not_o only_o to_o the_o power_n of_o godliness_n but_o to_o common_a honesty_n and_o morality_n 2._o if_o it_o have_v be_v political_a wisdom_n or_o justice_n to_o annex_v such_o penalty_n to_o ecclesiastical_a law_n of_o any_o kind_n sure_a christ_n in_o who_o be_v all_o the_o treasure_n of_o wisdom_n will_v not_o have_v be_v want_v in_o annex_v penalty_n of_o that_o kind_n to_o his_o own_o law_n of_o the_o great_a and_o weighty_a concern_v to_o his_o church_n 3._o we_o judge_v of_o the_o greatness_n and_o weighty_a concern_v of_o any_o law_n usual_o by_o the_o greatness_n of_o the_o penalty_n annex_v in_o case_n of_o transgression_n and_o therefore_o herein_o we_o may_v apprehend_v that_o the_o church_n own_o law_n challenge_v a_o preeminency_n before_o the_o law_n of_o christ_n own_o composure_n and_o will_v this_o king_n of_o king_n make_v only_a law_n of_o lesser_a concern_n and_o substitute_v other_o to_o make_v the_o great_a this_o be_v absurd_a to_o believe_v 4._o it_o be_v a_o great_a piece_n of_o pride_n in_o mother-church_n to_o advance_v herself_o so_o far_o above_o the_o civil_a state_n that_o the_o magistrate_n shall_v become_v the_o executioner_n of_o her_o law_n for_o the_o lawmaker_n have_v always_o a_o great_a priority_n and_o dignity_n above_o the_o executioner_n if_o it_o be_v reply_v that_o the_o church_n only_o crave_v the_o magistrate_n assistance_n to_o complete_a her_o ecclesiastical_a censure_n and_o make_v they_o stick_v close_o on_o upon_o the_o back_n of_o offender_n answ_n herein_o the_o church_n bewray_v she_o own_o weakness_n in_o that_o she_o confess_v she_o be_v not_o a_o complete_a polity_n neither_o have_v power_n enough_o to_o reform_v herself_o or_o effectual_o enough_o to_o execute_v she_o own_o law_n without_o be_v behold_v to_o a_o exotic_a power_n as_o if_o a_o master_n of_o a_o family_n have_v not_o power_n enough_o to_o execute_v domestic_a law_n in_o correct_v a_o child_n or_o servant_n without_o ask_v his_o neighbour_n leave_n and_o call_v for_o his_o assistance_n but_o in_o case_n the_o church_n say_v as_o indeed_o she_o do_v that_o she_o go_v to_o the_o civil_a magistrate_n by_o way_n of_o appeal_n and_o the_o say_a magistrate_n have_v power_n at_o his_o pleasure_n to_o supersede_n her_o proceed_n this_o be_v to_o set_v the_o state_n above_o the_o church_n in_o ecclesiastic_n whereas_o the_o civil_a state_n be_v subordinate_a to_o the_o ecclesiastic_a ecclesiastical_o and_o the_o ecclesiastical_a to_o the_o civil_a civil_o and_o both_o in_o respect_n of_o the_o exercise_n of_o jurisdiction_n in_o each_o particular_a orb_n parallel_v or_o coordinate_a §_o 9_o last_o such_o penalty_n that_o can_v answer_v the_o natural_a end_n and_o design_n of_o church-censure_n may_v not_o be_v annex_v or_o use_v by_o the_o church_n but_o such_o a_o penalty_n answer_v not_o etc._n etc._n the_o major_n be_v undoubted_a the_o minor_a thus_o appear_v 1._o because_o the_o sword_n of_o the_o magistrate_n reach_v but_o the_o outward_a man_n whereas_o the_o end_n of_o church-censure_n be_v to_o reach_v the_o conscience_n 2._o the_o natural_a use_n of_o church-censure_n be_v the_o exercise_n of_o they_o in_o foro_fw-la ecclesiae_fw-la but_o the_o coercive_a power_n of_o the_o magistrate_n may_v not_o be_v exercise_v in_o foro_fw-la ecclesiae_fw-la upon_o any_o allowable_a pretence_n whatsoever_o chap._n xvii_o of_o the_o limit_n of_o magistratical_a power_n in_o matter_n of_o religion_n §_o 1._o the_o three_o enquiry_n propound_v be_v concern_v the_o true_a bound_n and_o limit_n of_o the_o magistrate_n power_n in_o matter_n of_o religion_n a_o great_a and_o difficult_a question_n but_o of_o very_o great_a concern_v to_o we_o that_o it_o be_v right_o resolve_v i_o do_v not_o expect_v to_o be_v so_o happy_a as_o to_o give_v other_o full_a satisfaction_n in_o it_o i_o be_v not_o able_a to_o do_v it_o to_o myself_o so_o far_o as_o i_o will_v i_o shall_v only_o go_v as_o far_o as_o i_o can_v and_o be_v convenient_a for_o this_o undertake_n with_o all_o possible_a brevity_n and_o demonstration_n we_o speak_v before_o in_o the_o two_o former_a question_n concern_v the_o magistrate_n power_n in_o matter_n of_o indifferency_n both_o legislative_a and_o executive_a on_o the_o behalf_n of_o the_o church_n this_o question_n be_v of_o large_a extent_n concern_v his_o whole_a power_n in_o matter_n of_o religion_n and_o inquire_v how_o far_o he_o may_v and_o aught_o to_o go_v and_o how_o far_o he_o may_v not_o go_v i._n e._n he_o can_v go_v without_o usurpation_n §_o 2._o matter_n of_o religion_n be_v a_o large_a word_n and_o it_o comprehend_v not_o only_a religion_n itself_o but_o all_o circumstance_n and_o attendance_n thereof_o which_o be_v indifferency_n in_o themselves_o neither_o moraly_a good_a or_o evil_n but_o in_o regard_n of_o their_o tendency_n and_o respect_n they_o be_v so_o concern_v the_o magistrate_n legislative_a power_n in_o these_o thing_n we_o have_v speak_v somewhat_o already_o i_o shall_v speak_v no_o more_o here_o of_o the_o nature_n of_o religion_n than_o to_o make_v way_n for_o my_o present_a undertake_n religion_n be_v usual_o understand_v to_o comprehend_v all_o moral_a duty_n and_o all_o institute_v worship_n to_o which_o if_o we_o add_v the_o aforesaid_a attend_v circumstance_n we_o use_v a_o large_a way_n of_o expression_n and_o call_v they_o matter_n of_o religion_n §_o 3._o the_o moral_a law_n be_v a_o general_a stand_a rule_n to_o all_o sort_n of_o action_n person_n and_o society_n of_o the_o child_n of_o man_n whereby_o god_n himself_o have_v challenge_v the_o first_o right_n of_o dominion_n as_o of_o particular_a man_n so_o of_o all_o necessary_a fabric_n of_o rule_n and_o government_n in_o the_o world_n so_o that_o all_o action_n person_n and_o society_n due_o measure_v and_o square_v thereby_o be_v right_o call_v religious_a and_o the_o contrary_a irreligious_a hence_o particular_a domestic_a ecclesiastic_a and_o civil_a jurisdiction_n in_o a_o christian_a commonwealth_n be_v in_o proper_a sense_n call_v all_o of_o they_o religious_a §_o 4._o religion_n take_v in_o a_o strict_a and_o more_o limit_a sense_n be_v understand_v of_o a_o holy_a life_n and_o conversation_n of_o particular_a person_n and_o society_n not_o only_o according_a to_o the_o general_a rule_n of_o moral_a obedience_n but_o according_a to_o the_o more_o particular_a and_o special_a appointment_n and_o gospel-institution_n of_o our_o lord_n jesus_n christ_n whereby_o he_o separate_v unto_o himself_o the_o most_o choice_a and_o peculiar_a society_n in_o the_o world_n under_o his_o proper_a and_o more_o immediate_a rule_n and_o government_n which_o be_v call_v his_o church_n §_o 5._o therefore_o 1._o the_o civil_a christian_a magistrate_n have_v no_o power_n in_o the_o strict_a sense_n in_o matter_n of_o religion_n quatenus_fw-la magistrate_n no_o more_o than_o a_o heathen_a have_v for_o though_o the_o embrace_v the_o christian_a religion_n do_v much_o capacitate_v the_o civil_a magistrate_n as_o to_o his_o inclination_n and_o endeavour_n for_o the_o improvement_n of_o his_o magistratical_a power_n towards_o the_o advantage_n of_o religion_n yet_o it_o add_v no_o new_a power_n or_o jurisdiction_n to_o he_o over_o church_n family_n christian_n or_o other_o for_o a_o heathen_a magistrate_n be_v as_o much_o in_o his_o place_n the_o supreme_a head_n and_o governmnour_n of_o the_o church_n consider_v in_o a_o civil_a capacity_n under_o his_o government_n as_o the_o most_o faith-defending_a christian_a or_o catholic_n prince_n in_o the_o world_n neither_o by_o his_o embrace_a christianity_n do_v he_o attain_v any_o augmentation_n of_o his_o magistratical_a power_n headship_n or_o supremacy_n a_o christian_a be_v no_o more_o bind_v as_o a_o subject_a by_o the_o rule_n of_o the_o gospel_n to_o a_o christian_a magistrate_n than_o to_o a_o heathen_a or_o heretical_a magistrate_n the_o rule_n be_v indefinite_a to_o a_o magistrate_n as_o such_o though_o a_o christian_a subject_n will_v be_v the_o better_a man_n and_o subject_a and_o a_o christian_a magistrate_n the_o better_a man_n and_o magistrate_n christianity_n make_v every_o one_o the_o better_a man_n and_o better_o qualify_v for_o the_o performance_n of_o the_o relative_a duty_n of_o his_o place_n that_o he_o be_v set_v in_o §_o 6._o second_o no_o civil_a magistrate_n can_v be_v a_o ecclesiastical_a head_n and_o governor_n of_o the_o church_n as_o such_o it_o be_v christ_n prerogative_n to_o be_v the_o supreme_a and_o to_o constitute_v what_o other_o head_n and_o governor_n he_o in_o his_o wisdom_n think_v best_a but_o i_o find_v not_o that_o he_o ever_o make_v any_o magistrate_n a_o constitutive_a ecclesiastical_a head_n or_o governor_n to_o his_o church_n virtute_fw-la officii_fw-la for_o if_o so_o in_o every_o christian_a dominion_n the_o prince_n shall_v be_v the_o metropolitan_a and_o the_o true_a pastor_n to_o that_o national_a church_n §_o 7._o three_o no_o civil_a magistrate_n can_v by_o virtue_n of_o
all_o action_n become_v a_o christian_a commonwealth_n than_o so_o far_o the_o christian_a magistrate_n have_v power_n more_o or_o less_o so_o far_o as_o may_v conduce_v to_o the_o due_a maintain_n of_o the_o be_v or_o well-being_n of_o a_o christian_a state_n and_o therefore_o be_v to_o be_v conservator_fw-la unriusque_fw-la tabulae_fw-la he_o have_v the_o conservation_n of_o the_o second_o table_n commit_v to_o his_o care_n that_o it_o may_v be_v a_o civil_a state_n of_o the_o first_o that_o it_o may_v be_v a_o christian_n state_n and_o therefore_o as_o a_o family_n be_v to_o preserve_v the_o honour_n and_o justice_n of_o the_o moral_a law_n by_o a_o oeconomick_a sanction_n and_o the_o church_n by_o a_o ecclesiastic_a so_o the_o civil_a state_n by_o civil_a sanction_n each_o according_a to_o their_o just_a derive_v law_n whereby_o they_o be_v respective_o to_o govern_v and_o distinct_o to_o administer_v §_o 19_o the_o great_a question_n here_o be_v how_o far_o the_o magistrate_n power_n extend_v in_o the_o make_n and_o execution_n of_o penal_a statute_n we_o have_v show_v that_o the_o lord_n jesus_n have_v not_o reserve_v to_o himself_o so_o near_o a_o propriety_n in_o the_o government_n of_o civil_a state_n as_o of_o his_o church_n have_v take_v it_o as_o his_o peculiar_a prerogative_n to_o give_v law_n unto_o his_o church_n and_o preside_v there_o as_o the_o only_a legislator_n but_o unto_o state_n he_o have_v only_o give_v they_o the_o magna_fw-la charta_fw-la of_o the_o moral_a law_n and_o have_v allow_v unto_o they_o a_o legislative_a power_n in_o all_o matter_n concern_v the_o various_a exigence_n and_o divers_a requisite_n with_o attend_v circumstance_n in_o the_o due_a management_n of_o state-jurisdiction_n so_o as_o the_o say_a law_n be_v promote_a of_o the_o common_a peace_n and_o justice_n of_o their_o dominion_n and_o deducible_a from_o and_o found_v on_o the_o say_a rule_n of_o distributive_a and_o commutative_a justice_n §_o 20._o the_o law_n of_o man_n that_o be_v just_a and_o reasonable_a may_v take_v place_n in_o all_o thing_n conduce_v to_o the_o be_v and_o well-being_n of_o a_o christian_a commonwealth_n both_o as_o to_o the_o matter_n of_o the_o first_o and_o second_o table_n so_o far_o as_o be_v necessary_a to_o the_o manage_n of_o it_o under_o the_o due_a qualification_n of_o a_o civil_a state_n and_o therefore_o may_v not_o only_o punish_v crime_n commit_v against_o the_o second_o table_n but_o such_o as_o be_v against_o the_o first_o also_o and_o there_o be_v these_o especial_o that_o they_o be_v concern_v in_o 1._o blaspheme_v of_o the_o true_a god_n under_o which_o be_v comprehend_v common_a profane_a swear_n transgression_n especial_o of_o the_o three_o command_n 2._o worship_v of_o false_a god_n a_o sin_n against_o the_o first_o commandment_n 3._o idolatry_n or_o the_o worship_v of_o god_n by_o image_n a_o sin_n against_o the_o second_o commandment_n 4._o profanation_n of_o such_o time_n as_o be_v by_o god_n appropriate_v to_o himself_o for_o public_a worship_n a_o sin_n against_o the_o four_o so_o that_o these_o be_v palpable_a as_o to_o matter_n of_o fact_n clear_a as_o to_o the_o nature_n of_o the_o offence_n and_o of_o dangerous_a consequence_n tend_v to_o the_o eminent_a ruin_n and_o apparent_a danger_n of_o a_o civil_a state_n §_o 21._o in_o the_o concernment_n of_o the_o second_o table_n god_n have_v leave_v the_o civil_a magistrate_n more_o arbitrary_a in_o make_v or_o execute_v civil_a law_n as_o the_o necessity_n of_o the_o state_n do_v require_v lay_v the_o general_a rule_n of_o moral_a justice_n and_o the_o particular_a and_o relative_a benefit_n of_o the_o commonwealth_n and_o subject_n before_o his_o eye_n now_o in_o the_o matter_n of_o the_o first_o table_n be_v the_o moral_a rule_n of_o duty_n towards_o god_n he_o only_o require_v the_o magistrate_n to_o punish_v and_o restrain_v those_o vice_n in_o this_o kind_n that_o be_v notorious_a infectious_a and_o pestilent_a to_o a_o christian_a commonwealth_n in_o matter_n of_o natural_a worship_n reserve_v institute_v worship_n build_v fundamental_o on_o the_o same_o precept_n to_o another_o manner_n of_o dispensation_n wherein_o the_o civil_a magistrate_n be_v not_o to_o intermeddle_v as_o such_o neither_o as_o to_o legislation_n nor_o execution_n of_o penalty_n nor_o deligation_n of_o officer_n §_o 22._o as_o murder_n rapine_n adultery_n perjury_n etc._n etc._n be_v destructive_a to_o property_n community_n and_o relation_n and_o so_o to_o all_o civility_n in_o a_o state_n where_o such_o vice_n predominate_v and_o be_v not_o general_o suppress_v by_o justice_n it_o can_v be_v denominate_v a_o civil_a state_n but_o rather_o a_o pagan_a savage_a nation_n so_o where_o false_a god_n be_v multiply_v and_o worship_v the_o true_a god_n be_v blaspheme_v open_o and_o notorious_o and_o all_o time_n for_o public_a worship_n of_o he_o by_o his_o own_o appointment_n profane_v public_o and_o general_o and_o such_o vice_n not_o suppress_v by_o magistrate_n such_o a_o state_n can_v be_v call_v a_o christian_a civil_a state_n but_o heathenish_a whatever_o moral_a justice_n there_o be_v between_o man_n and_o man_n §_o 23._o though_o all_o sin_n be_v alike_o breach_n of_o god_n law_n yet_o none_o but_o those_o of_o a_o more_o gross_a external_a and_o exemplary_a nature_n fall_v under_o the_o cognizance_n of_o man_n justice_n the_o blasphemy_n profaneness_n and_o concupiscence_n of_o the_o heart_n be_v not_o punishable_a by_o man_n it_o must_v come_v to_o the_o magistrate_n per_fw-la allegata_fw-la &_o probata_fw-la that_o such_o a_o one_o blaspheme_v god_n worship_v a_o idol_n profane_v the_o name_n of_o god_n by_o swear_v etc._n etc._n and_o that_o open_o either_o in_o contempt_n of_o that_o god_n that_o be_v worship_v or_o that_o worship_n set_v up_o or_o in_o order_n to_o the_o delusion_n and_o seduction_n of_o other_o for_o it_o will_v seem_v very_o hard_a to_o break_v into_o the_o private_a house_n or_o apartment_n of_o idolater_n that_o may_v dwell_v in_o the_o land_n and_o proceed_v judicial_o against_o they_o for_o that_o religion_n which_o they_o be_v peacible_o retire_v to_o without_o any_o endeavour_n to_o publish_v or_o prupagate_v to_o the_o disturbance_n of_o the_o public_a or_o infection_n of_o other_o but_o no_o magistrate_n ought_v to_o suffer_v that_o god_n to_o be_v open_o blaspheme_v which_o he_o worship_v if_o heathen_n in_o a_o false_a worship_n be_v zealous_a upon_o this_o account_n how_o much_o more_o ought_v christian_n though_o no_o magistrate_n can_v enforce_v any_o subject_a to_o worship_v his_o god_n or_o aught_o to_o do_v it_o by_o a_o penal_a law_n as_o have_v be_v say_v yet_o he_o may_v punish_v he_o for_o blaspheme_v he_o or_o for_o seduce_v any_o from_o the_o worship_n of_o the_o true_a god_n yea_o for_o apostatise_v from_o the_o worship_n of_o the_o true_a god_n after_o he_o have_v own_v it_o precept_n and_o persident_n in_o the_o old_a testament_n be_v pregnant_a to_o these_o purpose_n which_o i_o need_v not_o enlarge_v on_o those_o that_o read_v the_o scripture_n be_v acquaint_v with_o they_o but_o we_o find_v no_o precept_n nor_o example_n for_o endeavour_v to_o reduce_v a_o poor_a heathen_a from_o bare_a idolatry_n to_o the_o worship_n of_o the_o true_a god_n by_o pecuniary_a mulct_n and_o corporal_a punishment_n and_o i_o be_o sure_a christ_n never_o practise_v it_o nor_o command_v it_o in_o the_o new_a testament_n §_o 24._o the_o great_a difficulty_n that_o yet_o attend_v this_o case_n allow_v the_o magistrate_n a_o power_n as_o such_o in_o some_o matter_n concern_v our_o duty_n direct_o to_o godward_o what_o be_v adequate_a and_o proportionate_a penalty_n in_o such_o case_n as_o these_o for_o the_o magistrate_n power_n be_v always_o insignificant_a whatever_o the_o law_n be_v if_o there_o be_v not_o a_o penalty_n annex_v to_o it_o and_o vigour_n in_o the_o just_a execution_n thereof_o now_o the_o enquiry_n be_v of_o what_o kind_n and_o degree_n of_o punishment_n of_o such_o transgression_n aught_o to_o be_v answ_n i_o apprehend_v it_o be_v a_o hard_a thing_n to_o determine_v to_o all_o man_n satisfaction_n i_o know_v some_o have_v recourse_n to_o the_o proceed_n of_o the_o judicial_a law_n which_o be_v but_o the_o reduction_n of_o the_o moral_a law_n into_o civil_a practice_n for_o the_o state_n of_o the_o jew_n and_o look_v upon_o they_o as_o bind_v to_o christian_a magistrate_n but_o i_o suppose_v the_o judicial_a law_n to_o be_v rather_o presidential_a only_o that_o christian_a magistrate_n may_v take_v a_o measure_n thereby_o for_o the_o degree_n of_o penalty_n set_v aside_o their_o different_a emergency_n of_o state_n and_o extraordinary_a case_n when_o god_n will_v make_v one_o sinner_n in_o a_o case_n exemplary_a to_o all_o age_n by_o his_o
