of_o nonpayment_n but_o for_o the_o satisfy_n of_o the_o king_n of_o the_o arrear_n of_o the_o 20_o l._n per_fw-la month_n and_o the_o profit_n of_o the_o land_n shall_v go_v towards_o the_o payment_n and_o satisfaction_n thereof_o so_o that_o now_o there_o be_v no_o question_n but_o the_o two_o part_n of_o the_o recusants_n land_n may_v be_v seize_v after_o his_o death_n death_n seizure_n after_o the_o recusants_n death_n unless_o court_n of_o exchequer_n inquire_v commission_n to_o inquire_v that_o a_o commission_n shall_v be_v award_v first_o to_o inquire_v savile_n 130._o case_n 201._o and_o where_o by_o the_o say_v former_a estatute_n of_o stat._n sect._n 8._o the_o three_o part_n of_o the_o forfeiture_n how_o to_o be_v dispose_v of_o the_o three_o part_n of_o the_o forfeiture_n for_o not_o come_v to_o divine_a service_n wingate_n tit_n crown_n numb_a 78._o restrain_v both_o part_n of_o it_o as_o well_o relate_v to_o those_o that_o have_v no_o certain_a place_n of_o abode_n as_o those_o who_o place_n of_o abode_n be_v certain_a to_o recusant_n convict_v and_o make_v no_o mention_n that_o this_o late_a sort_n must_v be_v in_o england_n at_o the_o time_n of_o their_o conviction_n and_o in_o the_o late_a addition_n to_o dalton_n cap._n 81._o tit_n recusant_n sect._n 14._o it_o be_v not_o only_o say_v that_o both_o sort_n must_v be_v convict_v but_o that_o they_o must_v be_v in_o england_n at_o the_o time_n of_o their_o conviction_n which_o two_o thing_n be_v only_o requisite_a in_o such_o who_o have_v a_o certain_a place_n of_o abode_n and_o not_o in_o the_o other_o sort_n who_o be_v within_o the_o meaning_n and_o danger_n of_o this_o law_n without_o any_o precedent_a conviction_n for_o recusancy_n see_v more_o of_o this_o matter_n 5._o licence_n to_o travel_v stat._n 3_o jac._n 5._o and_o how_o a_o popish_a recusant_n shall_v be_v license_v to_o travel_v out_o of_o his_o compass_n of_o five_o mile_n stat._n 3_o jac._n cap._n 5._o sect._n 8._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a copyholder_n stat._n sect._n 4._o a_o popish_a recusant_n copyholder_n that_o every_o such_o offender_n as_o be_v before_o mention_v which_o have_v or_o shall_v have_v any_o land_n tenement_n or_o hereditament_n by_o copy_n of_o court_n roll_n or_o by_o any_o other_o customary_a tenure_n at_o the_o will_n of_o the_o lord_n according_a to_o the_o custom_n of_o any_o manor_n shall_v forfeit_v all_o and_o singular_a his_o and_o their_o say_a land_n tenement_n and_o hereditament_n so_o hold_v by_o copy_n of_o court_n roll_n or_o customary_a tenure_n as_o aforesaid_a for_o and_o during_o the_o life_n of_o such_o offender_n if_o his_o or_o her_o estate_n so_o long_o continue_v to_o the_o lord_n or_o lord_n of_o who_o the_o same_o be_v immediate_o hold_v if_o the_o same_o lord_n or_o lord_n or_o lord_n be_v not_o then_o a_o popish_a recusant_n and_o convict_v for_o not_o come_v to_o church_n to_o hear_v divine_a service_n but_o forbear_v the_o same_o contrary_n to_o the_o law_n and_o statute_n aforesaid_a nor_o seize_v or_o possess_v upon_o trust_n to_o the_o use_n or_o behoof_n of_o any_o such_o recusant_n as_o aforesaid_a and_o in_o such_o case_n the_o same_o forfeiture_n to_o be_v to_o the_o queen_n majesty_n provide_v always_o name_n stat._n sect._n 5._o popish_a recusant_n shall_v notify_v their_o come_n and_o deliver_v in_o their_o name_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o such_o person_n as_o by_o the_o intent_n and_o true_a meaning_n of_o this_o act_n be_v to_o make_v their_o repair_n to_o their_o place_n of_o dwell_v and_o abode_n or_o to_o the_o place_n where_o they_o be_v bear_v or_o where_o their_o father_n or_o mother_n shall_v be_v dwell_v and_o not_o to_o remove_v or_o pass_v above_o five_o mile_n from_o thence_o as_o be_v aforesaid_a shall_v within_o twenty_o day_n next_o after_o their_o come_n to_o any_o of_o the_o say_a place_n as_o the_o case_n shall_v happen_v notify_v their_o come_n thither_o and_o present_v themselves_o and_o deliver_v their_o true_a name_n in_o write_v to_o the_o minister_n or_o curate_n of_o the_o same_o parish_n and_o to_o the_o constable_n headborough_z or_o tithingman_n of_o the_o town_n and_o thereupon_o the_o say_a minister_n or_o curate_n shall_v present_o enter_v the_o same_o into_o a_o book_n to_o be_v keep_v in_o every_o parish_n for_o that_o purpose_n there_o which_o shall_v be_v certify_v to_o the_o session_n and_o enroll_v there_o and_o afterward_o the_o say_a minister_n or_o curate_n and_o the_o say_a constable_n headborough_z or_o tithingman_n shall_v certify_v the_o same_o in_o write_v to_o the_o justice_n of_o the_o peace_n of_o the_o same_o county_n at_o the_o next_o general_n or_o quarter_n session_n to_o be_v hold_v in_o the_o same_o county_n and_o the_o say_a justice_n shall_v cause_v the_o same_o to_o be_v enter_v by_o the_o clerk_n of_o the_o peace_n in_o the_o roll_n of_o the_o same_o session_n forfeit_v good_n and_o land_n where_o not_o forfeit_v a_o popish_a recusant_n repair_v to_o the_o place_n appoint_v he_o by_o this_o act_n and_o keep_v within_o his_o compass_n of_o five_o mile_n but_o do_v not_o present_v himself_o or_o deliver_v in_o his_o name_n he_o do_v not_o forfeit_v his_o good_n or_o land_n for_o there_o be_v no_o particular_a penalty_n inflict_v in_o this_o part_n of_o the_o act_n for_o that_o omission_n nor_o yet_o in_o the_o subsequent_a branch_n for_o he_o that_o have_v clear_o twenty_o mark_n per_fw-la annum_fw-la in_o freehold_n or_o good_n and_o chattel_n worth_a forty_o pound_n but_o yet_o such_o person_n may_v be_v indict_v for_o such_o neglect_n and_o fine_v upon_o the_o general_a word_n of_o the_o statute_n which_o command_v the_o thing_n to_o be_v do_v for_o where_o a_o act_n of_o parliament_n command_v any_o thing_n to_o be_v do_v and_o inflict_v no_o penalty_n a_o indictment_n lie_v against_o the_o person_n who_o ought_v seditious_a and_o dangerous_a people_n as_o be_v aforesaid_a who_o have_v little_a or_o no_o ability_n to_o answer_v or_o satisfy_v any_o competent_a penalty_n for_o their_o contempt_n and_o disobedience_n of_o the_o say_a law_n and_o statute_n and_o be_v commit_v to_o prison_n for_o the_o same_o do_v live_v for_o the_o most_o part_n in_o better_a case_n there_o than_o they_o can_v if_o they_o be_v abroad_o at_o their_o own_o liberty_n the_o lord_n spiritual_a and_o temporal_a and_o the_o commons_o in_o this_o present_a parliament_n assemble_v do_v most_o humble_o and_o instant_o beseech_v the_o queen_n majesty_n that_o it_o may_v be_v further_o enact_v that_o if_o any_o such_o person_n or_o person_n be_v a_o popish_a recusant_n not_o be_v a_o feme_fw-fr covert_n and_o not_o have_v land_n tenement_n rent_n or_o annuity_n of_o a_o absolute_a estate_n of_o inheritance_n or_o freehold_n of_o the_o clear_a yearly_a value_n of_o twenty_o mark_n above_o all_o charge_n to_o their_o own_o use_n and_o behoof_n and_o not_o upon_o any_o secret_a trust_n or_o confidence_n for_o any_o other_o or_o good_n and_o chattel_n in_o their_o own_o right_n and_o to_o their_o own_o proper_a use_n and_o behoof_n and_o not_o upon_o any_o such_o secret_a trust_n and_o confidence_n for_o any_o other_o above_o the_o value_n of_o forty_o pound_n shall_v not_o within_o the_o time_n before_o in_o this_o act_n in_o that_o behalf_n limit_v and_o appoint_v repair_v to_o their_o place_n of_o usual_a dwell_n and_o abode_n if_o they_o have_v any_o or_o else_o to_o the_o place_n where_o they_o be_v bear_v or_o where_o their_o father_n or_o mother_n shall_v be_v dwell_v according_a to_o the_o tenor_n and_o intent_n of_o this_o present_a act_n and_o thereupon_o notify_v their_o come_n and_o present_v themselves_o and_o deliver_v their_o true_a name_n in_o write_v to_o the_o minister_n or_o curate_n of_o the_o parish_n and_o to_o the_o constable_n headborough_z or_o tithingman_n of_o the_o town_n within_o such_o time_n and_o in_o such_o manner_n and_o form_n as_o be_v aforesaid_a or_o at_o any_o time_n after_o such_o their_o repair_n to_o any_o such_o place_n as_o be_v before_o appoint_v shall_v pass_v or_o remove_v above_o five_o mile_n from_o the_o same_o and_o shall_v not_o within_o three_o month_n next_o after_o such_o person_n shall_v be_v apprehend_v or_o take_v for_o offend_v as_o be_v aforesaid_a conform_v themselves_o to_o the_o obedience_n of_o the_o law_n and_o statute_n of_o this_o realm_n in_o come_v usual_o to_o the_o church_n to_o hear_v purpose_n and_o within_o ten_o day_n then_o next_o follow_v shall_v certify_v the_o same_o in_o write_v to_o the_o bishop_n of_o the_o same_o diocese_n provide_v nevertheless_o relapse_n stat._n sect._n 15._o a_o recusant_n submit_v and_o fall_v into_o relapse_n that_o if_o any_o such_o offender_n after_o such_o submission_n make_v as_o be_v aforesaid_a shall_v afterward_o fall_v into_o relapse_n or_o eftsoons_o become_v a_o recusant_n in_o not_o repair_v to_o church_n to_o hear_v divine_a service_n but_o shall_v forbear_v the_o same_o contrary_n to_o the_o law_n and_o statute_n in_o present_a parliament_n that_o if_o any_o that_o be_v or_o shall_v be_v a_o recusant_n shall_v submit_v or_o reform_v he_o or_o herself_o and_o become_v obedient_a to_o the_o law_n and_o ordinance_n of_o the_o church_n of_o england_n and_o repair_v to_o the_o church_n and_o continue_v there_o during_o the_o time_n of_o the_o divine_a service_n and_o sermon_n according_a to_o the_o true_a meaning_n of_o the_o statute_n in_o that_o behalf_n in_o the_o say_v late_a queen_n time_n make_v and_o provide_v that_o then_o every_o such_o person_n for_o and_o during_o such_o time_n as_o he_o or_o she_o shall_v so_o continue_v in_o such_o conformity_n and_o obedience_n shall_v from_o thenceforth_o be_v free_v and_o discharge_v of_o and_o from_o any_o the_o penalty_n and_o loss_n which_o the_o same_o person_n may_v otherwise_o sustain_v and_o bear_v in_o respect_n or_o by_o reason_n of_o such_o person_n recusancy_n according_a to_o the_o true_a meaning_n of_o the_o statute_n in_o that_o behalf_n it_o have_v be_v doubt_v whether_o these_o word_n do_v refer_v only_o to_o the_o manner_n of_o the_o recusants_n conformity_n or_o to_o the_o time_n likewise_o when_o it_o be_v to_o be_v do_v as_o well_o as_o to_o the_o manner_n for_o if_o they_o refer_v to_o the_o time_n than_o the_o recusant_n be_v still_o bind_v notwithstanding_o this_o statute_n to_o conform_v before_o judgement_n according_a to_o the_o statute_n of_o 23_o eliz._n cap._n 1._o 1_o stat._n 23_o eliz._n 1_o or_o his_o conformity_n afterward_o shall_v not_o discharge_v he_o of_o the_o penalty_n but_o any_o information_n presentment_n or_o indictment_n in_o any_o of_o the_o king_n court_n at_o westminster_n or_o at_o the_o assize_n every_o such_o person_n and_o person_n shall_v be_v disable_v from_o thenceforth_o to_o sue_v or_o use_v any_o action_n bill_n plaint_n or_o information_n in_o course_n of_o law_n or_o to_o prosecute_v any_o suit_n in_o any_o court_n of_o equity_n or_o to_o be_v guardian_n of_o any_o child_n or_o executor_n or_o administrator_n of_o any_o person_n or_o capable_a of_o any_o legacy_n or_o deed_n of_o gift_n or_o to_o bear_v any_o office_n within_o this_o realm_n of_o england_n dominion_n of_o wales_n or_o town_n of_o berwick_n upon_o tweed_n and_o shall_v forfeit_v the_o sum_n of_o five_o hundred_o pound_n to_o be_v recover_v by_o he_o or_o they_o that_o shall_v sue_v for_o the_o same_o to_o be_v prosecute_v by_o any_o action_n of_o debt_n suit_n bill_n plaint_n or_o information_n in_o any_o of_o his_o majesty_n court_n at_o westminster_n wherein_o no_o essoign_n protection_n or_o wager_n of_o law_n shall_v lie_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o name_n of_o all_o and_o singular_a such_o person_n and_o officer_n aforesaid_a that_o do_v or_o shall_v take_v the_o oath_n aforesaid_a shall_v be_v in_o the_o respective_a court_n of_o chancery_n and_o king_n bench_n and_o the_o quarter_n session_n enrol_v with_o the_o day_n and_o time_n of_o their_o take_v the_o same_o in_o roll_n make_v and_o keep_v only_o for_o that_o intent_n and_o purpose_n and_o for_o no_o other_o the_o which_o roll_n as_o for_o the_o court_n of_o chancery_n shall_v be_v public_o hang_v up_o in_o the_o office_n of_o the_o pettybag_n and_o the_o roll_n for_o the_o king_n bench_n in_o the_o crown_n office_n of_o the_o say_a court_n and_o in_o some_o public_a place_n in_o every_o quarter_n session_n and_o there_o remain_v during_o the_o whole_a term_n every_o term_n and_o during_o the_o whole_a time_n of_o the_o say_a session_n in_o every_o quarter_n session_n for_o every_o one_o to_o resort_v to_o and_o look_v upon_o without_o fee_n or_o reward_n and_o likewise_o none_o of_o the_o person_n or_o person_n aforesaid_a shall_v give_v or_o pay_v as_o any_o fee_n or_o reward_n to_o any_o officer_n or_o officer_n belong_v to_o any_o of_o the_o court_n as_o aforesaid_a above_o the_o sum_n of_o twelve_o penny_n for_o he_o or_o their_o entry_n of_o he_o or_o their_o take_n of_o the_o say_a oath_n aforesaid_a and_o further_o that_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o the_o respective_a court_n aforesaid_a to_o give_v and_o administer_v the_o say_v oath_n aforesaid_a to_o the_o person_n or_o person_n aforesaid_a in_o manner_n as_o aforesaid_a and_o upon_o the_o due_a tender_a of_o any_o such_o person_n or_o person_n to_o take_v the_o say_a oath_n the_o say_a court_n be_v hereby_o require_v and_o enjoin_v to_o administer_v the_o same_o and_o be_v it_o further_o enact_v that_o if_o any_o person_n or_o person_n not_o breed_v up_o by_o his_o or_o their_o parent_n or_o parent_n from_o their_o infancy_n in_o the_o popish_a religion_n and_o profess_v themselves_o to_o be_v popish_a recusant_n shall_v breed_v up_o instruct_v or_o educate_v he_o or_o their_o child_n or_o child_n or_o suffer_v they_o to_o be_v instructect_v or_o educate_v in_o the_o popish_a religion_n every_o such_o person_n be_v thereof_o convict_v shall_v be_v from_o thenceforth_o disable_v of_o hear_v any_o office_n or_o place_n of_o trust_n or_o profit_n in_o church_n or_o state_n and_o all_o such_o child_n as_o shall_v be_v so_o bring_v up_o instruct_v or_o educate_v be_v and_o shall_v be_v hereby_o disable_v of_o bear_v any_o such_o office_n or_o place_n of_o trust_n or_o profit_n until_o he_o and_o they_o shall_v be_v perfect_o reconcile_v and_o convert_v to_o the_o church_n of_o england_n and_o shall_v take_v the_o oath_n of_o supremacy_n and_o allegiance_n aforesaid_a before_o the_o justice_n of_o the_o peace_n in_o the_o open_a quarter_n session_n of_o the_o county_n or_o place_n where_o they_o shall_v inhabit_v and_o thereupon_o receive_v the_o sacrament_n of_o the_o lord_n supper_n after_o the_o usage_n of_o the_o church_n of_o england_n and_o obtain_v a_o certificate_n thereof_o under_o the_o hand_n of_o two_o or_o more_o of_o the_o say_a justice_n of_o the_o peace_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o at_o the_o same_o time_n when_o the_o person_n concern_v in_o this_o act_n shall_v take_v the_o aforesaid_a oath_n of_o supremacy_n and_o allegiance_n they_o shall_v likewise_o make_v and_o subscribe_v this_o declaration_n follow_v under_o the_o same_o penalty_n and_o forfeiture_n as_o by_o this_o act_n be_v appoint_v ay_o a._n b._n do_v declare_v that_o i_o do_v believe_v that_o there_o be_v not_o any_o transubstantiation_n in_o the_o sacrament_n of_o the_o lord_n supper_n or_o in_o the_o element_n of_o bread_n and_o wine_n at_z or_o after_o the_o consecration_n thereof_o by_o any_o person_n whatsoever_o of_o which_o subscription_n there_o shall_v be_v the_o like_a register_n keep_v as_o of_o the_o take_v the_o oath_n aforesaid_a provide_v always_o that_o neither_o this_o act_n nor_o any_o thing_n therein_o contain_v shall_v extend_v be_v judge_v or_o interpret_v any_o way_n to_o
