by_o martial_a law_n and_o by_o authority_n of_o such_o commission_n as_o aforesaid_a 2_o which_o commission_n and_o all_o other_o of_o like_a nature_n be_v whole_o and_o direct_o contrary_a to_o gentleman_n the_o answer_n i_o have_v already_o give_v you_o be_v make_v with_o so_o good_a deliberation_n and_o approve_v by_o the_o judgement_n of_o so_o many_o wise_a man_n that_o i_o can_v not_o have_v imagine_v but_o that_o it_o shall_v have_v give_v you_o full_a satisfaction_n but_o to_o avoid_v all_o ambiguous_a interpretation_n and_o to_o show_v you_o that_o there_o be_v no_o doubleness_n in_o my_o meaning_n i_o be_o willing_a to_o please_v you_o in_o word_n as_o well_o as_o in_o substance_n read_v your_o petition_n and_o you_o shall_v have_v a_o answer_n that_o i_o be_o sure_a will_v please_v you_o and_o then_o cause_v the_o petition_n to_o be_v read_v distinct_o by_o the_o clerk_n of_o the_o crown_n the_o clerk_n of_o the_o parliament_n read_v the_o king_n answer_v thereto_o in_o these_o word_n soit_fw-fr droit_n fait_z come_z est_z desire_n which_o be_v let_v right_o be_v do_v as_o be_v desire_v this_o answer_n and_o the_o manner_n of_o confirm_v this_o law_n i_o have_v the_o rather_o recite_v because_o the_o king_n answer_n and_o circumstance_n relate_v thereunto_o be_v whole_o leave_v out_o in_o our_o last_o print_a book_n of_o statute_n the_o petition_n itself_o be_v so_o plain_a that_o there_o need_v no_o comment_n thereon_o only_o the_o reader_n may_v observe_v that_o the_o thing_n therein_o mention_v be_v the_o ancient_a right_n of_o the_o people_n and_o therefore_o they_o express_o demand_v they_o of_o the_o king_n as_o their_o right_n and_o liberties_n in_o the_o next_o place_n we_o shall_v add_v the_o late_a excellent_a habeas_fw-la corpus_fw-la act_n because_o relate_v to_o the_o same_o subject_a viz._n the_o free_n of_o the_o subject_a from_o causeless_a tedious_a and_o arbitrary_a imprisonment_n anno_fw-la tricesimo_fw-la primo_fw-la caroli_n secundi_fw-la regis_fw-la chap._n ii_o a_o act_n for_o the_o better_a secure_v the_o liberty_n of_o the_o subject_a and_o for_o prevention_n of_o imprisonment_n beyond_o sea_n common_o call_v the_o habeas_fw-la corpus_fw-la act._n i._o whereas_o great_a delay_n have_v be_v use_v by_o sheriff_n gaoler_n and_o other_o officer_n to_o who_o custody_n any_o of_o the_o king_n subject_n have_v be_v commit_v for_o criminal_a or_o suppose_a criminal_a matter_n in_o make_v return_v of_o writ_n of_o habeas_fw-la corpus_fw-la to_o they_o direct_v by_o stand_v out_o a_o alias_o and_o plury_n habeas_fw-la corpus_fw-la and_o sometime_o more_o and_o by_o other_o shift_n to_o avoid_v their_o yield_a obedience_n to_o such_o writ_n contrary_a to_o their_o duty_n and_o the_o know_a law_n of_o the_o land_n whereby_o many_o of_o the_o king_n subject_n have_v be_v and_o hereafter_o may_v be_v long_o detain_v in_o prison_n in_o such_o case_n where_o by_o law_n they_o be_v bailable_a to_o their_o great_a charge_n and_o vexation_n ii_o for_o the_o prevention_n whereof_o and_o the_o more_o speedy_a relief_n of_o all_o person_n imprison_v for_o any_o such_o criminal_a or_o suppose_a criminal_a matter_n 2_o be_v it_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o advice_n and_o consent_n of_o the_o lord_n spiritual_a and_o temporal_a and_o commons_o in_o this_o present_a parliament_n assemble_v and_o by_o the_o authority_n thereof_o that_o whensoever_o any_o person_n or_o person_n shall_v bring_v any_o habeas_fw-la corpus_fw-la direct_v unto_o any_o sheriff_n or_o sheriff_n goaler_n minister_n or_o other_o person_n whatsoever_o for_o any_o person_n in_o he_o or_o their_o custody_n and_o the_o say_a writ_n shall_v be_v serve_v upon_o the_o say_a officer_n or_o leave_v at_o the_o goal_n or_o prison_n with_o any_o of_o the_o under_o officer_n under_o keeper_n or_o deputy_n of_o the_o say_a officer_n or_o keeper_n that_o the_o say_a officer_n or_o officer_n his_o or_o their_z under_z officer_n or_o keeper_n or_o deputy_n shall_v within_o three_o day_n after_o the_o service_n thereof_o as_o aforesaid_a unless_o the_o commitment_n aforesaid_a be_v for_o treason_n or_o felony_n plain_o and_o special_o express_v in_o the_o warrant_n of_o commitment_n upon_o payment_n or_o tender_a of_o the_o charge_n of_o bring_v the_o say_a rule_n order_n or_o command_v nor_o no_o injunction_n protection_n or_o privilege_v whatsoever_o nor_o any_o more_o than_o one_o imparlance_n shall_v be_v allow_v except_v such_o rule_n of_o the_o court_n wherein_o the_o action_n shall_v depend_v make_v in_o open_a court_n as_o shall_v be_v think_v in_o justice_n necessary_a for_o special_a cause_n to_o be_v express_v in_o the_o say_a rule_n convict_v thereof_o shall_v be_v disable_v from_o thenceforth_o to_o bear_v any_o office_n of_o trust_n or_o profit_n within_o the_o say_a realm_n of_o england_n dominion_n of_o wales_n or_o town_n of_o berwick_n upon_o tweed_n or_o any_o of_o the_o island_n territory_n or_o dominion_n thereunto_o belong_v 8._o and_o shall_v incur_v and_o sustain_v the_o pain_n penalty_n and_o forfeiture_n limit_v ordain_v and_o provide_v in_o and_o by_o the_o statute_n of_o provision_n and_o praemunire_n make_v in_o the_o sixteen_o year_n of_o king_n richard_n the_o second_o 9_o and_o be_v incapaple_n of_o any_o pardon_n from_o the_o king_n his_o heir_n or_o successor_n of_o the_o say_a forfeiture_n loss_n or_o disability_n or_o any_o of_o they_o 13._o provide_v always_o that_o nothing_o in_o this_o act_n extend_v to_o give_v benefit_n to_o any_o person_n who_o shall_v by_o contract_n in_o write_v agree_v with_o any_o merchant_n or_o owner_n of_o any_o plantation_n or_o other_o person_n whatsoever_o to_o be_v transport_v to_o any_o part_n beyond_o the_o sea_n and_o receive_v earnest_a upon_o such_o agreement_n although_o that_o afterward_o such_o person_n shall_v renounce_v such_o contract_n 14._o provide_v always_o and_o be_v it_o enact_v that_o if_o any_o person_n or_o person_n lawful_o convict_v of_o any_o felony_n shall_v in_o open_a court_n pray_v to_o be_v transport_v beyond_o the_o sea_n and_o the_o court_n shall_v think_v fit_a to_o leave_v he_o or_o they_o in_o prison_n for_o that_o purpose_n such_o person_n or_o person_n may_v be_v transport_v into_o any_o part_n beyond_o the_o sea_n this_o act_n or_o any_o thing_n therein_o contain_v to_o the_o contrary_a notwithstanding_o 15._o provide_v also_o and_o be_v it_o enact_v that_o nothing_o herein_o contain_v shall_v be_v deem_v construe_v or_o take_v to_o extend_v to_o the_o imprisonment_n of_o any_o person_n before_o to_o first_o day_n of_o june_n one_o thousand_o six_o hundred_o seventy_o and_o nine_o or_o to_o any_o thing_n advise_v procure_v or_o otherwise_o do_v relate_v to_o such_o imprisonment_n any_o thing_n herein_o contain_v to_o the_o contrary_a notwithstanding_o 16._o provide_v also_o that_o if_o any_o person_n or_o person_n at_o any_o time_n resiant_a in_o this_o realm_n shall_v have_v commit_v any_o capital_a offence_n in_o scotl._n or_o ireland_n or_o any_o of_o the_o island_n or_o foreign_a plantation_n of_o the_o king_n his_o heir_n or_o successor_n where_o he_o or_o she_o aught_o to_o be_v try_v for_o such_o offence_n such_o person_n or_o person_n may_v be_v send_v to_o such_o place_n there_o to_o receive_v such_o trial_n in_o such_o manner_n as_o the_o same_o may_v have_v be_v use_v before_o the_o make_n of_o this_o act_n any_o thing_n herein_o contain_v to_o the_o contrary_a notwithstanding_o 17._o provide_v always_o and_o be_v it_o enact_v that_o no_o person_n or_o person_n shall_v be_v sue_v implead_v molest_v or_o trouble_v for_o any_o offence_n against_o this_o act_n unless_o the_o party_n offend_v be_v sue_v or_o implead_v for_o the_o same_o within_o two_o year_n at_o the_o most_o after_o such_o time_n wherein_o the_o offence_n shall_v be_v commit_v in_o case_n the_o party_n grieve_v shall_v not_o be_v then_o in_o prison_n and_o if_o he_o shall_v be_v in_o prison_n then_o within_o the_o space_n of_o two_o year_n after_o the_o decease_n of_o the_o person_n imprison_v or_o he_o or_o her_o delivery_n out_o of_o prison_n which_o shall_v first_o happen_v 18._o and_o to_o the_o intent_n no_o person_n may_v avoid_v his_o trial_n at_o the_o assize_n or_o general_a gaol_n delivery_n by_o procure_v his_o removal_n before_o the_o assize_n at_o such_o time_n as_o he_o can_v be_v bring_v back_o to_o receive_v his_o trial_n there_o 2._o be_v it_o enact_v that_o after_o the_o assize_n proclaim_v for_o thatcounty_n where_o the_o prisoner_n be_v detain_v no_o person_n shall_v be_v remove_v from_o the_o common_a gaol_n upon_o any_o habeas_fw-la corpus_fw-la grant_v in_o pursuance_n of_o this_o act_n but_o upon_o any_o such_o habeas_fw-la corpus_fw-la shall_v be_v bring_v before_o the_o judge_n os_fw-la assize_n in_o open_a court_n who_o be_v thereupon_o to_o do_v what_o to_o justice_n shall_v appertain_v 19_o provide_v nevertheless_o that_o after_o the_o assize_n be_v end_v any_o person_n or_o person_n detain_v may_v have_v his_o or_o her_o habeas_fw-la corpus_fw-la according_a to_o the_o direction_n and_o intention_n of_o this_o act._n 20._o and_o be_v it_o also_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o information_n suit_n or_o action_n shall_v be_v bring_v or_o exhibit_v against_o any_o person_n or_o person_n for_o anyoffence_n commit_v or_o to_o be_v commit_v against_o the_o form_n of_o this_o law_n it_o shall_v be_v lawful_a for_o such_o defendant_n to_o plead_v the_o general_n issue_n that_o they_o be_v not_o guilty_a or_o that_o they_o own_v nothing_o and_o to_o give_v such_o special_a matter_n in_o evidence_n to_o the_o jury_n that_o shall_v try_v the_o same_o which_o matter_n be_v plead_v have_v be_v good_a &_o sufficient_a in_o law_n to_o have_v discharge_v the_o say_a defendant_n or_o defendant_n against_o the_o say_a information_n suit_n or_o action_n &_o the_o say_a matter_n shall_v be_v then_o as_o available_a to_o he_o or_o they_o to_o all_o intent_n and_o purpose_n as_o if_o he_o or_o they_o have_v sufficient_o plead_v set_v forth_o or_o allege_v the_o same_o matter_n in_o bar_n or_o discharge_v of_o such_o information_n suit_n or_o action_n 21._o and_o because_o many_o time_n person_n charge_v with_o petty_a treason_n or_o felony_n or_o as_o accessary_n thereunto_o be_v commit_v upon_o suspicion_n only_o whereupon_o they_o be_v bailable_a or_o not_o according_a as_o the_o circumstance_n make_v out_o that_o suspicion_n be_v more_o or_o less_o weighty_a which_o be_v best_a know_v to_o the_o justice_n of_o peace_n that_o commit_v the_o person_n and_o have_v the_o examination_n before_o they_o or_o to_o other_o justice_n of_o the_o peace_n in_o the_o county_n 2._o be_v it_o therefore_o enact_v that_o where_o any_o person_n shall_v appear_v to_o be_v commit_v by_o any_o judge_n or_o justice_n of_o the_o peace_n and_o charge_v as_o accessary_a before_o the_o fact_n to_o any_o petty_a treason_n or_o felony_n or_o upon_o suspicion_n thereof_o or_o with_o suspicion_n of_o petty_a treason_n or_o felony_n which_o pettytreason_n or_o felony_n shall_v be_v plain_o &_o special_o express_v in_o the_o warrant_n of_o commitment_n that_o such_o person_n shall_v not_o be_v remove_v or_o bail_v by_o virtue_n of_o this_o act_n or_o in_o any_o other_o manner_n than_o they_o may_v have_v be_v before_o the_o make_n of_o death_n therefore_o say_v fortescue_n cap._n 42._o angliae_fw-la jura_n in_fw-la omni_fw-la casu_fw-la libercati_fw-la daunt_v favorem_fw-la the_o law_n of_o england_n do_v in_o all_o case_n favour_v grieve_v his_o executor_n or_o administrator_n who_o shall_v real_o prosecute_v for_o the_o same_o and_o first_o obtain_v judgement_n thereupon_o to_o be_v recover_v in_o any_o court_n of_o record_n at_o westminster_n by_o action_n of_o debt_n bill_n plaint_n or_o information_n wherein_o no_o essoign_n protection_n wager_n of_o law_n aid-prayer_n privilege_n injunction_n or_o order_n of_o restraint_n shall_v be_v in_o any_o wise_a pray_v grant_v or_o allow_v nor_o any_o more_o than_o one_o imparlance_n 2._o and_o if_o any_o person_n against_o who_o any_o such_o judgement_n or_o convict_v shall_v be_v from_o thenceforth_o disable_v and_o become_v by_o virtue_n of_o this_o act_n incapable_a ipso_fw-la facto_fw-la to_o bear_v his_o and_o their_o say_a office_n and_o office_n respective_o 4._o and_o shall_v be_v likewise_o disable_v to_o make_v any_o gift_n grant_v conveyance_n or_o other_o disposition_n of_o any_o of_o his_o land_n tenement_n hereditament_n good_n or_o chattel_n or_o to_o take_v any_o benefit_n of_o any_o gift_n conveyance_n or_o legacy_n to_o his_o own_o use_n 7._o and_o every_o person_n so_o offend_v shall_v likewise_o forfeit_v and_o lose_v to_o debt_n bill_n plaint_n or_o information_n wherein_o no_o essoign_n protection_n wager_n of_o law_n aid-prayer_n privilege_n injunction_n or_o order_n of_o restraint_n shall_v be_v in_o any_o wise_a pray_v grant_v or_o allow_v nor_o any_o more_o than_o one_o imparlance_n 8._o and_o be_v it_o also_o provide_v and_o enact_v that_o if_o any_o person_n shall_v hereafter_o be_v commit_v restrain_v of_o his_o liberty_n or_o suffer_v imprisonment_n by_o the_o order_n or_o decree_n of_o any_o such_o court_n of_o star-chamber_n or_o other_o court_n aforesaid_a now_o or_o at_o any_o time_n hereafter_o have_v or_o pretend_v to_o have_v the_o same_o or_o like_a jurisdiction_n power_n or_o authority_n to_o commit_v or_o imprison_v as_o aforesaid_a 2._o or_o by_o the_o command_n or_o warrant_n of_o the_o king_n majesty_n his_o heir_n and_o successor_n in_o their_o own_o person_n or_o by_o the_o command_n or_o warrant_n of_o the_o council-board_n or_o oâ—_n any_o of_o the_o lord_n and_o begin_v thus_o for_o the_o better_a and_o more_o due_a execution_n of_o the_o statute_n heretofore_o make_v against_o who_o as_o well_v against_o jesuit_n seminary_n priest_n and_o other_o execution_n thereof_o 2._o and_o that_o no_o record_n warrant_v or_o mittimus_fw-la to_o be_v make_v by_o virtue_n of_o this_o act_n or_o any_o proceed_n thereupon_o shall_v be_v reverse_v avoid_v or_o any_o way_n impeach_v by_o reason_n of_o any_o default_n in_o form_n 3._o and_o in_o case_n any_o person_n offend_v against_o this_o act_n shall_v be_v a_o inhabitant_n in_o any_o other_o and_o the_o liberty_n thereof_o shall_v have_v and_o they_o and_o every_o of_o they_o be_v hereby_o impower_v and_o require_v to_o execute_v the_o same_o power_n and_o authority_n within_o london_n and_o the_o liberty_n thereof_o for_o the_o examine_v convict_v and_o punish_v of_o all_o offence_n within_o this_o act_n commit_v within_o london_n and_o the_o liberty_n thereof_o which_o any_o justice_n of_o peace_n have_v by_o this_o act_n in_o any_o county_n of_o england_n and_o shall_v be_v subject_a to_o the_o same_o penalty_n and_o punishment_n for_o not_o do_v that_o which_o by_o this_o act_n be_v direct_v to_o be_v do_v by_o any_o justice_n of_o peace_n in_o any_o county_n of_o england_n 16._o provide_v and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o person_n offend_a and_o convict_a as_o aforesaid_a be_v a_o feme-covert_n cohabit_v with_o her_o husband_n the_o penalty_n of_o five_o shilling_n and_o ten_o shilling_n so_o as_o aforesaid_a incur_v shall_v be_v levy_v by_o warrant_n as_o aforesaid_a upon_o the_o good_n and_o chattel_n of_o the_o husband_n of_o each_o feme-covert_n 17._o provide_v also_o that_o no_o peer_n of_o this_o realm_n shall_v be_v attach_v or_o imprison_v by_o virtue_n or_o force_n of_o this_o act_n any_o thing_n matter_n or_o clause_n therein_o to_o the_o contrary_a notwithstanding_o 18._o provide_v also_o that_o neither_o this_o act_n nor_o any_o thing_n therein_o contain_v shall_v extend_v to_o invalidate_v or_o avoid_v his_o majesty_n supremacy_n in_o ecclesiastical_a affair_n 2._o but_o that_o his_o majesty_n and_o his_o heir_n and_o successor_n from_o time_n to_o time_n and_o at_o all_o time_n hereafter_o exercise_n and_o enjoy_v all_o power_n and_o authority_n in_o ecclesiastical_a affair_n as_o full_o and_o as_o ample_o as_o himself_o or_o any_o of_o his_o predecessor_n have_v or_o may_v have_v do_v the_o same_o any_o thing_n in_o this_o act_n notwithstanding_o note_n upon_o the_o forego_n act._n 1._o by_o the_o title_n preamble_n and_o scope_n of_o the_o act_n it_o appear_v that_o the_o same_o be_v intend_v for_o suppress_v seditious_a conventicle_n under_o pretence_n of_o religious_a worship_n that_o be_v where_o the_o conventicler_n meet_v together_o under_o a_o pretence_n of_o worship_n not_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n but_o indeed_o to_o carry_v on_o ill_a design_n against_o the_o state_n 2._o if_o any_o such_o conventicle_n be_v the_o justices_z know_v it_o by_o the_o oath_n of_o two_o witness_n may_v make_v a_o record_n thereof_o and_o then_o the_o person_n so_o offend_v shall_v forfeit_v so_o as_o in_o the_o act_n you_o have_v hear_v 3._o it_o must_v appear_v upon_o oath_n before_o the_o justice_n or_o confession_n of_o the_o party_n 1._o that_o it_o be_v a_o seditious_a conventicle_n meet_v together_o to_o disturb_v the_o peace_n under_o pretence_n of_o religion_n 2._o that_o the_o worship_n there_o practise_v be_v not_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n so_o that_o the_o informer_n must_v be_v present_a the_o whole_a time_n of_o the_o meeting_n for_o if_o they_o only_o hear_v a_o man_n pray_v or_o preach_v that_o be_v not_o contrary_a to_o the_o practice_n of_o the_o church_n of_o england_n and_o how_o do_v it_o appear_v that_o they_o do_v not_o read_v the_o liturgy_n 3._o it_o must_v be_v prove_v that_o there_o be_v assemble_v five_o person_n or_o more_o beside_o the_o inhabitant_n in_o the_o house_n 4._o if_o a_o party_n be_v fine_v above_o ten_o shilling_n if_o he_o pay_v down_o the_o money_n or_o it_o be_v levy_v within_o one_o week_n after_o such_o payment_n or_o levy_n he_o may_v appeal_v from_o the_o endless_a vexation_n in_o hunt_v after_o meeting_n to_o no_o purpose_n whereas_o the_o act_n enjoin_v he_o no_o such_o trouble_n and_o if_o you_o go_v once_o and_o find_v no_o conventicle_n you_o be_v
